Thank you for giving us a chance to respond to this issue. He has paid the rate guarantee fee before, on 5/514. Why is he now saying that he didn’t knowabout it? If he didn't have a problem with it a year ago, why now? If he forgot to cancel before his next fee was due, he
should just admit he forgot and move on Not blame us for somehow deceiving him orchanging the rules, and being a "Shaddy *** company".Again, he has paid it before without a meltdown. (Did he forget?) In December of we raised our fees to $per month. His rate did not even go up the agreement stated $until May, the end of his month rate lock, let alone theadditional $34.99. Anyone with a basic math understanding could do the math and see that he was not harmed. He got what he paid for. We sent out a notice in November, so he had sixmonths to cancel if he wanted to. He claims we failed to inform him of this term in the agreement. He checked the box saying that he not only read and understood the whole agreement but agreed. Why would he do this if he didn’t agree? We even sent him a copy of the agreement when he signed upHow are we to know that he is moving? Did he tell us? Or are we to read his mind? This was not only explained to him, but he acknowledged that he read and understood the agreement. He must conveniently not remember this now. Again, poor formon his part to be at fault but blame someone else. It would explain his very “classy” rating online, where he used the word “shady *** company” to describe the only partyto this agreement that has delivered just what was agreed to, when he came in of his own free will and choice and signed up. Without excuses! Some kids needto grow up. I hope he does.Our Office Manager did respond the same day as your email was sent in. He must not have liked the answer. We provide a method that is not only thestandard in not only this industry, but most finance companies. Just send a letter from wherever you are in the world, and tell us who you are, your number is on the free key tag we gavehim, and what you want done. How hard is this? It costs almost nothing to buy the stamp and drop it into any mailbox worldwide. We don’t require you to travel back and cancel in person on some arbitrary day and time. I’m sure he could even drop it off in person to *** on his way back home. I really love how selective the students arewith the “Honor” code. Thousands of members cancel every year. Even when they move. Why does this guy struggle so much more than 99.9% if all these others? Desired Settlement: "I expect World Gym to straighten up their business practices, be more upfront about their hidden fees, and change their cancellation policy to make it alittle easier on struggling college students who move to cities where there are no World Gym locations near them". I agree that this student is struggling to understand and read. We explain it at sign up, we send them a copy that incudes all the terms and conditions. We give a method of cancellations that is not only convenient and not prohibitive. We have great staff, and we are anything but "shaddy ***". We own land, equipment, employee people and pay taxes. We have been around for over years in Rexburg, and we plan on staying. We haven't been around by being "shaddy *** gym". I hope this kid grows up
