Member signed a 12 month term on September 14th, 2010. Regular billings successfully occurred biweekly on Fridays until members March 15th, 2011 was returned with an Account Closed decline reason.
The following course of events...

occurred prior to member being sent to a third party for further collection action:
March 17th, 2011 - Member called our head office and was advised of past due. Member claimed to have cancelled, he was asked if he submitted this in writing to which member responded "no". Member Rep instructed member to go to a World Health facility to fill out a cancellation form and pay arrears.
March 18th, 2011 - An auto dialer phoned member regarding past due
April 8th, 2011 - Internal collections left message on member's cell phone
April 21, 2011 - Member spoke with a Member Rep, told employee he would pay past due once he gets a job.
May 20th, 2011 - An auto dialer phoned member's regarding past due
May 20th, 2011 - Member returned called said again he would pay as soon as he can
June 6th, 2011 - Internal collections left message on member's cell phone
June 30th, 2011- Internal collections left message on member's cell phone
July 7th, 2011 - Final notice was sent to address on file
August 10th - Member spoke with an Internal Collections Rep. Member stated he just started working and can pay the balance by mid-September. Member requested a statement showing balance owing be sent to him. This was sent to an email address provided by member.
February 8th, 2012 - Promise to pay was broken and member was sent to [redacted] for 3rd party collections.
With all the above illustrated, member was fully aware of the debt he owed World Health. No cancellation was submitted to one of our facilities and member was given many opportunities to clear up the past due.
This is a valid debt and will remain listed with [redacted].

On January 31st, 2015 [redacted] purchased a 1 year membership billed biweekly, starting February 13th, 2015. 26 biweekly payments are required under the obligation of the agreement, however after the initial term, as clearly stated on the...

front of the signed agreement:
"I agree to pay bi-weekly dues of $29 (plus GST) starting 02/13/2015, for 26 biweekly payments. My membership will continue automatically thereafter for every subsequent 2 week period until cancelled in accordance with this agreement."
Term and Condition 10 on the back [redacted]'s membership states the following:
"CANCELLATION OF AGREEMENT BY THE MEMBER: The member may terminate this agreement as follows: (a) MONTHLY DUES MEMBERSHIP: After the expiration of the agreed number of Monthly Dues the member may terminate this Agreement by, (i) completing a cancellation form 30 days prior to their next billing date, within any WH facility, or (ii) sending written notice of cancellation by prepaid registered mail 30 days prior to the next due date...."
"Phone, facsimile e-mail, or verbal cancellation are not accepted"
[redacted] has spoken to Member Services and myself, the Director of Member Services. As stated directly to him, we are unable to issue a refund for the charges billed after the obligation as per the terms and condition of his signed agreement.
Our staff are fully trained in our cancellation procedure and many steps occur to ensure no cancellations are missed. The following occurs on accounts that cancel in our facilities:
1. Member is checked into the facility to review account and eligibility to cancel
2. Cancellation form is filled out by member, signed both by member and employee
3. The form is a carbon copy, this enables to retain a copy, along with provided a member a copy for their records
4. The cancellation form is uploaded to the members account and a note is made
5. The cancellation form is recorded on a summary sheet, for next day processing.
There was no indication of any of the above steps. On May 11th, [redacted] did visit our facility to fill out the documentation required to cancel a WH membership. The above steps occurred. The cancellation form was filled out with our 30 days' notice (and signed off too). The last billing was to occur on June 3. As a courtesy we waived the 30 days' notice. [redacted]'s final billing with World Health occurred on May 6th, 2016.

I am not satisfied with this response.

The employee did not ask to scan my card nor did the employee offer me any paperwork to do so. Whether or not this is proper procedure, the employee failed to follow through with their duties when a customer asks them about cancelling their account and that is what caused the problem in the first place.
I had signed a 1 year contract and had not used my membership since August 2015. I had purchased 2 trainer packages on top of the membership. I have no issues with paying that as that was what I had signed up for and knew what I was paying for. I did not wish to keep my membership active for longer than that as I was not even using it.
I had confirmed that it was within 3 weeks prior to the end of my contract that I had entered the gym to ensure the cancellation of my account. I can't find the exact date that I entered the facility as they did not give me paperwork when I did enter, however they do have the means to find out as they have recordings of who enters the building.

Member purchased a package of 12 Personal Training Sessions on January 7th, 2014. The sessions purchased are a discount rate based on the quantity. The terms on the front of the agreement state the member is agreeing to pay 26 billings...

of $XX amount biweekly on Friday. The terms of the agreement also state that no refunds will be issued, for any reason, including unused sessions.
With the above said, member has been in contact with our Personal Training Director. An arrangement was made to have member try one of our other locations. If still not satisfied, a cancellation of the membership for a $150 charge (early cancellation) and a cancellation of Personal Training was approved - As long as usage was paid for. This is arrangement is out of policy and we hope the member is truly satisfied with the new location she is attending.

the Membership agreement, along with the Personal Training purchased was issued.  This refund was made without prejudice and with intent to ensure the [redacted] was satisfied with the resolve of this matter.  With the above said, we would like to take this opportunity to review our current promotion.  World Health is currently offering the 30 day trail, with no strings attached.  This offer is just that, no strings.  We currently have hundreds of potential members using this offer and enjoying our facilities.  This option was 100% available to [redacted].  She was not required to purchase anything to obtain this offer, including the $36.75 facility fee paid, Sign a 1 year Membership Agreement (which was  not signed by a stylus) or provide Visa information for us to bill bi-weekly for the membership charges.  It appears during the initial 2 weeks of being a member with World Health, [redacted] used the membership on a regular basis, including attending Personal Fitness Consultation (which would not be available for use should just the 30 day free trial had been chosen) During one of these consultations, [redacted] purchased Personal Training.  The purchase of this agreement was not a misrepresentation, the purchase was fully executed by [redacted], including intent, based on the sessions that were used to date which per session, have a $52.50 value.  World Health has an everyday, 30 day money back offer for all 1 & 2 year memberships purchased.  This offer is not in conjunction with a 30 day trial.  The 30 day trail is meant for prospects, the 30 day money back is for members only.  This offer allows new members who have joined the opportunity as a member to use our facilities, including the Personal Fitness Consultations that come with the purchase of a World Health membership.  After 30 days, the usage of 2 consultations and 12 checks, if the new member finds World Health not to be a fit, we will refund all charges related to the membership.  Personal Training however is a separate agreement and does not fall under the 30 day money back, however can be cancelled once sessions used have been paid for.  I have since followed up with [redacted] to ensure she is satisfied with the refund and closure in full of both her membership and personal training agreements.  To date, I have not received a response. He told me he just purchase the car from a friend for 850.00.the car had around 155,000 miles.
At that time he told me to see what was wrong with it and do the diagnostics. He left the car
at this time.we finish the testing in a day, we found the ac/dc inverter was bad.I call him and told him
labor and prices,it was 1800.00 .he took 1 days to get back to me give or take.I all so told him at the time
it need maintenance. he ask me to look into it to see how much it was going to be.so I continued
I order the inverter and I told him it was going to take a week.we installed it. the car was working.
so since the car was towed in we never knew the condition of the car how it was running.so we got it running.
we found the tranfer case that holds the mg1 and mg2 was never maintanance this what it uses the keep the 158watts
battery charged.and we found the A/C compressor not working and the belt need to be change.that also cools the battery
he did tell me to change the compressor. I told him the gen 1 witch was made from 1999 to 2001 was not good car
it will keep giving him problms. and will cost him lots of money. so I refues to do the job and keep going
we dont give refunds back on labor and elc parts. we have it post up on the wall. shop warranty and
regalations. ps. he told me after he purchase the car a mouth later it die out. RULE OF PURCHES
DO NOT BUY SOMETHING IF YOU DONT NOW WHAT YOU ARE GETTING INTO . and know what you are buying.
