I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

He is not being honest about what I asked him to do to the driveway as opposed to what he actually did to the driveway.  Specifically, I asked for him:
*  to return in an hour when I would return
*  to cover a small area approximately 10' by 2' along the right side of the driveway
He dumped his entire load of leftover asphalt covering half the driveway leaving 1-2" uneven edges down the middle of the drive.
The following day when he returned with his helper and a bobcat after my male neighbor told him he needed to do so, he most certainly removed as much asphalt on the original drive as was possible to pick up without ruining the original driveway which I did express a good deal of concern about.  My neighbor and I worked along side his man to lift up the soft asphalt for several hours.  He had more helpers arrive and they begin in earnest to try and lift the new asphalt from the driveway when they began to also remove the original driveway surface creating holes in the surface - this is when I made them stop.
He is being disingenuous with his remarks.  I have photos and witnesses.   I most certainly did not pay him for the damage he created as he did not do what I asked him to do.  His remarks about why I refused to pay were part of a longer conversation when he blithely asserted that I now needed a new drive and should just buy one - this is what I said I could not afford to do.

Review: [redacted] dba World Paving was installing a driveway in my neighborhood. On 7/**/14 approx. 1:00 I spoke to him about laying a small amount of his leftover asphalt along side my driveway were I was experiencing erosion. He came to my property at 3:25 as I was leaving for an appointment. He tried to upsell me to replace the driveway which I declined. I showed him an area of 10' x 3' where I said I wanted the asphalt and said I was willing to pay $100-200 for a small amount laid there. He vehemently disagreed and I thanked him for his time, apologized saying I didn't know how pricey a small amount of asphalt would be and went to get in my car. He then said yws he would do it and we agreed to meet back on the property at 4:30pm. When I returned promptly at 4:30, the entire length of my driveway from 3' along the side running down the middle was covered in asphalt - not rolled smooth, not compressed, not feathered in to the surface of the existing driveway. The edge running down the middle of the drive was 2-3" higher then the existing surface and left in lumpy edges as was the edge along the lawn. The following morning I demanded that he repair the damage and was grossly insulted by him and called names. Later in the afternoon, my male neighbor confronted him and he mostly pleasantly agreed to send someone over. [redacted] ran a bobcat bucket over the surface to lift up some asphalt from the original driveway and his crew tried to pry up the new asphalt from the surface. They ended up removing a layer of the original driveway creating a hole about 5' x 3' in an area before I could stop them. At the end of the day they left. The driveway remains with the unwanted asphalt running the length of it extending in areas over the original pavement and now with rough surface and new holes.Desired Settlement: [redacted] bda World Paving needs to pay for a whole driveway replacement. He chose to enter my property while he knew I was not home and took the opportunity to dump his entire load of unused asphalt across my driveway and hand smooth it. My driveway has been made unfixable by me and can now only be completely replaced. The telephone listed on the truck for World Paving is ###-###-####, a cellular phone listed in [redacted] may reside at [redacted]

While working in the neighbourhood of [redacted] a lady approached me and asked if I had any asphalt left over. I advised her that she really needed the whole driveway asphalted, which she said she did not want, just

the left over asphalt. We agreed on the price of $200. After I finished laying the asphalt, she refused to pay me. She gave the excuse that her and her husband are getting divorced and so she wouldn't pay me the $200. After repeated phone calls from her telling me she wanted the asphalt removed. Then when I showed up with the crew of men, she said she wanted the driveway left alone. I never once insulted this lady, I never once called her names. As for damaging the driveway, it already had holes in it before I ever stood on it. She is wanting a brand new driveway for nothing. To this day I have not received any money from her. She said she is not going to give me any money I am owed. So I just let it go and did not speak with her any more on the matter.

Response:

He behaved poorly, created a problem that could not be restored to it's previous state and created further damage in the wake of his solving the problem.
