Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.We have read through the response from WWS and the details that they provide as the my experience in the industry (over years), events to the order process, their representation of the product which have serious been inaccurate and in may ways are an out right lie We have evidence to the sequence of events, their misrepresentation and blatant fraud on their part.Full details can be provided if required but I think that World Wide Stone in prepared to support their lie with more lies to justify their position It is truly unfortunate as Design FX had invested thousands of dollars on display with this factories lines In this situation having sent the wrong materials that where orange, grey and pink (should have been variation of gold & yellow) they have pursue our customers, continue to pursue our clients and are attempt to solicit our sales representatives in a way to advance their company and damage ours Thank you for this opportunity of being a voice on social media to expose World Wide Stone and their desperate attempts to take money from unsuspecting companies and individual This company has gone through one bankruptcy due to the poor actions, this case indicates they might be heading for another closure.Regards, [redacted]

World Wide Stone Corporation (“WWSC”) is did not “pressure” [redacted] (“[redacted]”) to pay the required deposit to confirm its order, as deposit payment is a matter of company policy to confirm an order and reserve the associated material(s).  The process works like this:  Customer...

places its order.  We verify availability or time estimated to produce the item, prepare a quote, called a Proforma Order, upon which all details involving the products are identified by name, order quantities are stated, unit and extended prices are stated, third-party freight charges are obtained and the best offer is stated, any special terms and conditions are stated.  The deposit amount is requested.The product ordered in this matter was Authentic Durango Sol™ Ledger Stone.  [redacted] has long had display boards of this material and knows well the natural colorations range of this natural product.  The end user, referenced by [redacted] as “the client,” originally came directly to WWSC to buy this material in question directly from WWSC.  However, WWSC’s policy is to always send buying interest to our Authorized Authentic Durango Stone™ Dealer, when we have one in the general market area of “the client.”  In this case, we gave it to our Authorized Authentic Durango Stone™ Dealer, [redacted].The original inquiry from [redacted] was on October 29th.  WWSC created a quote for that inquiry at that time, but there were numerous revisions made by [redacted] that changed in quantities, samples and shipping addresses, and that portion of the revisions continued to November 5, 2014, when WWSC has sufficient commitment from [redacted] to get its modified order into production.  More order revisions requested by [redacted] continued to December 5, 2014.  Upon our receipt of the required order deposit, as [redacted] does not have credit terms established with our company, WWSC began producing the order.  This is standard practice, as it has been with [redacted] on all orders for these several years. WWSC met this estimate.  [redacted]’s order was ready to ship within the estimated 3-4 weeks following order confirmation.  As stated on all of our orders, WWSC estimates the completion dates and shipping dates, which are never guaranteed in producing a natural product. Of course, further to that, WWSC has no control over US Customs or Mexican Customs* or third party freight common carriers.  Nonetheless, we estimated accurately.  (*:  WWSC’s factories and quarries are located in Mexico, with all factories in Durango, Durango, Mexico.  Therefore, products shipped ex-factory must go through border customs’ processes.)The golden creamy tones to which [redacted] refers are only one element of the natural colorations range variations that are stated in our price books, used by [redacted], and explained on our sample boards, literature, website and verbally explained to the client, with all of which [redacted] is in possession and is intimately familiar.  [redacted] simply ignores all of those other elements in her complaint.  In the case of [redacted]’s order in question, WWSC spoke many times with [redacted], exposing that the quarry from which the ordered materials would be produced was closed prior to the order, which [redacted] already knew from prior notices by WWSC to its Authorized Authentic Durango Stone™ Dealers; yet, WWSC committed to produce [redacted]’s order from the last remaining raw materials on hand at our factories from that quarry, and that shade variations were, and are present.[redacted] contacted WWSC on December 3, 2014, less than 4 weeks from start of production, asking for an update on order production completion and shipping date ex-factory.  [redacted]’s account representative at WWSC did change once during this transaction’s time period, because the first account representative retired, and in the normal course of business, [redacted]’s account was assigned to a new representative.  At that time, WWSC fully explained to [redacted] that its order had been shipped to [redacted] with all, but one crate, which remained at WWSC’s Scottsdale, AZ location.  This was because one of the trucks that left WWSC’s factories was found to be over the legal weight limit.  Therefore, WWSC was forced to remove one crate and ship it on the next truck leaving our factories.  WWSC, also, explained to [redacted] that the remaining crate was expected to arrive our Scottsdale location on the following Tuesday, December 9, 2014.  [redacted] was adamant that WWSC ship that one crate separately and requested WWSC to ship the bulk portion of [redacted]’s order on December 5, 2014. No portion of the material ordered by [redacted] was ever lost.  WWSC never communicated to [redacted] that any material was lost.  In fact, the opposite occurred.  The only times WWSC requires payment are order confirmation deposit and balance due before the order ships. Because [redacted] changed its order numerous times, final total costs changed with each revision.  Whenever a revision is made on an order, WWSC sends a revised order form to the client, detailing all order quantity revisions, unit and extended prices, third-party freight charges, any other special terms and conditions.  Again, [redacted] has not established credit terms with WWSC, so payment must be received in full prior to shipping to the end destination in accord with WWSC’s company policy.  Again, WWSC clearly communicated that one crate not shipped with the balance of [redacted]’s order was not shipped with the bulk of its order, because of the order being overweight, and that the one crate was never “lost”.[redacted]’s order was in route to [redacted], one crate short, in compliance with [redacted]’s clear direction.  Freight costs are third-party charges, outside the control of WWSC or [redacted], but market driven.  [redacted] accepted the freight charges associated with its order in question.  The material ordered by [redacted], Authentic Durango Sol™ Ledger Stone, is produced, crated and shipped in random lengths, which is well known to [redacted].  Therefore, there is no way that WWSC or [redacted] could know if it was damaged in shipment, unless there was apparent external damage to the crate, which [redacted] did not notate on the receiving bill of lading.  Further, as [redacted] received this material at a long distance from WWSC’s locations, WWSC did not see the delivered crates.  Finally, WWSC is confident that [redacted] signed for the shipment, thereby acknowledging that the material was not damaged.  What [redacted] experienced, when viewing the received material, is the natural colorations range variation in the product ordered, which is explained in all of our sources of product presentations and is a feature of the material, well known to [redacted].  In fact, [redacted] emailed images to WWSC of some of the materials received as a comparison in the same photo of a sample board of a different WWSC product to compare it with another one of our product lines, which was entirely irrelevant.  When you zoom in on the sample board in that photo, sent to WWSC by [redacted] as a comparison, you can see the display board label, stating it is WWSC’s Classic material and not at all the Authentic Durango Sol™ Ledger Stone ordered by [redacted].  [redacted] spoke together with three members of WWSC’s Scottsdale team about this matter on December 4 and 5, 2014.  [redacted], personally, phoned [redacted], WWSC’s VP Operations – Scottsdale, on December 4th, but he was in a meeting.   Immediately after his meeting, he received an email from [redacted], asking him to phone her.  He email-replied that he had another appointment, but would phone her in the morning, which he did do.  WWSC’s team has been nothing but supportive with [redacted] and communicated very courteously and expeditiously.  It is just that [redacted] is not happy that WWSC will not accept the consequences of [redacted]’s errors, financially or otherwise.It is always WWSC’s clients’ choice if they want to be a prepaid account or establish credit terms, subject to underwriting.  If a client has a prepaid account with WWSC, then WWSC’s policy is just that – prepay for the goods prior to picking up or shipping.  Each WWSC client is fully aware of this company policy and best practice and has agreed to terms and conditions of purchase.  The material WWSC shipped to [redacted] was accurately represented and well known to [redacted].WWSC’s quality producing company started 27 years ago and is world renown in the natural dimensional stone industry as providing natural dimensional stone products to the highest of world quality standards.  Our management alone has combined experience of over 100 years.  [redacted] claims 25 years’ industry experience.  [redacted] came to WWSC in 2011, seeking to be an Authorized Authentic Durango Stone™ Distributor and seeking WWSC’s training about natural dimensional stone, which WWSC freely gave to [redacted] and her partner.  For example, WWSC’s President has spent entire days training and coaching them how to successfully establish their sales organization for WWSC’s products.  However, [redacted] went its own way and has not done well.
