Hello,
In response to the complaint, I have attached a copy of our signed membership agreement that clearly states on the front page " that following the initial term, this membership will continue month-to-month, subject to the termination provisions of this agreement. Please see buyers...

right to cancel under section 7.
I can assure you that at no time has the club been in a position of staying open if we felt the environment was unsafe, nor was the club left in any state for the length of time described. I believe the incident described was one of a pipes that broke on the fitness floor that was contained immediately.
I might also add that this is not the first account that has gone into collections status by this individual. I must also add that the additional fee's described as "$90.00" are late, direct bill and return fee's.

Review: In February 2012 I signed up for a 1 year long gym membership from Sport and Health at [redacted].

I paid for the entire year in advance, and told the account representative I did NOT want to be on a month to month contract after the initial contract was concluded. He said that I would need to write an email or letter to terminate the membership and I told him that I would happily write the letter "right now" since I knew I was not going to be living in the area after the year had expired, He said, "Ohh that's fine, let me just put that in the computer".

After February 2013 I was still getting billed and it has just come to my attention..

First off... I did NOT authorize Sport and Health to keep my credit card on file (I specifically mentioned that I wanted to Pay ONCE)

Secondly my credit card number has changed (I had lost my wallet and got a new credit card) So I do not know how they got a new credit card number to bill me.

I moved (from [redacted], Virginia to [redacted] Maryland) in March 2013 in and did not receive any correspondence from Sport and Health that said I was still a member until recently when they notified me that my rates had changed... they had billed me on a month to month basis since March.Desired Settlement: I would like the membership to Sport and Health to be terminated retroactively (as was in the initial contract) as it was explained when I signed up and a refund to my credit card for the fees paid from March 2013 to October 2013. ($73.00 a month)

AS per the attached agreement, "following the initial term, this membership will continue month-to-month until 30 days written notice is received". We have no record of cancellation prior to October 2013. If **. [redacted] has documentation providing prior cancellation, please forward this information and we will research further his claim. Review: This afternoon I was contacted by the manager of Worldgate Sport and Health by phone, regarding a "concern" about my son who was in their child care area last night. I informed him that when I came to pick my son up, that the staff did not inform me that there was any problem with him being in childcare. In fact, they were very rude and unfriendly, and so, I made a complaint about them to the staff at the front counter, which I had done once before. This manager stated that I needed to come see him in person about the "concerns," and I told him that if his staff was unprofessional enough not to inform me when I came to pick my son up, that I didn't want to be informed of anything. I told him that I wanted to cancel my membership, and, instead of trying to cooperate with me and encourage me to maintain my membership, he immediately said, "Ok, we'll cancel your membership!" Along with his and his staff's incredibly rude, belligerent, and unprofessional treatment of me, I'm suspicious that they don't want us at the club because my son is autistic.Desired Settlement: I would like Worldgate Sport and Health to refund all charges on my credit card
