DISHONEST, DECEITFUL, DECEPTIVE BUSINESS PRACTICES
I took my daughter's car to Wow Auto Body in February for an assessment of whether or not the car was totaled. Wow had great google and yelp reviews so I was optimistic this was a reputable, honest business. As it turned out I was completely wrong to trust this business and the owner 'Brian'. He advised me that the car was 'totaled? that upon turning the engine over it sounded like metal grinding. We were devastated because we had just purchased this care for her 6 months earlier and because it was an inexpensive car under 10k, and had no lien on the vehicle we only insured it for liability. We paid cash for her car so hearing that it was totaled after only 6 months was a real gut punch. Brian was there to see our tears and distress, and responded by offering to help us find someone to buy the car for parts. I thought he was so kind to offer to help in this way. I guess I'm too trusting because he was working us the whole time.
The next day he calls to say he's found a 'buyer? for the car who'll pay $600 which was much more than we were able to find on our own. We were still completely devastated by the loss of my 19 year old daughter's first car and her transportation to college and work so we were very pained as we sold the car for a measly $600. Please note, Brian claimed he was the middle man, a third party was supposedly actually the one buying the car. For this reason I didn't try and negotiate a better price with Brian because to my knowledge he wasn't keeping the car.
I WAS SO WRONG ABOUT BRIAN. HE IS A PREDATOR WHO PREYS TRUSTING PEOPLE WHO TAKE HIM AT HIS WORD. THE WHOLE THING WAS A MANIPULATION. BRIAN KEPT THE CAR. BRIAN REPAIRED THE CAR HE TOLD US WAS TOTALED. My daughter drove by his shop last week and did a double take because she thought she recognized her car, but this car had been completely repaired. I went to take a look and CONFIRMED BY VIN # THAT IT IS HER CAR. Brian wasn't there when she went but she spoke to one of his employees who told her that he had repaired the car to give to his mother in law. WE SOLD HIM A 2009 HONDA ACCORD WITH 100K MILES FOR $600 BECUAESE HE ASSURED US THE CAR WAS TOTALED. I'm devastated to realize now that every interaction I had with him he was being DECEPTIVE, DECIETFUL AND DISHONEST. He essentially stole that car from a 19 year old girl. We would have never sold that car if we thought it could be repaired.
When I confronted him about this, he just lied and claimed he didn't say it was totaled and that it wouldn't have been worth it to my family to fix the car, which is not his decision to make. He didn't us the opportunity to make that choice because he LIED AND MANIPULATED US AT EVERY TURN. He claims to have put $6k into the car, which is still far less than the 10k it's costing to replace her car.
Store Credit I had no intention of selling a 2009 Honda Accord for $600 if the car was repairable. Even if I opted not to repair the car i wouldn't have sold it for a "junk/parts only" price. The value of the car in that condition may have been as much as $4500. We only received $600 because we believed Brian when he told me the car was totaled and was only good for parts. This man completely took advantage of of teenager!
On or about January 16, 2020, the Complainant's daughter brought her 2008 Honda Accord to Wow Auto Body to repair collision damages. We understand that the Complainant's daughter purchased the car used for $10,000. Wow Auto Body issued an estimate in the amount of $17,111.56 for the repairs. Due to the fact that the value of the vehicle was far below the amount of the estimate, Mr. (the owner of WOW auto Body) explained that the car was a total loss. Mr. further explained that WOW Auto Body may be able to repair the vehicle using cheaper used parts for approximately $8,000.00 to $10,000.00. Repair was declined in light of costs involved. Consequently, WOW Auto Body entered the specifications of the vehicle into an on-line database to obtain the fair market value of the vehicle in its wrecked condition. Through the database, it was determined that the fair market value of the vehicle in its wrecked condition was $435.00. Based on the foregoing, WOW Auto Body offered to purchase the vehicle for $600.00. The offer was accepted and the title was signed over. Labor costs comprise a significant part of the costs involved in the repair of any vehicle. Because Mr. and his employees are able to use their own labor after business hours to repair vehicles, they are able to repair vehicles at a cost significantly lower than that which a customer would have to pay. As such, Mr. purchased well over $6,000.00 in parts and spent long hours after work to repair this vehicle. The Complainant and her daughter had the option of paying $17,111.56 to repair the vehicle with new parts of $8,000 to $10,000 to repair the vehicle with cheaper used parts. They declined to do so because they either did not have the available funds or they did not think the car was worth repairing. Now that Mr. has spent well over $6,000 in parts and many hours of his own labor to repair the car, they want the car back.
