The company was contacted for an estimate to repair my vehicle. My vehicle, a *** was towed to the W.Y.A LLC for the estimate. After two weeks the company representative contacted me with an estimate of *** and said he would email me a written estimate.

After a week I received a well written detailed estimate which was slightly higher than the original verbal quote. I agreed to meet the representative at the shop with *** required to start the work.

When I got to the shop, the office was dark and the door appeared locked. Soon the representative arrived and after several minutes, he gained access to enter the office and he proceeded to escort me to the back where my vehicle was parked. He then began to show me what he referred to as the mechanical work that was being complete with the deposit I was set to pay that morning. He also explained there would be a separate quote for paint work, which he said had to be matched up but would look like brand new.

I paid the deposit and within a few days he requested the balance to complete "mechanical work. He then sent me a final estimate to complete my van, a total of a little ove ***.

I explained I do not have that kind of money. I explained the most I had was *** I then explained I will need to pick up my vehicle and wait on the body work when I have more money.

The representative then explained he was not able to stop the work and that I had to pay *** of the labor and all of the parts yo pick up my vehicle.

I never paid anything to begin the work a d yet this shop is trying to force me to pay money I never had to begin with.

In response to her complaint, she was shown what was needed and what had to be done. Beyond the mechanical, the body work was more than just paint which we had discussed. Rim was ripped and torn, fender was torn off, frame was bent, as well as other components missing from the vehicle. ***l had clear knowledge that there were two quotes, mechanical and body. She was quoted the body labor alone between *** not including parts, which she agreed upon on multiple occasions when we spoke on the phone. She made it clear that she understood all of these terms. In text messaging she also made it clear that she understood. I have even attempted to be fair and allow payment arrangements. She backed out once receiving the final quote. She originally received parts and labor at a discounted rate. She is now asking for return of the vehicle after not paying for services rendered besides the mechanical portion. The vehicle has been completely repaired, labor has been performed and parts have been bought. *** is requesting a return of her vehicle with free repair, service and labor. I stated once the mechanical contract was paid in full, I would start on the body portion of the job and after repair I would allow her to make payments, so that she would not have to ride-share, which could be costly. I started everything out in good faith. I have made every attempt to try to resolve this issue. I am still willing to allow *** to make payments towards the body repair and return her vehicle once all portions are paid. By law, I am not obligated to return the vehicle until all services are paid in full. I have been fair, honest and within reason with ***.

I reviewed the response from the company and I decline that offer. The company completed work that I did not agree to begin. I did not agree to the estimate nor did I pay a deposit to begin the work as I was required in completing the mechanical work that has been fully paid for. I have attached screen shots of all of our text messages, confirming I never agreed to the work. In fact I stated I just want to pick up my vehicle and maybe get the additional work done at a later date.At this point, I want my van or all of the money I have paid refunded.

We tried coming to a resolution and it seems she now wants the money returned for work completed and agreed upon which is a issue due to the fact hours of work and labor have been performed as well as parts being purchased. What’s can we do moving forward? My company is standing firm on payment for services rendered. There’s no more deals or negotiations moving forward we will take the necessary measures to ensure we are reimbursed next.

I am so disappointed that this situation has developed in this manner. All I wanted was to get my vehicle on the road again. I paid what I had to get the work done that I could. I put my hard earned money and faith in a business that is now holding my vehicle hostage for services I did not authorize. The representative is stating I want a refund on work that was done. No, I want my vehicle back or a refund for services completed that was never ever authorized. I have our complete text history showing I told the representative I could not afford the additional work. I also never paid a deposit to begin said work. I am so disappointed that a business who appeared so trustworthy and honest would be taking me and my family through these changes. When all you had to do at W.Y.A was be honest from the start. Instead, you did a bait and switch. I was realed in with one estimate and when I paid to get the work started, which later became the mechanical work, I was told there would be another estimate for paint and body work. I paid the balance for said mechanical work with no problem. When given the second estimate, I told the business from the start that the amount was more than I could afford. I did not authorize the work and I did not pay any deposit to start said work. I paid for mechanical work and that was it. I hope and pray no other customer falls for the games played at W.Y.A. No one deserves this, especially not a struggling single mother. At this point, I will be filing a police report and contacting a lawyer for further assistance. Sincerely
