Tree trimming for new garage construction was less than adequate, and the service provided was incomplete.
Company came and trimmed the tree. I thought it was discussed that the tree would be trimmed 10 ft back from the garage structure, however the quote says a "2x2" area. I explained that I did not want any branches near the garage.
At any rate, there are still branches that are actually hanging in the garage space. The garage is 16 ft high, as explained to the tree service. I measure the branches still hanging, and they hang as low as 11'5" and they are inside the garage space by a measurement of 4' from the back wall of the to be built garage. The garage was laid out in the back yard with wood markers, before the tree service arrived.

I have been trying to reach them to get the resolved for the past month. I have called almost daily, with no success. I had made 2 appointments with ***, where he did not show up. He did show up one day when I was not home and leave a note saying there would be extra cost if I had wanted more trimmed. I feel that these branches hanging in the garage space are part of the original quote, as they would be hanging in the ceiling space of the garage. I had informed the company many times that this is time sensitive as construction with the garage will be moving forward, and they will be unable to trim while these trades are at work.

I feel like I have been more than fair and patient in dealing with this company. I have tried to reach out to get this completed according to the original agreement. I have called countless times, and have tried everything reasonable to get this resolved. The project is moving forward as the concrete contractor has began setting up his equipment.

Desired Outcome

I feel like since I have done everything reasonable within my control, I will have to find other means to complete this service. It has been one month of calling the company trying to get this service completed. I feel like the invoice should be discounted 50%, from $480.25 to $240.13, original invoice number 5239. I feel like the fact that the original agreement was not met or completed, the poor service to deal with the lack of job completion and the fact that now I am required to complete the job by other means justifies this billing adjustment.

The tree service work requested by Mr. was completed as quoted. His concerns were reviewed and responded to and found to be unsubstantiated. The invoice for services rendered should be paid in full. A detailed description of the situation follows. On April 16, 2018 at 2:43 pm, *** called Wyoming Tree Service's office and spoke to *** at reception. He requested a quote on trimming a *** maple tree in the backyard. *** (estimator and operations manager) attended the site April 18, 2018 and provided a written estimate of $425 plus HST to "lift/thin/deadwood" the Norway maple in the backyard including "remove crossovers & full clean up" and "lift hi on north side" (1.7 hours at the tree service crew's regular rate). In the Job Description section of the estimate, it is noted that the handwritten notes are the actual scope of work quoted (the typed section is the initial description of the customer's request). In the Terms & Conditions section of the estimate, it states that "Any additional work not specified on the quote shall be charged accordingly." On May 1, 2018 at 2:30 pm, *** called and spoke to *** at reception. She transferred the call to *** who answered Mr. questions about his quote and confirmed the job as a work order scheduled for the week of May 7 - 11, 2018. He added the following notes the estimate / work order form at that time "Shed 16 feet tall. Take 10 to 15 feet over that." A copy of the estimate / work order form is attached. On May 9, 2018 at 1:44 pm, Mr. called and left a message for *** with *** M. confirming the scope of work and notifying WTS of 4 foot deep trench in the backyard that tree service crew should be aware of. He requested a phone call a day before scheduling. Due to scheduling be impacted by a local windstorm, the work was not scheduled until May 15- 16, 2018. As per Wyoming Tree Service's procedure, Mr. was called before the tree service crew came. Mr. called the morning of May 16 to remind the tree service crew of trench in backyard. *** M called the tree service foreman *** to ensure he was aware. *** said he had been informed and said he was just finishing cleaning up the job site. *** texted Mr. to let him know everything was okay. Mr. called a second time May 16 to confirm scope of work (10 feet of clearance). He also mentioned that he had an additional bush that he wanted to have chipped. He was informed that the tree service crew had likely left the job site but the message would be passed *** to the foreman. On May 17, 2018 at 4:40 pm, Mr. left a message with *** for *** saying that he thought more trimming should be done. *** reviewed the job site notes and spoke to the foreman *** who said they had been worked on the job from 9:03 to 11:40 am (2.62 hours) May 16, 2018 and felt that they definitely met or even exceeded the scope of work. On May 22, 2018, *** stopped by the job site to inspect the work was done. He found the tree to be trimmed to a clearance of more than 10 feet higher than the proposed shed. He left a note for Mr. stating the work was complete as quoted. Wyoming Tree Service mailed an invoice for the work that was done. On May 23, 2018 at 10:30 am, *** also left a voicemail stating that the work had been reviewed and inspected and had been completed as quoted. On May 24, 2018, Mr. left a voicemail requesting a time to meet to discuss the tree in backyard. On May 29, 2018 at 8:45 am, Mr. left a message with *** for *** saying that he thought the branches were still too low and requested a phone call or meeting. *** called him back later that day and left a voicemail. Mr. returned his call at 3:14 pm May 29, 2018 and they discussed the job. *** said that he had reviewed and inspected the job and found it to be completed as quoted. Although *** did not think it would be required, he told Mr. that, once his shed was built this summer, if he found any branches to be within the 10 foot high clearance of his new shed he would send a tree service crew to trim them. However, based on his visual inspection of the current status of the job, he believed the work to be completed as quoted. On May 31, 2018 at 1:47 pm, Mr. left a message with *** for *** saying that he would try calling again later. On June 6, 2018 at 11:54 am, Mr. left a message saying he was unavailable to meet that day (even though no meeting was scheduled). On June 12, 2018 at 1:35 pm, Mr. called and spoke to *** saying he would "pay half price and hire someone else if Wyoming Tree Service did not finish the trimming". On June 13, 2018, Mr. called and spoke to *** saying he needed to know if WTS will remove "the branch" otherwise he would remove it himself. *** (administrative manager) returned his call and left a voicemail. Mr. called and spoke to *** June 14, 2018 at noon. Mr. called and spoke to *** June 15, 2018 at 2:35 pm, offering to pay half of his invoice. Mr. was told repeatedly that his work had been completed as quoted. His concerns were addressed and responded to but found to be unsubstantiated. It is Wyoming Tree Service's position that the invoices for services rendered should be paid in full.

Based on the statements below and my actual measurements taken, the job is not complete.

In Wyoming Tree's response as follows:

Although *** did not think it would be required, he told Mr. that, once his shed was built this summer, if he found any branches to be within the 10 foot high clearance of his new shed he would send a tree service crew to trim them. "

As stated before I have done everything reasonable to give this company every opportunity to complete the job.

I also find the company Wyoming Tree Services statement that my claim is unsubstantiated to be false. As you can read in my original claim the following: "At any rate, there are still branches that are actually hanging in the garage space. The garage is 16 ft high, as explained to the tree service. I measure the branches still hanging, and they hang as low as 11'5" and they are inside the garage space by a measurement of 4' from the back wall of the to be built garage. The garage was laid out in the back yard with wood markers, before the tree service arrived. "

Based on the fact the job is incomplete, I feel like the invoice should be discounted 50%, from $480.25 to $240.13, original invoice number 5239.

Wyoming Tree Service maintains the position that the work was completed. Mr. appears to have a different assessment of the job. As previously noted, although *** (the operations manager who quoted this job) "did not think it would be required, he told Mr. that, once his shed was built this summer, if he found any branches to be within the 10 foot high clearance of his new shed he would send a tree service crew to trim them". Mr. indicated that the construction of the shed was imminent. *** believes that once the shed is erected it will be evident that tree clearance was completed as quoted. If not, he stands by his original offer to send a tree crew to do any necessary trimming at no additional charge. Wyoming Tree Service feels this is a fair way to address the variance in opinions on the work.
