In response to Mr***'s complaint regarding his personal training and contract cancellation, please allow me to explain the actual facts of his membership
Mr*** joined our gym on June 9th, 2015, signing an month agreementOur
cancellation policy is very specific, wherein a member may cancel if they move miles or more away from us, or if there is a permanent medical conditionIf they provide documentation of either scenario, we will cancel their membership for a small fee
At one time, Mr*** brought his brother in, (along with an interpreter) to add him to his membershipHe was never charged for his brother, as about a week later, he came back in with the interpreter again, and she said he wanted to cancel because he was movingI informed her that I needed verification of his move, and I never heard from either one of them again
As far as his personal trainer is concerned, Mr*** was constantly late for his appointments, or not showing up at allHe never notified his trainer that he would not be comingMr*** would tell his trainer that he was busy going to school, and doing many other thingsMr*** told his trainer because he was so busy, that he would get back with him when he had more time to trainAgain, he was never heard from
We are here and open to train Mr***We will even cancel his membership if he can provide proof of his move

En cuanto al entrenadorEl Sr *** tiene pruebas de sus conversaciones con el entrenador (el entrenador tambien cancelaba la sessiones por diversas razones entre ellas, salidas familiares y su esposa que estaba embarazada por sus molestias, y cuando tuvo a su bebe no estuvo disponioble varios dias, porque su esposa tuvo problemas en el parto y requeria cuidados postparto, y luego de unas semanas ya no podia entrenar igual por que necesitaba ayudar a su esposa con sus bebe) y igualmente tengo pruebas de cuando Sr.*** se comunicaba con el entrenador porque se iba a llegar tarde por su horario de trabajo, lo cual desde el principio se le indico al entrenador de que el Sr *** no tenia un horario fijo de salida y por eso podia variar la hora para entrenamiento y el indico que no tenia ningun problema, se termino el entrenamiento por los diversos situaciones a cuanto tiempo de ambas partes del Sr*** y del entrenadorDe que no supieron mas del Sr*** y su hermano no es correcto por que al parecer se le olvida que el hermano asiste a sus facilidades por que tiene un membresia por mesesEl Sr*** se mudo de residencia, tiene prueba la cual sera enviada

In regards to the trainerMr*** has proof of his conversations with the trainer (the trainer also canceled sessions for various reasons included in those, going out with his family and also due to his wife not feeling well due to her pregnancy, and when the baby was born he was not available for a few days because his wife had complications and needed post-partum care, and then after a few weeks he could not train the same because he needed to help his wife with the baby) and I also have proof that when Mr*** communicated with the trainer that he would be late due to his work schedule, which was told since the beginning to the trainer that Mr*** did not have a set time he would be out of work and because of this the time he could train would vary and he indicated he did not have a problem with this, the training was terminated due to the time issues between Mr*** and the trainerIt is incorrect that they did not hear back from Mr*** and his brother because it seems they forget the brother still assist their facility as he has a three month passMr*** has moved, he has proof that will be sent

I am responding to a recent complaint our business received concerning assigned ID #11941349. On July 9th of 2015, Ms. [redacted] signed a 36 month contractual agreement with X Factor Fitness. Enclosed you will find said document, with Ms. [redacted]'s signature. By signing this agreement,...

Ms. [redacted] agreed that X Factor Fitness may charge her debit card and/or checking account for her monthly dues of $34.99. Ms. [redacted] failed to have her funds available when they were due on Jan 14th of this year. She was notified that we were unable to process her dues. She informed me that she would check with her bank to see what the problem was. The next day she received a text regarding this same situation which upset her, thus the complaint. She demanded that I send her, her contract, which I did via email. (Every member receives a copy of their agreement via email when they sign up). She said that she did not receive it even after it was sent, so I saved a copy of the contract to our computer, and sent it as an attachment. Unfortunately, sending it this way eliminates the signature because it does not save the contract in it's original form due to the electronic signature pad. I explained to her that I would have to print it out, and send it through regular mail. Apparently that was not sufficient to Ms. [redacted], and immediately spewed her anger via social media, and this complaint. l attempted to resolve this issue by letting her know I would send her agreement in the mail, but her actions noted above, indicate she wanted immediate self-vindication. As a small business, we expect our customers to pay their dues, and it is their responsibility to update us if their billing information changes. 1 cannot control Ms. [redacted]'s reaction to our request that she pay her dues that were owed. As a resolution to this, we have determined that we do not want Ms. [redacted] as a member of our gym any longer, and happily canceled her agreement with X Factor Fitness. She was refunded $90.00 that she paid for personal training that went unused. These were funds that we did not have to return to Ms. [redacted], as our personal training is non-refundable. Please let me know if I can be of further assistance to this matter, but 1 hereby consider this resolved. Respectfully, Denise [redacted]
