The tenant never gave us written notice of a problem as required by law. After she did let us know, we immediately did an inspection of the home and did not find mold. She did not pay the rent for the last month that she had possession of the home. The security deposit was being held by the owner...

It was returned once due to a typo on our part. We never mailed a check. Nothing was ever due to the tenant because of the unpaid rent, cleaning, etc.
I actually have proof od emails about the issue and according to my lease email was an accepted form of communication. I was charged for things that were wrong with the unit prior to moving in and was led to believe that I was getting a refund when instead they sent me a bill. The condo was nit habitable and was ignored for quite some time. I sent multiple emails along with photos of my concerns and nothing was done.
The tenant did not pay the rent and moved out breaking the lease. I did not tell her she was getting her deposit back, just that she would receive the disposition of deposit (which is attached). She said the home was inhabitable in order to break the lease. It was not. She moved out and returned the keys at the end of the month. We could have required her to pay for the rent after move out until it was rented but felt we would give her a break. The home was very dirty and we have pictures. You can see that we did not charge her "for things that were wrong with the unit prior to moving in".
