Advised to enter into an escrow account agreement at the closing of property purchase. Issue manifested itself that the escrow account was drafted to specifically address, Xeisin Title company drafted the agreement wording. I had to employ a lawyer to assist with access to the escrow account. He took one look at the agreement and declared it no good. My complaint is this, the advice offered, the recommendation of establishing the escrow account, and the wording of the escrow agreement was inadequate, they are professionals, and should not have recommended and drafted a vehicle they have no knowledge of. It has resulted in me being denied access to the escrow account and having to expend several thousand dollars to fix the electrical system that was noted during the initial inspection.

Re Complaint ID; ***Dear Mr.:The facts of this matter are as follows:The Real Estate Agent for Mr. for his real estate purchase drafted the Escrow Agreementthe day of closing and presented copies of it to Xeisin.Xeisin did not draft an escrow agreement nor did Xeisin make any suggestions as to any wordingof an escrow agreement.The Seller-informed Xeisin that in order to go to closing it agreed to hold 12K Escrow untilspecific items outlined in escrow agreement were met.The Buyer and Seller signed agreement.Under the express terms of the agreement, Xeisin was only tasked with holding Escrow fundsuntil items completed.The Buyer and Seller are disputing over whether work was completed or not.The Seller believed it has met its obligation and escrow can be released to it.The Buyer disagreed and decided to have work done on his own. He attempted to recover hisexpenses from Seller Escrow.We had no authority to release money on our own. We submitted the request to the Seller. TheSeller did not agree.The Buyer obtained an attorney who has been in communication with our attorney. Mediationand perhaps litigation will be required to resolve this matter between Buyer and Seller.Since an agreement could not be reached, Xeisin would be committing a breach of trust if itwere to release funds to one party when the other party disagrees. Buyer and Seller haveobtained legal counsel. Xeisin is only the funds holder and is not permitted to release funds untilan agreement has been reached.Upon resolution of the Buyer's and Seller's disputes by agreement of the parties or order of acourt of competentjurisdiction, Xeisin will disburse as instructed.As shown by the foregoing the complaint has no basis in law or in fact.Sincerely,Jonathan *** HManaging MemberXeisin Title LLC
