Review: January *, 2014COPY OF LETTER SENT TO XENEX CORPORATIONI am canceling your services immediately and am ordering you to cease and desist any withdrawals from my checking account. We are canceling due to breach of contract and misrepresentation by your customer sales representative, [redacted] We were told we would get a flat rate of 1.59% on all cards except those ran over the phone, which he advised us to hit the appropriate button on the card processor and say the card is present. I received my itemized statement via e mail and audited all charges. Not one transaction qualified for the 1.59%, additionally, it does not say on the contract that certain cards taken would be charged fees of a different percentage. Nor can any of your representatives inform me which cards have a high percent and which ones qualify for 1.59%. We have only utilized your services for approximately 1.5 months and we have been charged close to 4% in fees since that time. I have done some research and found that I am not the only one [redacted] has misrepresented the fees to. I am not paying the unjustified cancellation fee of 595.00 due to the length of time we were your client and you did not deliver according to [redacted]s expressed insistence that we would only pay 1.59% flat rate. This, he said, in part was because there is no middle man your company IS the processor. That was also a misrepresentation, Global Payments IS the processor. He also stated the he was an ex-marine as I am and used that as a tool to cement his credibility. I am forwarding a copy of this letter to the Revdex.com and am enclosing a check for the 1.59% fees on the deposits made and any other fees, less the 99.00 annual membership fee, as we are not going to be members and you will not be processing our credit cards in the coming year. I am not happy that I am stuck with a lease for the machine, and will notify the leasing company of your deceptive business practices.Desired Settlement: Cease and desist withdraw of funds from bank account, no charges for early cancellation of contract, due to breach & misrepresentation, in amount of 595.00. Would like to be released from lease on credit card machine as was deceptively forced to purchase lease.

Response:

A merchant account was created in the name of [redacted] based on a contract signed 11-*-2013, signed by [redacted]. The Rate Schedule explains the criteria for transactions that are billed at the 1.59% and those that are surcharged. All fees billed were consistent with the rate schedule.

Be aware that Xenex Payment Systems customer service is less than adequate when it comes to their long term customers and providing the necessary information to make sound business decisions regarding their services. Over the past 6 years of being one of their good standing customers, we were not given notice to a termination fee that would be deducted from our account due to us terminating our services with them. We were unaware that we were still in any contract with them that would negate a termination fee of any kind. We were taken for $495 fee plus 3 months of inactivity on our account. Leave it to the banking corporations to once again go after the small business’s bottom line. How can they keep getting away with this? “Government” needs to step in and make some changes. Xenex management, feel free to contact me regarding any corrections you can provide for my injustices.

The biggest scam i've ever seen, unprofessional as it gets, got signed into a 5 year contract with these jokers and 4 months prior to the end I was told if I didn't want contract to renew, that I need to send in my cancel for services a minimum of 90 days before hand. I was being charged 35 bucks a month while with another processor, and was riding out the last 4 months of contract to not get charged any cancellation fee, however they charged that to me anyway and auto deducted it from my account, When I called about it they said I had to send it in just after 90 days and there was nothing they could do for me since I sent it in 2 weeks early! on top of all this they are in cahoots with another company [redacted]. Do not do business with these people at all! very dishonest! and unprofessional.
