I am rejecting this response because: I was trying to obtain a loan to build the pool, I decided not to borrow the money and pay for it myself. I gave *** a check for $5k on 9/27/2017, which was cashed on 9/28/On 10/10/2017, I gave *** another check for $5k, which he cashed on 10/11/On 10/18/2017, I gave *** another check for $13K, which he cashed on 10/19/The checks were given to *** before the work was done, even though the contracts states, that the payments are after the work is doneThe gunite was pour, but why did he stop working on my pool after the gunite was pour? It was not because of the weather or the holidaysThanksgiving was over a month away and Christmas was over months away*** stopped coming to finish the pool!! I have all the text messages that I sent to *** and his response was that someone would be there tomorrow, no one would show upYes they did pour the gunite, but I still just have a hole in my back yard!! I can't do anything with the pool!! A week before Thanksgiving, I asked *** to please clean my backyard, because my brother and his family were coming to visit for ThanksgivingHe did send a person to clean the backyard, but all he did was move the trash aroundThe person did put some 2x4's that were left behind on a trailer that *** had dropped off. *** tried to sneak in and take the trailer awayI called him over to me and asked him why no one had come to work on my pool? He said things had gotten "complicated". I told him that he and I had an agreement and he needed to finish my pool, which he said he would send someone to work on itIt wasn't until the 2nd week in December that someone did come to do some work on the pool. All that person did was work on the waterfall for half a dayAfter Christmas another person came by and put the tile around the pool. The contract states that the pool will be finished within days once he startsIt is now well over the days. As far as me not paying him for the work he was suppose to do, I am not a SHYSTER like he is!! The contract states, that once the plaster is poured, I am to pay him $5KWhatever excuse he is using not to finish the pool, the contract states that I am to pay him after the plaster is doneThe $3K more after everything else is done....not before, after the work is doneI have attached the contract for your review. Every worker that he sends over has told me that *** owes them money and they do not trust himI have everything documented and my attorney has it nowMy first priority is to get the pool completed by another pool company, which I have already contractedOnce the pool is finished, I will deal with *** and his company.So, as to coming to some kind of agreement, I don't want *** *** to finish the poolHe has had plenty of time to honor the contract and he has not!! *** has breached our contract and I'll let the court deal with it in due time

In response to complaint. Here is a summary of events as they happened as my customer is not being very forthcoming. He did sign a contract to have a pool built on July of unfortunately he did not complete the transaction till he gave deposit required til Sep27th of days
later. During that time I asked Mr*** for deposit on several occasions with his response being that he was getting a bank loan ( something he forgot to mention at first) I however in good faith went ahead and created plans to submit to city of Leander as I knew it would take a while to obtain permit. I also asked Mr*** about deposit and he kept saying this week and this week. I paid for permit on Aug and got my first inspection pool layout Sep15, 2017. Still no deposit. By this time we had city and HOA approval. We finally started excavation and completed by Oct9th which is when the working days start ( of course with exclusions of Holidays and bad weather days). before the end of October we had Gunite ( which is the concrete in place). I did have difficulty trying to match his existing flagstone to use around the coping of pool.After several weeks passed I showed him again pictures of what was available and he picked one. We had already ordered his tile and it had come inWe had some bad weather ( rain early Novand that caused delays and as Thanksgiving was approaching He asked to clean up front yard and grade which we did. We had also removed truck loads of excavated dirt prior to that. There was a half a truck left to fill in trenches and low spots with the rest to be removed after job was completed. We installed tile in Decand also built the structure for waterfall sheer wall during that time. This was done despite verbal abuse and threats of which my response was we were within the time limits ( which one of any disagreements we had. By then of Decall communication had deteriorated I had asked one of my subs doing the work if he would be a go between which he did for a while. Mr*** has refused to agree to make payments as per contract and stated that he would not pay anything till all was completed and everything was put back in place sprinkler/sod etc. This is not part of the contract. At this point I do not trust Mr*** will pay any of the moneys owed at any point and hope for the Revdex.com to help find a resolution. In + years in business this is probably my 3-complaint.
