Revdex.com, I read the the most recent response in regards to the complaint and again, the complaint is very selective and completely disregards Xtreme's position on this matterI have again included Xtreme's position as it relates to this complaint below: The true facts of the matter are as follows: -Customers have the ability to purchase a "Land Only" package or a "Full Package." When booking a "Full Package" it is made very clear that travelers can depart on an array of potential travel dates, as well as an array of departure citiesMany travelers choose the "Land Only" package due to the fact they have specific travel requirements [redacted] did not choose a "Land Only" package, and selected a "Full Package" knowing the uncertainty with his selection -In accordance with the above point, I have copied parts of Xtreme's terms and conditions that support that the itinerary change was warranted: "XTREME will provide as much information as is available to XTREME regarding transportation schedules at the time of your Reservation; provided however, that this information shall be considered by you as tentative and subject to change without notice per the individual carrier’s operating plans.Transportation schedules and travel times are not guaranteed and variations in same may affect the actual length of time you may have at your Vacation Package and/or Trip destination(s)Carrier schedule changes can occur without notice even after tickets have been issued; therefore, you are responsible for re-confirming both outbound and return transportation departure times and (requisite chetimes)In the rare event your Vacation Package and/or Trip, scheduled and ticketed by XTREME,includes an overnight layover in a different city,XTREME may, at its option, provide you with a pre-paid hotel accommodation for you for the scheduled layover; but this shall not include layovers caused by flight delays, missed connections, and/or schedule changes by the air carrier after the flights have been reserved. In the event that any air transportation is cancelled for any reason, XTREME may, at its option, provide ground transportation to the nearest available airport for you to continue to your destination cityXTREME shall have no liability for any travel delays to or from your Vacation Package and/Trip destination" -It is important to note that when the itinerary changes became known, [redacted] was presented with several options, one of which was to downgrade to a "Land Only" package [redacted] choose to not accept this optionSince [redacted] choose not to accept several reasonable options offered by Xtreme, Xtreme must provide airfare, which was unfortunately not the desired departures city (Chicago) -It is also important to note that Xtreme works on a group organizer basis when decisions such as these are madePlease see the terms and conditions below: All room or villa occupants shall be deemed one group and Your Reservation shall either indicate yourself or a o-traveler as the designated organizer to act on your behalf in relation to your Vacation Package and/or Trip accommodations and add on packagesIf no such person is designated in your Reservation, XTREME typically appoints the first person who submits his/her reservation form to act as the organizer for the group for the requested room type or villaBy submitting your Reservation for your selected Vacation Package or Trip, you are authorizing such designated organizer to act on your behalf as your agent in connection with all matters relating to Vacation Package and/or Trip including your accommodations, and XTREME is hereby authorized by you to rely upon your designated organizer’s actions (or if applicable in actions) on your behalf for changes and/or additions to your Vacation Package and/orTrip Reservation and you hereby agree to be responsible for any additional amounts as may now be due as a result of such changes or additions and pay all such amounts when due.In no event however, shall the designated organizer be authorized to alter this Agreement Xtreme understands that ***'s experience was not optimal given the circumstances, however, Xtreme has acted in accordance with it's terms and conditions and ultimately did provide [redacted] with the components of the travel package that was purchased Please let me know if you need clarification on any of the above Sincerely, Xtreme Trips

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [redacted] vsXtreme Brands, ID # [redacted] Dear [redacted] : This is in reference to my complaint against Xtreme Brands, LLC., assigned ID # [redacted] To avoid lengthy redundancy, please reference all prior documents and files that I previously submitted in this matter On June ***, Xtreme responded to my prior submissionIt is extremely important to emphasize that Xtreme did not challenge its breach of contract by violating its Co-Terminal Terms & Conditions provision, section “XVIII BCO-TERMINALS”The facts support that this breach of contract is crystal clearIndependent of Xtreme’s other serious wrong-doings, this contract breach represents sufficient basis to require Xtreme to immediately provide me with a full $2,refund for the fully paid travel package that my son did not participate due to Xtreme’s decision to cancel its Detroit Metro charter flight and reschedule to Chicago’s O’Hare airport to maximize its profit More specifically, my son was advised at the last minute by Xtreme that his purchased Detroit Metro departure and return city would no longer be accommodated and instead, he was required to travel by bus from Ann Arbor Michigan to Chicago’s O’Hare’s airport, approximately miles away to a separate and distinct out of state Co-Terminal geographySee Xtreme’s Term & Conditions section “XVIII BCO-TERMINALS” belowFor Xtreme’s CUSTOMER AGREEMENT TERMS AND CONDITIONS, see [redacted] “XVIII BCO-TERMINALS For the purposes of air travel arrangements as part of your Vacation Package and/or Trip the following are considered “co-terminal” airports: New York (Newark, JFK, LaGuardia); Baltimore/Washington (BWI, National, Dulles); Chicago (O'Hare, Midway, Rockford, Milwaukee); Detroit (Metro, City), Miami/FtLauderdale (FL), Orlando/Tampa (FL), Rochester/Syracuse/Buffalo(NY), Cincinnati/Dayton (OH), San Francisco/Sacramento/Oakland (CA), Dallas (DFW, Love Field), which means your Vacation Package and/or trip may leave and/or depart from and/or return to any co-terminal at the option of XTREME.” Note that Xtreme’s contract section ‘XVIII B’ language does not include Detroit’s Metro airport within Chicago’s O’Hare, Midway, Rockford or Milwaukee geography, for the obvious reason that Detroit’s Metro is too far away from Chicago airports [~miles] to be considered a reasonable alternative [co-terminal] airport The central issue in this case is that only days before the scheduled departure, Xtreme unilaterally decided to cancel its Detroit Metro charter flights from Detroit’s Metro to Puerto Vallarta (and corresponding direct return flights) for a fully paid Spring Break vacation, confirmed by an initial payment four months prior on October **, 2013, (and fully paid for prior to cancellation), that my son [redacted] did not take as a direct consequence of Xtreme’s last minute breach of contract and failure to cure The facts of this case involves Xtreme’s sale of a vacation ‘full package’ that was selected by the vast majority if not all its other thousands of clients that subscribed to this Spring Break vacation that integrated local airport, round trip flights to and from Puerto VallartaMy son bought the ‘full package’, not land package, expecting Xtreme to honor its representations and deliver the local airport direct air transportation flights as representedWe would never have considered modifying Xtreme’s air travel commitments by paying considerably more money (at the last minute) for a ‘land package’ that would have required my son to book his own round trip airfareXtreme is suggesting that it would have been reasonable for us to downgrade to the ‘Land package’ as a consequence of its cancellation of its local airport charter flights to Puerto Vallarta and with only days to purchase round trip flights, pay significantly penalties that exceed the agreed upon costs of Xtreme’s ‘full vacation package’This is outrageous! The transportation commitments at the time of purchase, (October 2013) were verbally represented to be assured and in fact, remained unchanged for the vast majority of Xtreme’s thousands of clientsUnfortunately, for reasons unknown, my son was singled out with a small group of other clients by receiving notification only days the planned departure, that he was required to take two ROUND TRIP BUS TRIPS TO AND FROM THE UNIVERSITY OF MICHIGAN TO CHICAGO’S O’HARE AIRPORT, A DISTANCE OF ~ MILES EACH TRIPThese charter flight schedule changes were caused solely by Xtreme as the airlines played absolutely no role of any kind in the cancellation By failing to honor its Co-Terminal contract provision, Xtreme now seeks to justify its retention of my $2,for a vacation my son did not take, (not including other direct financial losses associated with Xtreme’s breach), with deceptive contract language that on its face, implies that Xtreme cannot be held responsible for transportation changes caused by the transportation industry“ subject to change without notice per the individual carrier’s operating plansCarrier schedule changes can occur without notice even after tickets have been issued;” Again, the facts here are that the airline industry did not cancel any flights relating to the Xtreme vacation; it was Xtreme that cancelled its Ann Arbor charter flights in order to increase its profit margins If Xtreme did nothing wrong, why did the [redacted] , a [redacted] and [redacted] , offer my son what was represented as significant incentives to accept the radical downgraded changes to their promised transportation arrangements? In recognition of its last minute contractual breach, Xtreme offered undefined and unconfirmable offers to induce the [redacted] s to accept their unsafe and substantially lower quality changesThese offers included, ‘a bigger room’, (compared to what), a VIP table, (more alcohol for our son is a significant safety hazard, not a positive inducement), and an additional free night (so our son could miss a day of college classes by returning one day later!) By forcing my son to take buses from Ann Arbor Michigan to Chicago’s O’Hare airport, A DISTANCE OF APPROXIMATELY MILES EACH TRIP, Xtreme placed my son in harm’s way! This was totally unacceptable! My son was singling out of thousands who received the travel arrangements that my son purchasedFurther, my son’s NEWLY SCHEDULED FLIGHTS FROM AND TO CHICAGO’S O’HARE TO MEXICO CITY WOULD NO LONGER BE DIRECT FLIGHTS, BUT INSTEAD, REQUIRE MULTI-HOUR LAYOVERS IN MEXICO CITY BEFORE PROCEEDING TO AND FROM PUERTO VALLARTA The written record clearly shows that my family’s decision to formally cancel the Xtreme vacation followed Xtreme’s refusal to book my son on available direct flights from Detroit’s Metro as representedWhile the inconvenience of the last minute Chicago flights was problematic, my family’s decision to cancel the fully paid for vacation was based on safety concerns! Revdex.com,
After reading the full detailed complaint regarding the travel package purchased ***, Xtreme does not believe a refund is in orderFurthermore, the complaint includes very selective portions of our terms and conditions in an attempt to skew the complaint in ***'s
favor
The true facts of the matter are as follows:
-Customers have the ability to purchase a "Land Only" package or a "Full Package." When booking a "Full Package" it is made very clear that travelers can depart on an array of potential travel dates, as well as an array of departure citiesMany travelers choose the "Land Only" package due to the fact they have specific travel requirements*** did not choose a "Land Only" package, and selected a "Full Package" knowing the uncertainty with his selection
-In accordance with the above point, I have copied parts of Xtreme's terms and conditions that support that the itinerary change was warranted:
"XTREME will provide as much information as is available to XTREME regarding transportation schedules at the time of your Reservation; provided however, that this information shall be considered by you as tentative and subject to change without notice per the individual carrier’s operating plans.Transportation schedules and travel times are not guaranteed and variations in same may affect the actual length of time you may have at your Vacation Package and/or Trip destination(s)Carrier schedule changes can occur without notice even after tickets have been issued; therefore, you are responsible for re-confirming both outbound and return transportation departure times and (requisite chetimes)In the rare event your Vacation Package and/or Trip, scheduled and ticketed by XTREME,includes an overnight layover in a different city,XTREME may, at its option, provide you with a pre-paid hotel accommodation for you for the scheduled layover; but this shall not include layovers caused by flight delays, missed connections, and/or schedule changes by the air carrier after the flights have been reserved. In the event that any air transportation is cancelled for any reason, XTREME may, at its option, provide ground transportation to the nearest available airport for you to continue to your destination cityXTREME shall have no liability for any travel delays to or from your Vacation Package and/Trip destination"
-It is important to note that when the itinerary changes became known, *** was presented with several options, one of which was to downgrade to a "Land Only" package*** choose to not accept this optionSince *** choose not to accept several reasonable options offered by Xtreme, Xtreme must provide airfare, which was unfortunately not the desired departures city (Chicago)
-It is also important to note that Xtreme works on a group organizer basis when decisions such as these are madePlease see the terms and conditions below:
All room or villa occupants shall be deemed one group and Your Reservation shall either indicate yourself or a o-traveler as the designated organizer to act on your behalf in relation to your Vacation Package and/or Trip accommodations and add on packagesIf no such person is designated in your Reservation, XTREME typically appoints the first person who submits his/her reservation form to act as the organizer for the group for the requested room type or villaBy submitting your Reservation for your selected Vacation Package or Trip, you are authorizing such designated organizer to act on your behalf as your agent in connection with all matters relating to Vacation Package and/or Trip including your accommodations, and XTREME is hereby authorized by you to rely upon your designated organizer’s actions (or if applicable in actions) on your behalf for changes and/or additions to your Vacation Package and/orTrip Reservation and you hereby agree to be responsible for any additional amounts as may now be due as a result of such changes or additions and pay all such amounts when due.In no event however, shall the designated organizer be authorized to alter this Agreement
Xtreme understands that ***'s experience was not optimal given the circumstances, however, Xtreme has acted in accordance with it's terms and conditions and ultimately did provide *** with the components of the travel package that was purchased
Please let me know if you need clarification on any of the above
Sincerely,
Xtreme Trips

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me and the matter has been resolvedThe principal of the company worked with me to find an equitable solutionThe company seemed sincere about clearing up any posssible confusion which could lead to similar problems for future customers I believe this problem was caused by a lack of communication between student reps, student travellers, website staff and the management of the companyThe tardy updating of the website and inconsistencies in the billing details versus other website information also contributed to our issue*** was slow to recognize and take responsibility for these issuesThe management is now aware of the disconnect and is acting proactively to make sure the dilemma I faced will not happen to any one elseAlthough it was extremely difficult to contact this company and arrive at a solution within a reasonable time frame, the company has made a good faith effort to remedy the problemThe problem was resolved on May *,

I am awaiting a good faith payment of $which was promised me by their representative [redacted]This settlement is equal to the amount of money paid by me to get my group to and from the IAD airport using ground transportation since the company failed to provide air transportation from PHl to PVR as I had contracted for
The company has acknowledged that their screen at the point of purchase indicated PHL, not IAD and that all of their subsequent billing and paid invoices reflected a PHL to PVR round-trip and did not indicate anything at all about an IAD departure city They insist this was a mistake , not deliberate misrepresentationThey say that a PHL-PVR day trip was never offered by their company even though it is what I clearly booked on their website.
I expected to receive this payment last week and have recontacted Xtremebrands, LLC and have been told they are looking into the status of the missing check.
I would like to believe that their statements to me are true and try to forget about the extreme hassle travelling an extra hours round-trip in a van to get to the IAD airport in the middle of the night on my 21st birthday instead of attending my party in PHL.
I will recontact your organization in a few days if I receive the check for my ground transportation expenses incurred because of this company's misrepresentation of the true origin city of my Puerto Vallarta vacation.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
[redacted] vs. Xtreme Brands, ID #[redacted]
[redacted]
[redacted]
Dear [redacted]:
This is in reference to my complaint against Xtreme Brands, LLC., assigned ID #[redacted]. To avoid lengthy redundancy, please reference all prior documents and files that I previously submitted in this matter.
On June [redacted], Xtreme responded to my prior submission. It is extremely important to emphasize that Xtreme did not challenge its breach of contract by violating its Co-Terminal Terms & Conditions provision, section “XVIII B. CO-TERMINALS”. The facts support that this breach of contract is crystal clear. Independent of Xtreme’s other serious wrong-doings, this contract breach represents sufficient basis to require Xtreme to immediately provide me with a full $2,217 refund for the fully paid travel package that my son did not participate due to Xtreme’s decision to cancel its Detroit Metro charter flight and reschedule to Chicago’s O’Hare airport to maximize its profit.
More specifically, my son was advised at the last minute by Xtreme that his purchased Detroit Metro departure and return city would no longer be accommodated and instead, he was required to travel by bus from Ann Arbor Michigan to Chicago’s O’Hare’s airport, approximately 300 miles away to a separate and distinct out of state Co-Terminal geography. See Xtreme’s Term & Conditions section “XVIII B. CO-TERMINALS” below. For Xtreme’s CUSTOMER AGREEMENT TERMS AND CONDITIONS, see [redacted]
“XVIII B. CO-TERMINALS
For the purposes of air travel arrangements as part of your Vacation Package and/or Trip the following are considered “co-terminal” airports: New York (Newark, JFK, LaGuardia); Baltimore/Washington (BWI, National, Dulles); Chicago (O'Hare, Midway, Rockford, Milwaukee); Detroit (Metro, City), Miami/Ft. Lauderdale (FL), Orlando/Tampa (FL), Rochester/Syracuse/Buffalo(NY), Cincinnati/Dayton (OH), San Francisco/Sacramento/Oakland (CA), Dallas (DFW, Love Field), which means your Vacation Package and/or trip may leave and/or depart from and/or return to any co-terminal at the option of XTREME.”
Note that Xtreme’s contract section ‘XVIII B’ language does not include Detroit’s Metro airport within Chicago’s O’Hare, Midway, Rockford or Milwaukee geography, for the obvious reason that Detroit’s Metro is too far away from Chicago airports [~300 miles] to be considered a reasonable alternative [co-terminal] airport.
The central issue in this case is that only days before the scheduled 2/**/14 departure, Xtreme unilaterally decided to cancel its Detroit Metro charter flights from Detroit’s Metro to Puerto Vallarta (and corresponding direct return flights) for a fully paid Spring Break vacation, confirmed by an initial payment four months prior on October **, 2013, (and fully paid for prior to cancellation), that my son [redacted] did not take as a direct consequence of Xtreme’s last minute breach of contract and failure to cure.
The facts of this case involves Xtreme’s sale of a vacation ‘full package’ that was selected by the vast majority if not all its other thousands of clients that subscribed to this Spring Break vacation that integrated local airport, round trip flights to and from Puerto Vallarta. My son bought the ‘full package’, not land package, expecting Xtreme to honor its representations and deliver the local airport direct air transportation flights as represented. We would never have considered modifying Xtreme’s air travel commitments by paying considerably more money (at the last minute) for a ‘land package’ that would have required my son to book his own round trip airfare. Xtreme is suggesting that it would have been reasonable for us to downgrade to the ‘Land package’ as a consequence of its cancellation of its local airport charter flights to Puerto Vallarta and with only days to purchase round trip flights, pay significantly penalties that exceed the agreed upon costs of Xtreme’s ‘full vacation package’. This is outrageous!
The transportation commitments at the time of purchase, (October 2013) were verbally represented to be assured and in fact, remained unchanged for the vast majority of Xtreme’s thousands of clients. Unfortunately, for reasons unknown, my son was singled out with a small group of other clients by receiving notification only days the planned 2/**/14 departure, that he was required to take two ROUND TRIP BUS TRIPS TO AND FROM THE UNIVERSITY OF MICHIGAN TO CHICAGO’S O’HARE AIRPORT, A DISTANCE OF ~ 300 MILES EACH TRIP. These charter flight schedule changes were caused solely by Xtreme as the airlines played absolutely no role of any kind in the cancellation.
By failing to honor its Co-Terminal contract provision, Xtreme now seeks to justify its retention of my $2,217 for a vacation my son did not take, (not including other direct financial losses associated with Xtreme’s breach), with deceptive contract language that on its face, implies that Xtreme cannot be held responsible for transportation changes caused by the transportation industry. “…subject to change without notice per the individual carrier’s operating plans.. Carrier schedule changes can occur without notice even after tickets have been issued;” Again, the facts here are that the airline industry did not cancel any flights relating to the Xtreme vacation; it was Xtreme that cancelled its Ann Arbor charter flights in order to increase its profit margins.
If Xtreme did nothing wrong, why did the [redacted], a [redacted] and [redacted], offer my son what was represented as significant incentives to accept the radical downgraded changes to their promised transportation arrangements? In recognition of its last minute contractual breach, Xtreme offered undefined and unconfirmable offers to induce the [redacted]s to accept their unsafe and substantially lower quality changes. These offers included, ‘a bigger room’, (compared to what), a VIP table, (more alcohol for our son is a significant safety hazard, not a positive inducement), and an additional free night (so our son could miss a day of college classes by returning one day later!)
By forcing my son to take buses from Ann Arbor Michigan to Chicago’s O’Hare airport, A DISTANCE OF APPROXIMATELY 300 MILES EACH TRIP, Xtreme placed my son in harm’s way! This was totally unacceptable! My son was singling out of thousands who received the travel arrangements that my son purchased. Further, my son’s NEWLY SCHEDULED FLIGHTS FROM AND TO CHICAGO’S O’HARE TO MEXICO CITY WOULD NO LONGER BE DIRECT FLIGHTS, BUT INSTEAD, REQUIRE MULTI-HOUR LAYOVERS IN MEXICO CITY BEFORE PROCEEDING TO AND FROM PUERTO VALLARTA.
The written record clearly shows that my family’s decision to formally cancel the Xtreme vacation followed Xtreme’s refusal to book my son on available direct flights from Detroit’s Metro as represented. While the inconvenience of the last minute Chicago flights was problematic, my family’s decision to cancel the fully paid for vacation was based on safety concerns!
Xtreme prides itself on safety. “Safety is our Xtreme's #1 priority.” [redacted]
The compilation of severe 2013-2014 winter weather facts and bus fatality statistics that follow serve to reinforce the safety concern reasons that resulted directly from Xtreme’s Co-Terminal contract breach. This record will serve to reinforce why my family had no option but to refuse to accept Xtreme’s last minute and radically altered travel arrangements.
Xtreme’s radically changed transportation arrangements requiring potentially hazardous bus trips to and from Ann Arbor to Chicago’s O’Hare airport in severe winter weather were the sole result of Xtreme canceling its Detroit Metro charter flights. The airline industry played no role in any of the significant transportation changes Xtreme forced upon son only days before the planned Puerto Vallarta departure.
I attempted to reason with Xtreme to figure out a reasonable way, at no further cost to me, for Xtreme to honor its original travel plan representations [meaning flying my son out of and returning directly to Detroit’s Metro from Puerto Vallarta]. I attempted to explain that my family’s refusal to accept Xtreme’s radically altered last minute transportation changes were based on the significant danger associated with multiple 4.5 hour bus trips from Ann Arbor to Chicago’s O’Hare airport in the worst winter in recorded history. Xtreme did not care. Further, I tried to point out the potential dangers associated with two 2.5+ hour layovers in Mexico City, additional hazards never contemplated in the Xtreme Spring Break vacation package sold to my son. Again, my safety concerns fell on deaf ears.
The data below attempts to highlight the serious potential dangers associated with dual 4.5 hour+ bus travel arrangements in the dead of winter from Ann Arbor Michigan to Chicago’s O’Hare airport. My wife and I tried to explain these potential dangers to Xtreme. Our concerns fell on deaf ears. We sought to explain the potential dangers associated with over two multi-hour Mexico City layovers. Once again, Xtreme did not take any responsibility in responding to these concerns. Similarly, Xtreme could not rationalize why my son [redacted] was one of a few thousand clients who was singled out from taking the direct Detroit Metro flights that were promised and subjected to at least 9 hours of potentially dangerous bus arrangements.
This past 2013 – 2014 winter was unprecedented in its severity. See The Weather Channel’s March **, 2014 article entitled: ‘10 Major Cities with the Worst Winter of 2013-2014‘

CONCLUSION: Xtreme cancelled its Detroit Metro charter flights to increase its profit margins at the expense of trusting clients like my son. Xtreme breached its Co-Terminal contract provision and sidesteps that critical legal violation with contract language that was drafted to imply that Xtreme is not responsible for airline industry cancellations. Xtreme failed to cure its breach by either financing Detroit Metro travel arrangements equivalent to those sold to my son as originally represented or refunding my money. Instead, to maximize profit, Xtreme singled out my son and a few select others, among thousands, and forced to subject them to considerable long term ground transportation inconvenience and very real significant potential danger by requiring them to travel by bus from Ann Arbor Michigan to Chicago’s O’Hare airport and back, in perhaps the worst winter weather in recorded history. This blatant disregard for human safety, in direct violation of its co-terminal contract provision, is symbolic of Xtreme’s sole priority of making money without concern for their client’s well-being or regard for taking responsibility for honoring its sales and contractual representations.
As a consumer, I have been substantially harmed financially. I seek the Revdex.com to confirm that facts above, and require Xtreme to immediately refund my $2,217 and the addition monies I was forced to spend as a result of their contract breach.
Respectfully submitted,
[redacted]
.
Sincerely,

Revdex.com,
I read the the most recent response in regards to the complaint and again, the complaint is very selective and completely disregards Xtreme's position on this matter. I have again included Xtreme's position as it relates to this complaint below:
The true facts of the matter are as follows:
-Customers
have the ability to purchase a "Land Only" package or a "Full Package."
When booking a "Full Package" it is made very clear that travelers can
depart on an array of potential travel dates, as well as an array of
departure cities. Many travelers choose the "Land Only" package due to
the fact they have specific travel requirements. [redacted] did not choose a
"Land Only" package, and selected a "Full Package" knowing the
uncertainty with his selection.
-In accordance with the above
point, I have copied parts of Xtreme's terms and conditions that support
that the itinerary change was warranted:

-It is important to note that when the itinerary
changes became known, [redacted] was presented with several options, one of
which was to downgrade to a "Land Only" package. [redacted] choose to not
accept this option. Since [redacted] choose not to accept several reasonable
options offered by Xtreme, Xtreme must provide airfare, which was
unfortunately not the desired departures city (Chicago).
-It is
also important to note that Xtreme works on a group organizer basis when
decisions such as these are made. Please see the terms and conditions

organizer for the group for the requested room type or villa. By
submitting your Reservation for your selected Vacation Package or Trip,
you are authorizing such designated organizer to act on your behalf as
your agent in connection with all matters relating to Vacation Package
and/or Trip including your accommodations, and XTREME is hereby
authorized by you to rely upon your designated organizer’s actions (or
if applicable in actions) on your behalf for changes and/or additions to
your Vacation Package and/orTrip Reservation and you hereby agree to be
responsible for any additional amounts as may now be due as a result of
such changes or additions and pay all such amounts when due.In no event
however, shall the designated organizer be authorized to alter this
Agreement.
Xtreme understands that [redacted]'s experience was not
optimal given the circumstances, however, Xtreme has acted in accordance
with it's terms and conditions and ultimately did provide [redacted] with the
components of the travel package that was purchased.
Please let me know if you need clarification on any of the above.
Sincerely,
Xtreme Trips

Review: I contracted with this travel agency to fly in and out of Philadelphia airport for a trip to Puerto Vallarta which would begin on Saturday March ** and end on Thurs. April *, 2014. The company has provided me with flight information and they have booked me out of Washington/ Dulles airport which is 4 hours from the origin city I contracted for.

My group is supposed to be flying together out of PHL. I made my application for this trip in the early fall and paid all fees due on time and in full. I was never informed that a random airport assignment could be made .

I was told that our group would be flying together unless I had signed up late which I did not. Some of our group is flying out of PHL and 8 of us have been assigned to fly out of IAD which is Washington Dulles Airport in Sterling Virginia. None of us requested to fly out of this airport as it is inaccessible to us. We do not have cars or rides or money to transport ourselves to an airport which is 4 hours from the origin city we specified when we signed up for the trip.

MY booking # is [redacted]. My friends who were also assigned to fly out of IAD when they contracted for PHL are also victims of this bait and switch - take the money and run scheme.

Their names are:

[redacted] and [redacted] Xtreme trips has also been notified that the airport IAD is not an acceptable origin city for these girls.

My mother and I have sent three detailed emails to [redacted] and called xtreme trips over 8 times in the past two weeks. We have left messages and spoke with an [redacted] twice. The first time [redacted] told us that he checked the booking and agreed that PHL was supposed to be the origin city. He directed us to call the airlines and handle the ticket switch directly as it was the most expedient way to handle to flight change. We called [redacted] and were told it would be over $300 to change the ticket at all and another $630 to book the next cheapest flight which still would not fly out of PHL. The closest airport [redacted] flies out of is JFK. Why would [redacted] book us on an airline that does not even fly out of our requested destination city when many airlines do? Delta is a partner with [redacted] and could provide a connecting flight to an [redacted] second and final leg, but [redacted] told us that such a flight switch would not be allowed at all.

By booking us incorrectly, not notifying us till after any [redacted] ticketing process was finalized, misdirecting us to believe that a free flight change was easily available through [redacted] and not following through on promises made, we have now wasted valuable time and money.

The second time my mother spoke to [redacted] was Friday March *, 2014. He apologized for not responding to the 2 emails he has disregarded and told me that the flights would be switched to PHL as an origin city within a couple of hours. That was 4 days ago. Another email was sent and more phone messages were left letting [redacted] know that nothing was done to switch the girls' flights and no contact has been made at all by any member of his staff even though he assured me that he was personally going to contact his flight department so they could resolve the issue that afternoon.

It is far too late and too expensive for us to rebook ourselves even if we received a full refund today. KIn addition, my 21st birthday party is booked for the night of March [redacted] in Philadelphia. I turn 21 at midnight. The plan was to attend the party with my friends who are booked on this trip and then head to the PHL airport in the morning to go to Puerto Vallarta. [redacted] is aware of this. My mother has a $500 deposit down for my party.

If I fly out of any other airport than PHL I will have to cancel my party because of [redacted] deceptive business practices. [redacted] has no regard for consumers. truth in advertising, delivering goods as ordered and timely conflict resolution. My mother and I tried to be flexible when we were on the phone with [redacted] offering to fly out of JFK if no PHL flights were available. I know that many PHL flights are available and no longer will accept a flight out of JFK. The company needs to provide what it promised and was paid for in advance.Desired Settlement: We want tickets issued immediately for each individual member of the group trip mentioned above ( 7 individuals) flying together as promised in and out of PHL airport to Puerto Vallarta March [redacted] April *.

Response:

At this time, I have been contacted directly by Xtreme Brands, LLC regarding complaint ID [redacted], however my complaint has NOT been resolved because:

[Your Answer Here]

I am awaiting a good faith payment of $630 which was promised me by their representative [redacted]. This settlement is equal to the amount of money paid by me to get my group to and from the IAD airport using ground transportation since the company failed to provide air transportation from PHl to PVR as I had contracted for.

The company has acknowledged that their screen at the point of purchase indicated PHL, not IAD and that all of their subsequent billing and paid invoices reflected a PHL to PVR round-trip and did not indicate anything at all about an IAD departure city. They insist this was a mistake , not deliberate misrepresentation. They say that a PHL-PVR 5 day trip was never offered by their company even though it is what I clearly booked on their website.

I expected to receive this payment last week and have recontacted Xtremebrands, LLC and have been told they are looking into the status of the missing check.

I would like to believe that their statements to me are true and try to forget about the extreme hassle travelling an extra 8 hours round-trip in a van to get to the IAD airport in the middle of the night on my 21st birthday instead of attending my party in PHL.

I will recontact your organization in a few days if I receive the check for my ground transportation expenses incurred because of this company's misrepresentation of the true origin city of my Puerto Vallarta vacation.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. The principal of the company worked with me to find an equitable solution. The company seemed sincere about clearing up any posssible confusion which could lead to similar problems for future customers. I believe this problem was caused by a lack of communication between student reps, student travellers, website staff and the management of the company. The tardy updating of the website and inconsistencies in the billing details versus other website information also contributed to our issue. [redacted] was slow to recognize and take responsibility for these issues. The management is now aware of the disconnect and is acting proactively to make sure the dilemma I faced will not happen to any one else. Although it was extremely difficult to contact this company and arrive at a solution within a reasonable time frame, the company has made a good faith effort to remedy the problem. The problem was resolved on May *, 2014.

Review: To Whom It May Concern:

I seek your assistance in requiring Xtreme Brands / Xtreme Trips to provide a full $2,2** refund for a 2014 Spring Break vacation that my son paid for that he was unable to take in lieu of Xtreme’s breach of contract and deceptive business practices in willfully failing to fulfill core air travel obligations as represented by their company in convincing my son [redacted] to sign up for their Feb., **, 2014 trip to Puerto Vallarta Mexico. Specifics follow.

WHAT WAS SOLD / PROMISED: To induce [redacted], a University of Michigan student at Ann Arbor, to commit to their Spring Break vacation, Xtreme Trips represented to [redacted], with confidence and enthusiasm, that he was paying for a vacation package that included:

ROUND TRIP DIRECT FLIGHTS FROM DETROIT’S METRO AIRPORT TO PUERTO VALLARTA MEXICO;

WHAT WAS DELIVERED LAST MINUTE: Only days before the Feb., **, 2014 vacation, Xtreme radically changed its transportation commitments by notifying [redacted] that he was required to:

TAKE ROUND TRIP BUS TRIPS [IN THE DEAD OF WINTER] TO AND FROM THE UNIVERSITY OF MICHIGAN, TO CHICAGO’S O’HARE (A DISTANCE OF ~ 300 MILES EACH TRIP) FOR NON-DIRECT FLIGHTS FROM CHICAGO’S O’HARE TO MEXICO CITY & AFTER A MULTI-HOUR LAYOVER, CONNECT WITH A FLIGHT TO PUERTO VALLARTA.

** It was not the airlines that changed or cancelled [redacted]’s round trip, non-stop flights reservations; it was Xtreme that made the unilateral decision to change [redacted]’s Detroit Metro direct flights to Puerto Vallarta.

[redacted] PAYMENTS PAID TO XTREME BY [redacted] CREDIT CARD:

Oct **, 2013 $250;

Nov **, $300;

Dec *, $1,368;

Jan **, 2014 $299

TOTAL PAID TO XTREME: $2,2**

REFUNDS FOR TRIP CHANGES:

$500 was previously credited by Xtreme in recognition of its failure to conform with or rectify its contractual obligations leaving a balance due $1,7**. However, over the last two months, we have been working with [redacted] to get a full refund and given Xtreme’s attempts to justify their last minute transportation changes, we can’t be confident that [redacted] will be successful, and thus, why we are reaching out to the Revdex.com.

WHAT PARTY WAS RESPONSIBLE FOR THE TRAVEL COMMITMENT CHANGES?

It was not the airlines that cancelled my son’s direct flights from both Detroit Metro’s airport to Puerto Vallarta and thereafter from Puerto Vallarta to Detroit Metro, but rather, it was Xtreme Trips that changed my son’s flight commitments! Note that my Feb., **, 2014 Federal Express letter, transmitted also by email specially stated, “It was Xtreme that put itself in the position of being unable to deliver on its commitment to fly [redacted] from Michigan directly to Puerto Vallarta… I left a message for you on your cell at 11:30am today, February **, 2014 to advise that at the time of my call, there were two seats available on Delta, leaving Detroit DTW on Feb., [redacted] at 9am arriving PVR at 1:21pm, non stop, flight # [redacted]. There are also two seats on Delta to return home; leaving PVR on Feb., ** 2014, at 12:51PM and arriving at DTW at 6:09PM, non stop, flight # [redacted].”

Xtreme refused to book the Delta direct flight tickets that were confirmed available. We can find no logical reason for this other than Xtreme’s overbooking of their charter flights and thus, in an attempt to save considerable money, sought to have our son take 10 hours worth of bus trips to another State and provide him with lower cost non-direct flights. This Xtreme solution to solve their problem was presented only days before the February [redacted] vacation in spite of the fact that my son made his initial payment for his direct Detroit non-stop flights on October **, 2013.

The Xtreme Contract: With no mention of any possibilities of travel arrangement changes, [redacted], a Xtreme [redacted], never disputed that the Xtreme Spring Break trip was based on air travel non-stop departure and return city was Detroit, Michigan. On October **, 2013, [redacted] committed to the Xtreme Spring Break vacation package and paid a $250 deposit trusting Xtreme to honor its travel arrangement commitments. Nevertheless, at the last minute, Xtreme notified [redacted] that for both the departing and arriving flights, [redacted] would have to take a bus from the University of Michigan to Chicago’s Illinois’ O’Hare, airport. Note that this means that [redacted] was asked to travel to another state, (from Detroit, Michigan to Chicago Illinois), two times, each a distance of approximately 300 miles in order to take unplanned and undisclosed downgraded non-stop flights that would subject him to two multi-hour unplanned stop overs in Mexico City. (Traveling from and returning to the U.S.)

Contractually, [redacted] was advised at the last minute by Xtreme that his purchased departure and return city would no longer be accommodated within his co-terminal territory. This represents a breach of contract, as Xtreme violated its co-terminal departure/return city requirements as described in Paragraph B ("CO-TERMINALS"), Section XVIII ("XTREME’S [OPERATOR] 'OPTION' VACATION PLAN") in its CUSTOMER AGREEMENT TERMS AND CONDITIONS [redacted], (see Xtreme contract language below)

Note that Xtreme’s contract section ‘XVIII B’ language does not include Detroit’s Metro airport with Chicago’s O’Hare, Midway, Rockford or Milwaukee, for the obvious reason that Detroit’s Metro is too far away from Chicago airports [~300 miles] to be considered a reasonable alternative [co-terminal]airport.

Xtreme’s April *, 2014 letter to [redacted].

In response to this claim, Xtreme Trips provided [redacted] with a letter dated April *, 2014 that we recently received from [redacted]. Please note that Xtreme does not dispute that [redacted]’s round trip, non-stop Detroit-Metro to Puerto Vallarta flights were changed last minute or that Xtreme advised [redacted] that he had to take a round trip bus from the University of Michigan to another state, Chicago, to fly to and from Puerto Vallarta on non-stop flights.

Xtreme takes the following positions that we adamantly disagree with.

1. The third paragraph states “.. the airlines want to put them on a bus to Chicago get a flight..”. As stated above, the airlines played no role in the last minute travel changes. THE TRAVEL CHANGES WERE THE SOLE RESULT OF XTREME’S DECISION TO CHANGE THE PROMISED TRAVEL ARRANGEMENTS.

2. The third paragraph indicates “..or an option to be refunded the flight portion of the package and book their own flights. [redacted] and his roommates for the trip opted for the first option.” This claim is false. The reality is that [redacted] and I spoke, a conversation that I recorded and will transmit to you in digital form (MP3 file). At no time did [redacted] opt for the first option’. Instead, I sent [redacted] an email on February **, 2014 that specifically stated in part: “Given the February [redacted] departure date, I urge you to reconsider Xtreme’s position. As Xtreme prides itself on being an expert in the travel and entertainment industry, at Xtreme’s sole expense, find a way to get [redacted] and his other friends in the same unenviable position as he on a direct flight from Detroit’s Metro to Puerto Vallarta as originally promised. Alternatively, fully finance a flight from Detroit’s Metro to Chicago or another major hub like Atlanta and get the boys on a direct flight to Puerto Vallarta. If either of these options proves impossible, immediately refund all monies to [redacted] and his friends. These are the proper reasonable, moral and legal courses of action.”

My email and federal express letter to Xtreme / [redacted] went on to state: “I left a message for you on your cell at 11:30am today, February **, 2014 to advise that at the time of my call, there were two seats available on Delta, leaving Detroit DTW on Feb., [redacted] at 9am arriving PVR at 1:21pm, non stop, flight # [redacted]. There are also two seats on Delta to return home; leaving PVR on Feb., *, 2014, at 12:51PM and arriving at DTW at 6:09PM, non stop, flight # [redacted].”

THE POINT HERE IS THAT XTREME COULD HAVE BOOKED THE FIGHTS MENTIONED ABOVE AND HONORED ITS COMMITMENTS. INSTEAD, IN BAD FAITH, AND CONTRARTY TO XTREME’s REPRESENATIONS, XTREME ELECTED NOT TO DO SO.

NOTICE OF CANCELLATION sent by [redacted] to Xtreme on 2/**/14

Xtreme Brands, LLC

(d.b.a. Xtreme Trips) [redacted] URGENT - ATTN: [redacted], NOTICE OF CANCELLATION

February **, 2014

Via email [redacted] & Via Federal Express

Dear [redacted]:

As we discussed on Thursday evening, February **, 2014, my son [redacted] has decided to reject your concession offers and cancel his Spring Break trip to Puerto Vallarta Mexico as a consequence of Xtreme Brands LLC’s breach of contract.

More specifically, [redacted] is a full time student at the University of Michigan at Ann Arbor. His Xtreme Spring Break trip was predicated in large part on flying out of Detroit’s Metro airport on a non-stop flight to Puerto Vallarta. On that basis, the following credit card payments were paid to Xtreme.

Oct **, 2013 $250; Nov **, $300; Dec *, $1,368; Jan **, 2014 $299

It was only days ago that Xtreme informed [redacted] that Xtreme could not offer him the promised non-stop flight out of Detroit’s Metro airport and that he would have to take a bus from Ann Arbor to Chicago’s O’Hare airport, a distance of over 280 miles requiring a minimum of 4.5 hours of driving time assuming no traffic or weather problems occurred. Further, the flight from Chicago’s O’Hare airport is not a direct flight as originally promised by Xtreme, but rather, two flights that requires over two hours of stop over in Mexico City. Xtreme’s last minute return travel plans calls for the same minimum of over two hours of stop over flight to Mexico City in route back to the U.S., and another minimum 4.5+ hours of bus travel from Chicago to the University.

Switching flights from one “co-terminal” city to another is a clear breach of contract. See section XVIII (B) of the Xtreme’s Terms & Conditions. These last minute alternative travel plans are radical departures from Xtreme’s travel plan representations that [redacted] signed up for. Xtreme’s new revised plan subjects [redacted] to two major 4.5+ hour treks on highways and other roadways in one of the most dangerous winters in recorded history. Stop overs in Mexican airports presents additional potential hazards never contemplated in Xtreme’s travel agenda that it sold to [redacted] back in October.

For the record, I tried to make every effort to find a mutually agreeable solution when we spoke this past Thursday night. It was Xtreme that put itself in the position of being unable to deliver on its commitment to fly [redacted] from Michigan directly to Puerto Vallarta. On that basis, I suggested that you figure out how to get [redacted] on a direct flight from Detroit’s Metro as one resolution. When you advised that it was impossible to arrange that, I suggested a full and immediate refund and you rejected that solution, recommending a $200 credit and other ‘perks’ that involved a larger hotel room (compared to what?) and a VIP table (another undefined and unwanted incentive).

Respectfully, your concessions, while a clear indication of an attempt to take some responsibility for Xtreme’s breach of contract, are grossly insufficient to offset the magnitude of the last minute changes that Xtreme is asking [redacted] to bear.

Given the February [redacted] departure date, I urge you to reconsider Xtreme’s position.

These are the proper reasonable, moral and legal courses of action.

I left a message for you on your cell at 11:30am today, February **, 2014 (###-###-####) to advise that at the time of my call, there were two seats available on Delta, leaving Detroit DTW on Feb., [redacted] at 9am arriving PVR at 1:21pm, non stop, flight # [redacted]. There are also two seats on Delta to return home; leaving PVR on Feb., *, 2014, at 12:51PM and arriving at DTW at 6:09PM, non stop, flight # [redacted].

In the event that we cannot immediately resolve this matter in an amicable fashion, with [redacted]’s express consent, we hereby reserve all rights and remedies to pursue legal action against Xtreme to recover all monies paid to Xtreme, including but not limited to all damages and recovery of all legal fees.

I remain available to discuss this matter. You can reach me at home __________ or on my cell at ___________.

Sincerely,

[redacted] with [redacted]'s express consent.

Response:

Revdex.com,

After reading the full detailed complaint regarding the travel package purchased [redacted], Xtreme does not believe a refund is in order. Furthermore, the complaint includes very selective portions of our terms and conditions in an attempt to skew the complaint in [redacted]'s favor.

The true facts of the matter are as follows:

-Customers have the ability to purchase a "Land Only" package or a "Full Package." When booking a "Full Package" it is made very clear that travelers can depart on an array of potential travel dates, as well as an array of departure cities. Many travelers choose the "Land Only" package due to the fact they have specific travel requirements. [redacted] did not choose a "Land Only" package, and selected a "Full Package" knowing the uncertainty with his selection.

-In accordance with the above point, I have copied parts of Xtreme's terms and conditions that support that the itinerary change was warranted:

"XTREME will provide as much information as is available to XTREME regarding transportation schedules at the time of your Reservation; provided however, that this information shall be considered by you as tentative and subject to change without notice per the individual carrier’s operating plans.Transportation schedules and travel times are not guaranteed and variations in same may affect the actual length of time you may have at your Vacation Package and/or Trip destination(s). Carrier schedule changes can occur without notice even after tickets have been issued; therefore, you are responsible for re-confirming both outbound and return transportation departure times and (requisite check-in times). In the rare event your Vacation Package and/or Trip, scheduled and ticketed by XTREME,includes an overnight layover in a different city,XTREME may, at its option, provide you with a pre-paid hotel accommodation for you for the scheduled layover; but this shall not include layovers caused by flight delays, missed connections, and/or schedule changes by the air carrier after the flights have been reserved. In the event that any air transportation is cancelled for any reason, XTREME may, at its option, provide ground transportation to the nearest available airport for you to continue to your destination city. XTREME shall have no liability for any travel delays to or from your Vacation Package and/Trip destination. "

-It is important to note that when the itinerary changes became known, [redacted] was presented with several options, one of which was to downgrade to a "Land Only" package. [redacted] choose to not accept this option. Since [redacted] choose not to accept several reasonable options offered by Xtreme, Xtreme must provide airfare, which was unfortunately not the desired departures city (Chicago).

-It is also important to note that Xtreme works on a group organizer basis when decisions such as these are made. Please see the terms and conditions below:

All room or villa occupants shall be deemed one group and Your Reservation shall either indicate yourself or a o-traveler as the designated organizer to act on your behalf in relation to your Vacation Package and/or Trip accommodations and add on packages. If no such person is designated in your Reservation, XTREME typically appoints the first person who submits his/her reservation form to act as the organizer for the group for the requested room type or villa. By submitting your Reservation for your selected Vacation Package or Trip, you are authorizing such designated organizer to act on your behalf as your agent in connection with all matters relating to Vacation Package and/or Trip including your accommodations, and XTREME is hereby authorized by you to rely upon your designated organizer’s actions (or if applicable in actions) on your behalf for changes and/or additions to your Vacation Package and/orTrip Reservation and you hereby agree to be responsible for any additional amounts as may now be due as a result of such changes or additions and pay all such amounts when due.In no event however, shall the designated organizer be authorized to alter this Agreement.

Xtreme understands that [redacted]'s experience was not optimal given the circumstances, however, Xtreme has acted in accordance with it's terms and conditions and ultimately did provide [redacted] with the components of the travel package that was purchased.

Please let me know if you need clarification on any of the above.

Sincerely,

Xtreme Trips

Response:

Revdex.com,

I read the the most recent response in regards to the complaint and again, the complaint is very selective and completely disregards Xtreme's position on this matter. I have again included Xtreme's position as it relates to this complaint below:

depart on an array of potential travel dates, as well as an array of

departure cities.

"XTREME will provide as

much information as is available to XTREME regarding transportation

schedules at the time of your Reservation; provided however, that this

information shall be considered by you as tentative and subject to

change without notice per the individual carrier’s operating

plans.Transportation schedules and travel times are not guaranteed and

variations in same may affect the actual length of time you may have at

your Vacation Package and/or Trip destination(s). Carrier schedule

changes can occur without notice even after tickets have been issued;

therefore, you are responsible for re-confirming both outbound and

return transportation departure times and (requisite check-in times). In

the rare event your Vacation Package and/or Trip, scheduled and ticketed

by XTREME,includes an overnight layover in a different city,XTREME may,

at its option, provide you with a pre-paid hotel accommodation for you

for the scheduled layover; but this shall not include layovers caused by

flight delays, missed connections, and/or schedule changes by the air

carrier after the flights have been reserved. In the event that any air

transportation is cancelled for any reason, XTREME may, at its option,

provide ground transportation to the nearest available airport for you

to continue to your destination city. XTREME shall have no liability for

any travel delays to or from your Vacation Package and/Trip

destination. "

Please see the terms and conditions

below:

All room or villa occupants shall be deemed one group and

Your Reservation shall either indicate yourself or a o-traveler as the

designated organizer to act on your behalf in relation to your Vacation

Package and/or Trip accommodations and add on packages. If no such

person is designated in your Reservation, XTREME typically appoints the

first person who submits his/her reservation form to act as the

organizer for the group for the requested room type or villa. By

submitting your Reservation for your selected Vacation Package or Trip,

you are authorizing such designated organizer to act on your behalf as

your agent in connection with all matters relating to Vacation Package

and/or Trip including your accommodations, and XTREME is hereby

authorized by you to rely upon your designated organizer’s actions (or

if applicable in actions) on your behalf for changes and/or additions to

your Vacation Package and/orTrip Reservation and you hereby agree to be

responsible for any additional amounts as may now be due as a result of

such changes or additions and pay all such amounts when due.In no event

however, shall the designated organizer be authorized to alter this

Sincerely,

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[redacted] vs. Xtreme Brands, ID #[redacted]

Portions of the article’s language and statistics follow:

Respectfully submitted,

.
