Customer came in and signed up for a month to month draft membership at the Columbia location. It was explained to them that that membership takes a 30 day written letter of cancelation to stop payment. Membership agreement was printed and signed by both customers and copies were given to them. Clearly states on the agreement that it takes a 30 day time period to stop the draft process. We have copies of there agreement and drivers license and bank card as proof we did our part in the most honest fourth coming way possible. We regret the customer was not happy with their experience and that our outside coke machine took their money. Our billing company has had no calls logged from the member. I am rejecting this response because: At no point did any employee with this gym ask for further identification or documentation of any sort. There was never any effort from this gym to resolve the serious concerns presented. The concerns I had were not inflated and neither were the details regarding Martin the employee who was harassing us. Just because he committed the crimes after being employed with the gym doesn't excuse the harassment he was doing while working at the gym. What it does show is a timeline of behavior he had and proves that he was very much capable of harassing clients based upon his aggressive behaviors. Instead of this gym apologizing for the negative experience we received they are trying to create an idea that in no way were they at fault for what their employee had done. As you can tell it has taken this gym this long to respond to this complaint which was old.

Not using the gym is not an allowable reason for cancellation of a contract. If your contract is over then you can cancel with 30 days notice. Please contact [redacted].

Review: Xtreme Fitness told me I could get out of my contract if I moved. I moved, and I am stuck in this contract.

I signed up with Xtreme fitness because a friend had signed up and was allegedly told if they were to move, they could get out of their contract. I went in and said that I have never joined a gym and wanted to talk to someone about signing up. A man brought me into his office and said this will be very simple, sign here here here and here and you will be able to use our facility 24/7. I said I had recently moved to this side of town, and I asked what would I have to do to cancel if I were to move again. He said all I would need to do is come in with a copy of my new address and it would be done. I moved. I came in with a piece of mail showing my new address and they told me I could not get out of my contract. When I asked why, I was told that the gym only accepts changes of residence that were 25 miles away to qualify for exiting a contract.Desired Settlement: I just want out of my contract.

Response:

Moving over 25 miles away and showing proof of new address change will allow the contract to be cancelled without penalty. If you have that info then Please contact [redacted].

Review: We have had a membership with this gym for over a year. The owners [redacted] and [redacted] actually took my son rock climbing with them. I have tried several times over the last few months to cancel the membership. No one answers the phone and no one is at the from desk. Finally, we went by yesterday and they have closed down but continue taking money from my account (2 days before). They refuse to return my calls or credit the months they stole from me. I don't know how many others have had this problem, but I am sure I'm not the only one they didn't inform.Desired Settlement: Mr. and Mrs. [redacted] owe me three months worth of fees or $114.00 ($38.00 per month). Thank you.

Review: Canceled membership, told all is clear, then get a letter from a debt collector three months later for $350.

Signing up for the club, in March of this year, I was lied to about there not any sort of trial period, but told I could cancel in the first few months if I didn't want to continue my membership, all the while being pressured and rushed through the contract that they'd set in front of me. HE seemed nervous and in hasty to get me signed up. Within 2 months I tried to cancel. I called in at the very beginning of May; they asked for my name, verified my address, asked if I would just like to suspend the account, or cancel it. I told them to cancel it, I waited a short period of time on the phone, then was told I'm all good. I asked if I needed to come in to sign anything and they told me no.

I get a letter from a debt collector about 4 months later demanding $350. I called Xtreme Fitness to ask about the charges, they refused to answer any questions, told me they didn't know anything, and was told they use 3rd party billing, and that I needed to talk to them. I called their 3rd party biller, and was told to contact the debt collector.

I called the debt collector to ask questions about the charge. He answered the phone without a greeting, just "What?" He refused to let me even ask any questions. Told me I was required to give 30 days notice to the gym, bring in proof of moving more than 20 miles, and required to pay an early cancellation fee... none of which was mentioned speaking with the employee several months earlier on the phone. The debt collector refused to answer any questions, yelled and personally insulted me, called me an it and asked if I knew how to pay bills, all while I remained completely calm and civil.

Extreme Fitness won't talk about the charges, or anything. No one I ask questions to will answer them, so, I have NO idea why I'm being charged $350 after canceling and being told there's nothing else I have to do.Desired Settlement: Settle the issue with the debt collector and/or retract the outrageous fee of $350 for what I'm not even sure.

Review: My husband and I opened a membership with Xtreme Fitness with an agreement number of [redacted] on approximately May 23, 2011. We had been satisfied with our membership until around June and July 2011 when an employee by the name of [redacted] began harassing us about my husband assisting with my workouts. I explained to [redacted] that the man assisting me was my husband and that we both have a membership. He began to harass us about training in the gym so I immediately went to the front desk to speak with the General Manager as two other employees one man and one woman were standing groping each other ignoring the fact I was standing there waiting for assistance. When they looked at me they began laughing and continued to ignore me until I spoke up and said "excuse me, I would like to speak with the manager". The manager then came to the counter when I asked to speak in his office. It was at that time I discussed the harassment issues as well as the unprofessional behavior and lack of customer service occurring at the front counter. He began justifying all three employees actions and then finished by saying he would speak with them. The next time my husband and I arrived to workout the same harassing behavior continued and again we explained the same thing, that we were married and both had a membership. Again I approached the General Manager with the same concern and again he replied the same. This situation continued to occur until around the end of July when both my husband and I decided after speaking with the manager a third time together that this situation was not going to be resolved. We stated at that time that the contract had said if we weren't completely satisfied with our membership that we could cancel. The manager explained to us that regardless of the harassment complaints we couldn't cancel our membership. It was the end of July that we stopped using Xtreme Fitness all together.

On Saturday, 12/10/2011, [redacted] made headline news on channel 7 KRCR along with the Record Searchlight newspaper and ShastaMugshots.com for being under the influence of Methamphetamine coupled with some very extensive violence, child abuse and terrorist threat charges which would explain the harassing behavior occurring at Xtreme Fitness with my husband and I. I feel it is very important to mention that the first day my husband and I worked out together at Xtreme Fitness which does include a children's daycare inside the facility that they also provided membership to a known child molester. This was also an issue I brought to their attention. This company, throughout the community, is known for their bad reputation. Despite the rumors we had heard of the place we decided to give them a shot, bad decision on our part but in no way should a business be allowed to operate in this manner. I also have the newspaper clippings as well as a print out of [redacted]'s mugshot listing his charges if necessary. Thank you for your time.Desired Settlement: See Complaint Text

Review: I have been with this gym since before it opened which I believe is going on eight years now. The quality and cleanliness have only ever gone down since then. The owner has been complained to countless times over the years and even employees have complained to him and so I feel this is the next step in hopefully getting some response or action. The main aerobics room has had broken ceiling tiles for years now, and the floors and mirrors will go months without being cleaned. I am in class almost everyday so I observe that. The downstairs drinking fountain is going on a month now and has not been repaired. The hand sanitizer containers have not been filled in at least 6 months. The women's bathroom lights have been out, except for one for over two weeks now so anyone using that goes to the bathroom in the dark. Only one soap container in the bathroom ever has soap in it and there is always trash on the bathroom floor sometimes for weeks at a time. The toilet paper is never in all the stalls at once- this has been for years- and there isn't any bottles of cleaner around the gym equipment even if you wanted to wipe it down. Sometimes the daycare worker doesn't show up and the front counter person is forced to do both jobs- how is that even safe? There is no longer a towel service and yet once a year the gym takes $60 dollars out of our accounts for "gym improvements" The other day I noticed a sign at the front counter that says you can help yourself to the tanning beds 24/7 and the button panel to operate the tanning beds for anyone to use. I really hope a teenager doesn't abuse this and accidentely fries themselves in the beds. In the old days there would be three or four staff standing around the front chatting and the gym would still be filthy- now there is usually only one staff member around, and there is no way they could perform all the tasks the gym needs. There is a card scanner outside the front door so we can get in when staff is late, but now it just hangs by a wire- now a month.Desired Settlement: I would love for the gym just to be clean and broken things fixed in an timely manner. The gym is in a great location and the fitness instructors are top notch. This gym has such incredible potential if only it was clean and delivered on the services it advertises on a consistent basis.

Response:

Thank you for you long term commitment and concern to help make our gym a better one.

Some ceiling tiles have been removed from the aerobics room only to provide access to hang our rings and punching bags.

The first floor water fountain was done and has been repaired. However there was 2 other water fountains working during this time.

Only adults are allowed to tan.

There is sanitize bottles throughout the gym are are now refilled every morning.

Card reader is secure.

We have a full time cleaning crew. And babysitting crew. However, if a babysitter calls in sick then yes our front desk staff will cover instead of closing the kids room. This is done for people that drive far to our gym and bring their kids. We feel it is only fair that the moms and dads still get to work out.

Please keep me informed on any future concerns and our progress to meet your needs by contacting us Please contact [redacted].

Thanks for being a member.

Review: I was told that if I moved, I could cancel my membership with no issues. They continued to charge me and sent me to collections.

I was a member of this gym for several years. I was told that if I moved out of town, I could cancel my membership with no fees. I moved from Redding to Chico. I went to the gym and canceled my membership before I moved (and I got a signed cancelation form). They continued to charge my account through automatic billing. I called them several times to get it stopped, and they said it would stop... but I kept being charged. Eventually I closed my checking account so that they couldn't charge me anymore. Then a few years later, I checked my credit report and saw that they had sent me to collections! I called the collections agency and explained everything to them. I ended up having to pay them, but they did remove the negative mark on my credit report at least... All in all, a terrible experience. I've heard nothing but horror stories from people who try to cancel memberships with this gym.Desired Settlement: It would be nice to be reimbursed for the months I paid for after I had already canceled my membership... but I'm not holding my breath.

Review: They will not cancel my account. And keep billing me for something I am not even using.Desired Settlement: Stop billing me I do not owe this money to them, um hello I have not been there since I lost my job!
