"Since no one is answering my calls I felt it necessary to communicate to you my expectationsI expect a schedule of proposed repairs to my condo I want to know day by day what is scheduled and if nothing is being done I want to know whyI expect daily
updates of the work that has been completedI need a new date for substantial completion and I want the orientation walk-through scheduled and a new closing dateAs you should be aware the contract says that I have a right to expect thatI will not accept a closing date later than 6/12/15.
I believe that I deserve compensation for my out-of-pocket expenses, which by June will be $This includes rent for May and June at $per month, moving expenses totaling $1100., and storage of $If the unit is not ready by 6/12/I expect a daily penalty to be paid to me at a rate of $per day until the unit is ready I was told by you that the delays were a result of an act of God and actually what occurred was negligence of the plumber who you employed and therefore you are responsible for recouping the losses" I wanted to respond and possibly clarify a few items First of all, we understand the frustration in having your closing delayed--we are frustrated as well Everyday the home is not closed, has a negative financial impact on our company, so I assure you that we are all working toward the same goal The delay that we are experiencing was an unfortunate mistake that occurred during the under-slab plumbing, while not an "Act of God", it is handled in the exact same fashion- this is an insurance claim on the plumbing contractor, no difference than had their been hail damage or a burst pipe Fortunately the mistake was caught before your move-in, because the repair is quite intrusive and messy Trust me when I say that it is better to have had this discovered in advance of closing where we are the ones having to deal with the insurance company rather than you During the course of construction of a home there are many issues that are corrected along the wayits just part of construction That is the reason that we employ superintendents to supervise and sort out these issues when they occur This issue unfortunately required a fairly elaborate repair There were cheaper and faster solutions to this problem, but I personally made the decision to spend some extra time and make sure it was done right, and that the solution was appropriate for a brand new home In regard to your financial demands and deadlines, simply put, what you are asking for is just not what we agreed upon I have attached a highlighted copy of the Agreement pointing out the areas that address construction delays as well as what happens when a home is damaged during construction We reject any claim for compensation as requested I have reviewed the schedule with our construction team and currently we are shooting for a closing date of 06/16/ The orientation will be scheduled for a few days prior to the closing Our superintendent will contact you once we are about weeks away from closing to confirm If you are concerned about scheduling deliveries, etcI would recommend giving yourself a little buffer just be on the safe side I understand that you are extremely frustrated with your experience here of late, but I want you to know that we care very deeply about delivering you a fantastic home, and I am personally involved in making sure that our team is doing everything within our power to finish the home quickly, completely, and correctly Thanks,TomThomas JoynerOwner, Joyner HomesO: 317.468.2320M: 317.654.3387F:

<[email protected]>Subject: Revdex.com CASE# [redacted]   In the case of Mrs [redacted]: Mrs. [redacted] brought us (Xtreme Inc), her 2005 [redacted] in Aug. of 2016. Mrs. [redacted] had already hed the truck diagnosed by someone else & told us to ONLY change the driver side fuel injectors & an EGR cooler, which we did exactly that. Afterwards, the vehicle still did not run correctly. SHe then needed a glow plug harness for the dr & passenger side of the truck, which she approved, &  she asked us to also change the passenger side injectors as well, which we did along with an oil change. Upon changing the injectors, we found that #7 cylinder injector was dumping fuel into the cylinder, due to a broken injector nozzle on the end of the injector that was missing.Mrs. [redacted] was notified of that & took the vehicle & drove it for a few days, still smoking, before coming back with it. After she delivered the vehicle, it would not start, I then had my (2) [redacted] master diesel tech certified mechanics look at the vehicle. It was found that the vehicle had NO oil pressure.  The [redacted] techs found that the IPR sensor had a hole in the screen & the oil cooler that the IPR sits into was bad due to dry rotted O rings & the screen/ filter beneath it was deteriorated and the high pressure oil pump was bound up, not spinning freely. Mrs. [redacted] was notified before anything was ordered. She approved the work so we went forward. After changing the oil cooler & oil pump, the truck started & ran, but still roughly. We had to regain oil pressure & fuel pressure before knowing that the missing nozzle on #7 cylinder went into the head causing valve damage causing #7 cylinder to loose compression. Her batteries were also changed because the ones she had were no good. Mrs. [redacted]'s employer was paying for the work as we went, & he was informed of everything all the way as well as Mrs. [redacted] was. She failed to tell us that she bought this truck from a person's family that the owner had died, & the truck had beeb sitting in a barn for almost 5 years! Diesels need constant lubrication throughout the engine in order for components not to seize, dry rot, or to get surface rust. The oil in the bottom of the oil pan when we 1st changed the oil looked like mud! That's exactly why she had the transmission rebuilt earlier with someone else also. I notified Mrs. [redacted] & her employer that the head would have to be removed by lifting the cab off the truck, & the head would have to be sent to a machine shop to have it & the valves inspected & repaired before I could put it back together. I gave her a price for the work & talked to her employer, that was funding her, & he declined the work & agreed she should have never bought a DIESEL truck that had been sitting for so long & not have expected multiple problems. Xtreme Inc did everything by the book, with the best technicians, & did NOTHING without approval. We kept in very close contact daily with Mrs.[redacted] the whole time and worked late, sometimes till midnight for her. We replaced ONLY the components that Mrs. [redacted] told us to change in the beginning & then ONLY the components that were 100% no good with her & her employer's approval. The remaining work was not performed  because the truck exceeded her employer's willingness to spend more on a vehicle that had so much problems. We tried our best & did everything we could to help Mrs. [redacted], but she expects Xtreme Inc. to do the work & pay for the remaining parts for free. The vehicle was not a total loss when it was here & we would gladly repair the vehicle at cost if she still wanted to move forward to keep a good business relationship. This engine is very well known for multiple problems & a class action lawsuit against [redacted]I have all the invoices & pictures to back up 100% of this statement if needed as does Mrs. [redacted].
