On April 14, [redacted] was emailed a copy of the sales contract for his purchase of a [redacted] ***Mr [redacted] was quoted a price of $13,150, a discount of $1,off of the $14,MSRP of the desired vehicleAs per the BRP Spring Fever promotion requirements a $non-refundable deposit was taken and the Spring Fever Promotion Contract was completed and approved by Mr [redacted] See Appendix The customer requested the possibility of trading in his vehicle on the purchase of his new vehicleXtremepowersports informed Mr [redacted] that we use fair market value as assessed by [redacted] as well as a physical Inspection of the vehicle when the customer brings the machine in for our mechanics to go over, to determine if trade is acceptable and if purchase offer will be made (See Appendix 4)As stated on the sales contract, to which Mr [redacted] agreed to, the trade value is listed as "TBD" (to be determined)The purchase of the new vehicle was non-contingent on the trade In of Mr [redacted] 's current vehicle and as such, he was able to decide not to trade his vehicle and sell It of his own accord with no recourse from XtremepowersportsMr [redacted] had possession and use of his current snowmobile during the entire contract elapsed time periodAlthough Mr [redacted] claims to have had communication with a former employee of Xtremepowersports, months prior to the delivery of the new vehicle that he agreed to purchase through the Spring Fever Promotion with respect to possible value of his current snowmobile, we have no documentation of any such communicationIf there was any communication it would be merely anecdotal In nature due to the variables of fair market value and the condition of the property at some indeterminate time in the futureAs can be seen clearly on the bill of sale, to which Mr [redacted] agreed to, the trade value was listed as ''TBD''See Appendix & Mr [redacted] was notified that his snowmobile would be shipping from BRP the week of 9/26/Mr [redacted] had communicationswith an employee at Xtremepowersports on 10/18/that his vehicle was being put on the schedule to be built, As per Spring Fever Promotion Certificate/Contract (See Appendix SJ, to qualify for the promotions, the customer must submit a non-refundable deposit, as well as accept delivery of the vehicle within days of dealer notificationAs the customer was notified on 10/18/that his vehicle was being scheduled for assembly, this would allow for a pick up date no later than 11/2/As Mr [redacted] did not complete the purchase and delivery of his new vehicle in the required time frame, his non-refundable deposit, which he Is aware of, has been forfeited to BRP because of his failure to meet the requirements of his contract with Xtremepowersports and BRP, The contract has been closed, as "Failure to Consummate" by Mr [redacted] and as per BRP "Spring Fever Promotion" contract, no return of deposit is dueThere will be no further communication on this from Xtremepowersports

As Mr. [redacted] did not complete the purchase and delivery of his new vehicle in the required time frame, his non-refundable deposit, which he Is aware of, has been forfeited to BRP because of his failure to meet the requirements of his contract with Xtremepowersports and BRP, The contract has been closed, as "Failure to Consummate" by Mr. [redacted] and as per BRP "Spring Fever Promotion" contract, no return of deposit is due. There will be no further communication on this from Xtremepowersports.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me if Xtreme Powersports acknowledges that and accepts that the chargeback is confirmed and not disputed.
