Review: Upon looking at my credit report I found a derrogatory remark pertaining to a car loan I co-signed on. I found out the car was reposessed upon a call from someone NOT on the loan. I contacted Y2K and at first they said they didn't report anything to credit agency. #months later I contacted them after disputing the claim, finding out they had added , in collections, attorneys contacted on my credit report. This was after I contacted them and told them I would have taken care of it and kept the car had I known. I contacted them again and they informed me that they didn't know what happened to the car. Then they said it was sold back to [redacted]. I asked over a month ago for balance and a way to get this resolved. No answer from them. Today they said they didn't have any info on me!The lady was rude and obnoxious on the phone when I asked her for balance owed, and where the car was. She informed me I had to pay the whole loan, and would NOT be getting car back.Desired Settlement: I want this taken off my credit report immediately and put as paying once a monthly amount can be obtained. I also want to know what happened to the car, what it was sold for, and what actual remaining balance is. I have no problem working out a payment agreement with them, I want the derrogatory credit report removed.

Response:

Thank you for your time in addressing [redacted] complaint. After reviewing his concerns I have the following for your consideration. The reason [redacted]son has derogatory remarks on his credit report is because he has a derogatory credit history with Y2K Finance. After analyzing the remarks in our database, regarding this account, the other party on the account ([redacted] daughter) was sent to jail. Upon calling [redacted] phone to make payment arrangements his wife stated that they were no longer going to pay for this vehicle and to come pick it up. They then proceeded to give us directions on where the car was located to secure the vehicle. That is about as straight forward repossession as it comes, and his credit report accurately reflects this. [redacted]son insinuates that it was Y2K's responsibility to make sure he performed under the provisions of the contract. This is simply not the case. [redacted]son is a 55 year old man and is certainly capable of reading and understanding a basic contract and his obligations in it. I do see where [redacted]son called wanting a deficient balance on 06/14/2012 but the number he left to respond to that request was not in service. I can tell you that the deficient balance is $4,537.78 and he is free to remit that balance at anytime. That is about all I am able to address since the remainder of his dialogue is so poorly written that I can't understand it. I can tell you that the repossession being reported to Experian is accurate and WILL NOT be modified.[redacted]

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The issue I have is that I was not contacted. My ex-wife called them, who IS NOT ON THE LOAN, and made no attempt to contact me. I have purchased 4 vehicles whith them in the past, and honored my contracts on all. All I wanted was to resolve this, not to have someone change the remarks on my credit report to be even more negative. I contacted them last year and their response was THEY didn't put that on my report. Every time I have called, I have retained a different response. They were suppose to send me the info over a month ago. I work field service, over 200 people call MY PHONE every week. So their employee wrote the wrong number down. I want paperwork showing the car was not sold. That the remaining balance is correct. I told them before I have no problem setting up payments, send me the info. I want to resolve this....I AM THE ONE WHO INITIATED CONTACT! I want this resolved, you would think they would be more than happy to begin collecting the balance!

Response:

[redacted] has alleged a lot of different issues in his letters. Here are the facts of what happened with [redacted] loan.

1. [redacted] claims that this account should not be on his credit report - I do not decide what to put on someone's credit report. I simply relay what happened on the loan and its eventual outcome. In this case, [redacted] did a voluntary repossession and this is what is being reported and will continue to be reported.

2. Following the voluntary return of this vehicle a 10 day letter was sent to both parties (attached.) However, that letter was returned without a forwarding address, as per our collection notes (attached.) The credit application (attached) indicated that they both lived at the same address and we sent the letter to the last known address.

3. [redacted] stated that he had prior purchases, financed by Y2K, that were successful. We believe that to be the case as our notes indicate that we would not pursue a deficient balance (attached.) He will also see in the notes what the deficient balance was prior to reselling the vehicle ($5,662.78.) The vehicle was then sold for $1,125 (attached) and that left a remaining balance of $4,537.78.

Look, this is as straight forward of a voluntary repossession as there is. Y2K accepted the vehicle back that was in a delinquent status, declared a repossession, sent the correct paperwork and reported appropriately. If [redacted] would like to have this account shown as "paid in full, was a repossession" then he can make arrangements with [redacted]. I am sure [redacted] will be more than willing to find a settlement agreement greatly reduced from the deficient balance.

Thank You,

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. I will contact the manager.

Regards,

Y2K is one of the shadiest businesses I have ever dealt with in my life. My fell behind on a payment, and instead of calling me, they call my good friend who'd recommended them to me and told him how much I owed, how far behind I was and that they should get a hold of me. This is ILLEGAL in many different ways, unfortunately only civil. This company is by far not worth the effort in any way shape or form of dealing with.

Review: Y2K and I settled on a pay off price for a 1996 Buick which I sent them $500.oo refund check on June 3, 2013. I called at the end of June when I did not receive the title. I spoke to [redacted] a supervisor about the title and [redacted] who works there which was harassing me while I was in the hospital very ill and I kept telling [redacted] where I was at and said I would send the money when I received the income tax refund and was out of the hospital but she did not care, yelling at me several times. When I voiced this to [redacted], he said I was trying to cause trouble that I was a trouble maker and told me the title would be sent to me in 30 days and I was not to call and bother them again. Well, to this date July 24,2013; I have not received the title on my 1996 Buick. I don't understand why they won't send it. I have prof I was in the hospital and very ill.Desired Settlement: I would like the title to the 1996 Buick before the first of August 2013.

Response:

In response to the complaint from [redacted], most of what she is saying is completely untrue. She was never yelled at or told she was a "trouble maker."

It is our policy to not release the titles until 60 days after receipt of a personal check as was the case in this situation. Her illness has no bearing on any of the activities involving this business transaction.

Her title was mailed on August 5, 2013.

Thank you,

Manager, Y2K Inc.

Regards,

Very shady they sold me a lemon, wouldnt make promised repairs... argued constantly until I finally returned the vehicle to their lot before a payment was even due... I was never offered a refund from my down payment, a replacement vehicle... nothing! In fact I never heard from them again for over 4 years and then all the sudden I am served with papers that they are trying to sue me. Bad bad bad business!!!
