Got taken in the end.
Placed and order online for 4 small parts in june 2023. 2 days later received an email telling me the parts were backordered and should arrive approx 8/28. Received one of the small parts in the mail on 8/21/2023. When I asked about the other parts they said they were discontinued and would offer a refund. Had I not called dont know when I would have found this out. Now the refund part starts. The initial purchase amount was 67.95. the invoice that came with the one part was for 9.94 so I would expect a refund for 58.01. Well they say the refund will be 47.71 which they said was for the 3 remaining parts and the shipping. well the original invoice showed the shipping at 16.75 but they refunded 4 dollars. when question the answer was "
Here is internal document info on your shipment in blue. Our Cost to ship was $8.50 plus internal labor $4.00 = $12.50

$16.75-12.50= $4.45

The shipping refund was rounded to the nearest dollar ( $4 )"
so my 7.49 part ended up costing me 20.24 NEVER AGAIN ..

Facts [redacted] was given a detailed list of all added accessories The lighted flag rods were NOT on it, neither was the RECLUSE CLUTCH (which he took for free) 1st time driven [redacted] called us saying the machine blew up, tried to find company to work on it for fouled plugs(this is caused by operator error lugging the machine) Oil reserve tank has nothing to do with engine level, it does not cause problems Tires customer put on are to big for the stock horsepower of the engine The opinion of other people or dealers, to run large paddle tires on this machine is not evidence that a person should do that The machine was spec'd out with all terrain tires of specific size for optimum performance for the stock engine Larger tires with no horsepower upgrade is not suggested and can cause operational issues for the vehicle The Rekluse clutch installed prior to the machine being put on the sales floor for sale, is a recommended Yamaha Accessory, added for those customers that do not know how to manually shift a machine (or dont want to) Customer requested it to be removed, which we did We installed a stock manual clutch which the customer proceded to "burn up" due to improper operation, so we replaced that system at no charge trying to satisfy this customer There are hundreds of these machine with stock clutch set ups in operation, and they are performing correctly when operated correctly by the driver Soft parts like clutch plates are the customer responsibility, just like brake pads are We mistakenly refunded him for the Recluse clutch that he never paid for ($300) and refunded for the custom aftermarket Graves Exhaust that he decided he didnt want ($1200) Customer claims to have video of his machine not performing in the soft sand with the large tires on it, but he is not willing to share this with us We tested this machine in our shop (Authorized Yamaha Dealer and Yamaha Trained Service Staff) and the machine has no operational problems We requested to take the machine to the soft sand for additional testing, to replicate his issue, but he would not allow us to do any testing So far, we only have "hear-day" that there is an issue with this machine We did have another customer test their machine on the soft sand with stock tires and it performed perfectly We did have another customer test their machine on the soft sand with paddle tires AND a turbo horsepower kit, and it performed perfectly We do not recommend a customer install larger/paddle tires on a stock machine Customers are free to install ANY aaccessories, tires or the like on their machines, some items void their warranty, some do not It is up to the customer to check their WARRANTY paperwork for details It is the responsibility of the dealer to provide such printed information, which we did, but we do not read the documents and booklets to the customer

This is obviously getting nowhereThis seems to be coming back to paddle tires every timeThe parts guy at yamaha sports plaza ordered the paddle tires out of a magazine before I left on 6/4/2016, He said "you want these ones?" and pointed to the set of paddle tires that were orderedNobody ever said anything to me about the fact that these are not recommended for the machine I had just purchasedWhy would anyone order a brand new set of wheels and tires that are not recommended for a brand new machine? That doesn't make any sense at allThe sales guy Dan told my wife and I about the LED flags when he was trying to sell the machine to usHE USED THE FLAGS AS A SELLING POINT! He even said how you can control them with the remotes and change the colors (the remotes that yamaha sports plaza took back after the machine was in my trailer)This is not going anywhere blaming me for "smoking" a new clutch, The owner Dan showed Myself and my friend Josh the bad clutch they removed out of the machineThe owner Dan also said that THEY had installed the clutch incorrectly! This is NOT my fault at all! I was sold a piece of junk machine for $28,that this shop does not know how to fixI have been lied to multiple times and they just keep changing their storiesShame on you!Sincerely,*** ***

Complaint: ***I am rejecting this response because:Sincerely,The machine does not run/drive properlyWe have compared it to another Yamaha YXZ1000R with 28" paddle tires in the sand at the same time as the video was takenI also have a video of the other machine, and it takes off normallyI have spoke to two other Yamaha dealerships and both dealerships have told me that the paddle tires are not the problemBottom line is that the machine DOES NOT WORK PROPERLY and has been misdiagnosed every time at Yamaha Sports PlazaThe machine was sold to me with many modifications done to the machine that were installed by this dealershipThe owner Dan told me that their mechanic installed the clutch wrong, so they installed a factory Yamaha clutch to replace the recluse clutch that was aftermarket and installed wrong by themThey also removed an aftermarket exhaust system that was installed by themI did not choose to have these modifications installed, the machine had already been modified and was in their showroom for sale that wayThe salesman also told me that the unit came with LED lighted dune flags with remote controls to change the colors and quick release flag mountsThe owner said that the flags were NOT included after the sale was completed and they had me go get the flags out of the back of my trailer and return the controllers that were in the units glove boxThe owner then charged me another $for regular sand dune flags that I paid for with my debit card after I had just financed $26,on a Yamaha credit card and paid sales tax and licencing with my personal credit cardThe machine DID NOT HAVE AN OWNERS MANUAL WITH IT! I had to call them and ask for an owners manual since they never supplied me with one at the time of purchaseI did not get what I paid for! You cannot sell someone a new machine with all of these options and then remove them after the sale is completed The mechanics at the dealership do not know what is wrong with the unit and all I hear is a bunch of excuses and lies every time I have tried to get this problem fixedI cannot believe that someone can stay in business with all of these bad business practicesI have now contacted an attorney and I will be seeking legal advice at this point.

Customer purchased the blue & white machine pictured.  This will give you an idea of the kind of major vehicle this is.  For all financed sales such as this one, we are required to title the vehicle in the name of the purchaser, just like a car and name the finance company as lien holder, and also register the vehicle with the state. $21,599.00 base price
 The consumer bought our showroom Special Edition with many extra options.The consumer bought oversize tires  28"dia to replace the stock size 26"dia,   (through us) his choice from an aftermarket supplier,as he intends to at some point install a turbo kit on the engine to double the horsepower of the machine, torque and lower the gear ratio, which he will need to push the paddle tires in the soft sand, the stock engine will have a harder time turning them because the paddles on the tires get locked into the sand unless you are practiced at starting out in soft sand.  (Customer did state he is going to order the turbo from MPI, Inc. when he can, the kits sell for Retail $3999. but one has not been installed yet to date that we know of.
  
 If  at Revdex.com you are not familiar with sand travel, this is a similar function to a river boat with a rear paddle.  The right size paddle wheel matched to the size of the engine will send it through the water, a larger size paddle wheel will be to large for the boat to turn easily and use up most of the engine power just to get it to turn, and slowly, if at all.  Hope that helps you.  So if the customer is having trouble, he will have to take the oversize tires them and use the recommended stock tire size, or add the turbo kit with the big tires for the performance level he is seeking. 
I would also like to address the customer early-on (first use) complaint of white smoke from the exhaust when unit running and driving.  This can happen during the "break-in" period when the user lugs down the engine (does not keep the RPM's in the recommended mfg's range)  These machines are designed to operate at very high engine RPM's, topping out at 10,000 rpm limit as described in the Owners Manual, HOWEVER, the Owners Manual #LIT-11626-29-60 clearly states specific instructions for 0-10 ( Avoid prolonged operation above 5300rpm and vary the speed of the vehicle from time to time and do not operate at one set throttle point: and 10-20 hours of operation, avoid prolonged operation above 6300rpm.).    This particular customer claims to know everything about sand motor sports, however, the machine he purchased is brand new to the industry, so reviewing and following the mfg specific recommendations is very important, especially during the break-in period.
After three trips to the sand dunes, the customer reported to be disappointed with the machine.  On July 5th, the customer came to our store and showed 3 managers (Parts, Sales, Service) a video of him in the machine operating in the sand, with the big tires on it, which isnt a problem after break in, but it does take more horsepower (hp) to turn them and they easily dig into the sand.  The video clearly depicted the customer repeatedly revving and holding the engine to the 10,000 rpm point (which causes the electrical system to cut engine operation to protect the engine from damage, this is a built in safety feature) which first of all is not recommended on a new engine, but 2nd of all, is not the proper way to start the vehicle from a stop.  It will simply dig a hole with the paddle tires, and as the customer claims, the machine will not move forward.  (paddle tires out perform smooth tires in the sand so even if he had it in 4WD, he has smooth front tires which will stay on top of the sand, only the back end sinks)  
It is hard to know for sure if the customer is operating the vehicle as the mfg designed it to be used, but clearly at the time of this video, he was not.  It is important that the customer  reads or re-reads and follows the instructions in the owners manual, and learns basic operations for driving in soft sand.  Even with experience in other types of ATV/UTV/SxS, this is the first one of its kind with 5 speed sequential manual gear shift operation and 3-cylinder engine. Stock engine 77hp.  With turbo 155hp. to ever hit the market in Fall of 2015.
We have done many things to help this customer . We asked permission from the  customer, to take his machine to the sand and test the operation there under the exact conditions he complained about.  He became very adamant about the fact that nobody was taking his machine anywhere.   But if not allowed to replicate the problem he is having, we can not prove that it is happening at all. 
The next best scenario was to test the machine on solid ground (wet pavement to create a similar slippage you might get in sand) with the stock OEM tires on 7/7 at our location.  Tested by two different drivers here, the machine performed exactly as it should. The engine tested perfectly, exhaust correct, torque correct.   
The customer came and picked up his machine on 7/9.  We gave the customer a check for $1500.00 , Refunding him for the $1079.99 custom Graves exhaust (used at this point) plus $420.00 as he was very very upset in the store that day making loud demands, as he picked up his machine.  We have not heard from him since.
The customer's desired settlement is a full refund, compensation and corrections to his credit report. 
This is not a defective unit, nor does it even need any kind of service (as it was inspected 7/9 and found to be in excellent condition without defect)  The sales agreement does not include any kind of refund or return of purchase if the customer doesn't like the machine or if it doesn't meet their application.  We suggest that if the customer, after a period of time adjusting to and setting-up with matching add-on components and still simply does not like the off-road-vehicle, he should sell it and choose something else to his liking.
