To Whom It May Concern,
In reference to the Yankee Trader LLC's June 12, response, which I received from you via email on June 25, 2015, and in support of my initial complaint about said vendor having knowingly sold and shipped to my name a pistol with a damaged barrel and missing ejector spring, the pistol was at my transferring dealer's place of business from the moment it was received, on 04/25/15, until I took possession of it on 05/26/15, as indicated on my dealer's copy of the Maryland State Police's Application to Purchase a Firearm, included with this letterI contacted the seller, Mr***, via email on 05/17/15, immediately after having returned from my dealer's place of business from having filled out the included paperwork, and physically seen the pistol for the first timeHe quickly replied to my email citing his day inspection period as an excuse for not accepting the pistol back
Please see the included “Maryland State Police Application and Affidavit to Purchase a Regulated Firearm,” as provided by my gun dealer, *** *** of *** ***, LLC, information below, which at the very bottom of the document contains both my signature and Mr***'s signature next to the date the paperwork was completed by me, on 05/17/15, and to the right of that, mine and Mr***'s signature and date, 05/26/15, in which the pistol was transferred into my possessionThis document was provided to me by my gun dealer, Mr*** ***, who can easily confirm the dates I have provided in my communications with you, as well as the fact I noticed the damaged pistol barrel when I inspected it on 05/17/
Please also see the included copies of my email, dated 05/17/15, complaining to Mr*** about the condition of the pistol, and his reply on that same date; note the dates on the emails
From 04/25/through 05/26/the pistol was at my gun dealer's place of business and all he did was
open the box to check the serial number before logging it into his record book and storing it in a safe, as required by lawI complained to the seller, Mr***, about the damaged barrel on 05/17/15, but only took possession of the pistol on 05/26/I have conducted gun-related transactions with my gun dealer, Mr***, who is also a full-time Federal government employee whose job requires a security clearance, for at least five years, have bought on average 5-guns per year with him, and consider him and honest person of good characterHe is not a gunsmithHe does not fix guns for a livingHe transfers guns, usually new guns, as a part-time job
The documents provided with this letter show that the gun arrived with a damaged barrel, and missing ejector spring, and not only dispels Mr***'s ingenious theory about unscrupulous buyers, but vividly reverses it
I am no longer interested in a partial refund that would offset the cost of fixing the pistolI want a full refund, plus $for the transfer fee I paid my gun dealer, plus the actual cost of shipping the pistol back to the seller
If the seller, Mr***, refuses to issue a refund of $($+ $shipping) + $35, Transfer fees, plus the actual cost to ship the pistol back to him, then I would like for this complaint to be made public (with the exception of my personal information on the included State of Maryland application to purchase a firearm), so that anyone thinking of doing business with *** ***, the Yankee Trader LLC, and any other companies under his name, sees what kind of merchant he is and how he conducts business across statesAdditionally, I will pursue whatever means available to obtain fair compensation for the damages done

On 4/23/ J shipped an FEG model Rhandgun, serial number ***, to ***, ** *** *** *** *** *** * * ***, a licensed firearm dealerThehandgun had been purchased by the complainant over the Internet for $15, includingpostage and insuranceAs it was shipped by US PS
priority mail, it probably arrived on orabout 4/27/15.On or about 5/ 17/15, twenty days later, I received a phone call from said complainant that"the barrel was bulged" and that he expected to be compensated for this "damage''Ireminded him of my return policy (attached) and that the barrel certainly was not bulgedwhen I mailed itBased on these facts, I refused to send him any compensation.Let me add, for what it's worth, that most firearm dealers have had to resort to returnpolicies very similar to mine as the firearm industry lately is replete with instances suchas this that can only be described as scamsIt is very common for unscrupulous buyers topurchase a weapon, shoot it for a few days or strip it of a hard-to- find part, then try toreturn it on the pretext of it being defectiveYet others will complain that it was"damaged in transit" but that their gunsmith can fix it for "only $50, so please send methat amount and neither of us will have to file an insurance claim ."l hope I've made it clear why I declined, and continue to decline, the buyer's claims andrequests, especially when they were made twenty days after the fact
Inspections/ReturnsA) I have a 24-hour non-shooting inspection period, which begins at the time of delivery.If a buyer finds any undisclosed problem with an item sent to him by my company, Yankee Trader LLC,please call or email me before doing anything elseIf the buyer does not contact me during the inspectionperiod, the sale will be considered final.B) Inspection consists of external examination, functioning the action by hand, checking the bore, andhaving the headspace checked by a qualified gunsmithNo further disassembly, firing of the gun,substitution of parts, turning of screws, or removal of pins and scopes is permitted.C) Returns and refunds will be authorized only if it is determined that the item is not exactly as described.If I allow the return of an item, it must be returned within two days of delivery and in the very samecondition as received, freight prepaidDo not return the item COD as it will be summarily refused;shipping costs are not reimbursableA full refund, less shipping, will be made by company check withintwo business days of receipt by Yankee Trader LLC.D) If the buyer has simply changed his mind about the purchase, or if he fails a NICS check, advanceauthorization must be obtained from the seller before the item can be returnedIn such cases I will refundpayment less a 20% re-stocking and re-advertising fee.E) If, however, it is evident upon inspection of an item returned for any reason, that any of the nonpermittedactions detailed above have occurred, the refund amount will be limited to no more than 25% of_the original purchase price, and the buyer wilfhave purchased a very expensive (insert part name here)
