this letter in response to Monterey FInancial Services Inc.  requesting payment of $1,941.00. I am requesting that this debt be forgiven.  I am aware that my initial contract stipulated payment of $303.67 for a period of 90-days.  My last payment was two days late due to illness.I am under strict doctors care for the treatment of Lupus.  Although I feel fine health wise most of the time, there are times when it comes out of remission.  At these times the medication taken to stabilize my platelets causes me to be incoherent.  I have statements from my doctor to validate if needed.I phoned Monterey FInancial Services on January 27, 2015 to inform them that payment could be taken.  Payment was processed on January 28, 2015.Thank you for your assistance in this matter.[redacted]

A return call was made on 10/28/14 to ###-###-#### asking they stop harrassing me. At this point, the "Collections" person, who did not give a name, insisted I was the person who pretended to be [redacted] in September when they first started calling. Will contact Verizon for additional calls and dates of those calls. Since the number above is the number listed on their website, they DID call me and behave rudely. I do not have to provide personal information to unsolicited callers and have never had an account with this company nor dealt with this company in the past. Dr. [redacted]

Only lies to keep their A+ rating with the Revdex.comClick the links below to  find what they are REALLY all about.[redacted]There are thousands more sites just like the one's above complaining of Monterey's fraud & poor business tactics.Don't let this company fool such a reputable company such as the Revdex.com as they apparently have been all along to fraud their A+ rating with you.I don't know anything about any e signature or whatever they are claiming I signed.As I said I am willing to pay $599.00 at a competitive  interest rate but I'm not renting my puppy so I'm NOT paying rental fee's...ie: $599.00 become $1460.00 in Montereys fraudulent world.I intend to file a civil suit if this matter is not resolved.

[redacted] account was placed with Monterey Financial Services to act as the 3rd party servicer on 07/25/2007. The amount booked into our office was $10967.56, with an interest rate of 14%. [redacted] agreed to 96 payments of $190.52. In January 2008 [redacted] started paying late and missed several contractual payments January 2011. On 11/09/2010 they expressed to our representative that they were experiencing serious financial hardship, their income was reduced and they just loss their house due to a foreclosure.  In February 2011 [redacted] contacted our client Resource Marketing Group expressing they were no longer able to afford the month payment and our client agreed to lower their monthly payment from $190.52 to $95.26 until their financial situation changed so they did not lose what they had already  invested into the contract. Since this amount was significantly below the originally agreed payment amount the term of the contract was extended accordingly.
The interest rate of 14% has not changed from their original agreement and they are certainly not being charged 100% in interest as they claim. [redacted] agreed to the lowered payment  amount to continue with the services outlined in their contract knowing the impact this would have on the term of the loan
[redacted] still have a remaining balance due on their contract for the amount of $7435.90. It would be in [redacted] best interest to increase their monthly payments to at minimum what they contractually agreed to from the beginning of their loan which was $190.52. The next payment is due on 02/20 for $95.26. As stated in the complaint the automatic payment has been stopped so [redacted] will need either reactive the automatic payment with our office, mail in future payments or call and schedule payments over the phone with a representative or on our website. Failure to make future payments on time could result in contractual late fees being applied to their account in addition to potential negative credit reporting.

As the Collections Manager states in his response, I am not responsible for the balance pending on the account, yet, they continue to attempt collection from me; he admits this in his response as well,  the situation regarding [redacted], the responsible party, has been explained to them multiple times, again the Collections Manager admits knowledge of this.  This is only one issue, the other, more important issue, is the fact that due to their "hold" on the account with [redacted], they are attempting to prevent [redacted], a minor (who is obviously not responsible for the account) access to medical supplies and upgraded medical equipment for a life threatening disease.

I have reviewed the response made by Monterey Finacial Services in reference to complaint ID [redacted]. Some details of our 01/13/15 conversation were left out of Monterey Financial Service's official response and other details of our 11/19/15 conversation that could have been disclosed to me during the 01/13/15 conversation were not disclosed at that time. Also, it shold be noted that I made the 01/09/15 payment on my own accord because the bank account that the 01/16/15 payment was scheduled to come out of was closed.
In other words, I was being responsible to pay my debt to Monterey Financial Services, and even a day ahead of schedule (according to Montery's own records). However, I find that this resolution would be satisfactory to me, as all I wanted was the $15.00 fee returned to my account, and Monterey Financial Services is stating that they will do just that.  I will wait for Monterey Financial Services to perform this action and, if they do, will consider this complaint resolved.

In response to the complaint received:
[redacted] entered into a contract with [redacted] for the
purchase at [redacted] on 6-28-14 (copy of contract attached). The
contract does contain a 90 Days Same as Cash Option, where the expiration of
this option is very...

clearly outlined as expiring on 9-26-14. [redacted] has
made her contractual monthly payment of $116.92 as outlined in the agreement,
but did not fulfil the terms of the Same as Cash Option. [redacted] did not
attempt to reach Monterey regarding a payoff until after the 90 Day expiration
date of 9-26-14, outlined in the contract.
[redacted] would benefit from reviewing the “Prepayment” clause
in the attached contract that she agreed to, which outlines the $37.50 service
charge with prepayment, as well as the rebate computation (Rule of 78).
 It also
very clearly outlines the interest rate on the loan. At this point, since [redacted]
did not fulfill the terms of the 90 Days Same as Cash Option, and she is
obligated to pay the remaining balance per the terms of the contract. With her
recent payment on 10-1-14 of $116.92, [redacted] is able to still take
advantage of an early payoff of $728.81 if paid by 10-27-14. This will save her
$360.97 in interest.
I urge [redacted] to contact our office toll-free at [redacted] to make the necessary arrangements to satisfy her obligation to
the loan.

They haven't corrected the account online. It shows a past due balance of $195.

On 01/18/15 [redacted] signed a consumer pet lease agreement for the financing of a pet at [redacted]. Her account was placed with Monterey Financial Services on 01/20/15 to act as a 3rd party servicer throughout the term of her lease. I have attached a copy of the lease agreement for...

The terms and conditions of the lease were agreed to by [redacted] as indicated by her signature on page 4 and initials on pages 2 and 3. All of the charges [redacted] references in her complaint are clearly outlined in the lease agreement. Including but not limited to specifically being outlined in section 8. Located on the page labelled Authorization Agreement for Prearranged Payments for [redacted], LLC [redacted] was given the option to sign up for automatic withdrawal or mail her payments. Based on the documentation provided and the options given I am unsure how [redacted] felt she was forced to be on automatic payments.
To the best of our knowledge the pet was purchased from [redacted], while in good health. [redacted] is welcome to discuss any health concerns regarding the pet with the pet store or [redacted] directly.
“Unfortunately we will not be able to accommodate [redacted] desired settlement as the terms and conditions were clearly outlined and agreed to in the attached lease agreement.. [redacted] contacted our office on 02/09/15 requesting an early purchase amount to pay in full her lease agreement. She was quoted the amount of $785.84 which was only good through 02/19/15. Since then her early purchase amount has increased to $873.30 due to February’s due date elapsing. Monterey Financial is still willing to honor amount quoted on 02/09 of $785.84, if the amount is paid in full by 03/06/15.
As of today the account is past due for $87.46 for Ferbaury 20, 2015 lease payment. If [redacted] does not take advantage of our above offer and the February payment remains unpaid the account could be reported the credit bureaus as past due in addition to late fees being applied to her account. I encourage [redacted] to contact our office immediately to pay in full her lease agreement before any rent fees apply to her balance.

full term of the lease that [redacted] entered into. Since [redacted] satisfied her early buyout obligation, this remaining balance will be closed, and reflect a $0 balance by the end of this month. A paid in full letter has been sent in the interim.
