Yellow Scene sells a number of different products for our print publications, website, and other mediaThese products are typically sold bundled together in various waysAdditionally, negotiation is common practice in our industry with clients frequently negotiating priceIn this case no agreement was reached as to price of any product or bundle of products, nor was any money exchangedObviously, there was misunderstanding as to how some of this pricing workedAgain, no agreement of any kind was reached and no money was exchanged

Yellow Scene Magazine has unfortunately as of late been delayed to press dates, sometimes up to the end of the monthThe month in question where a magazine was delivered through priority mail in a white envelope was due to a major delay in the free shipping service provided to mailing routesIn order to ensure that the magazine was delivered this month to this individual we had opted to mail the magazine ourselves (at a severe loss) in order to meet the demands of this subscriberSubscriptions make a very small portion of our mailing for each issue, but they do all get packaged and mailed one way or another.It has truly been unfortunate that some of these distribution dates were delayed and due in no small part to a lack of long-term employee filling the role of the Distribution Manager at this timeI will personally reach out to this subscriber and offer him a refund as is his requestIf there are any additional questions or concerns, please do follow up and I will be happy to oblige.While I did not personally speak to this individual, I was made aware of a few instances where complaints were being relayed but what was not known to me was their connectivity.Evan W [redacted] Operations ManagerYellow Scene Magazine

YS Magazine is unable to remove Ms [redacted] from our mailing as we utilize the Post Offices Saturation mail systemWe do not have addresses on our mailings, but rather a Postal Patron imprintWe pay to have every house on the route deliveredThe Post Office has told us to inform any person receiving the magazine that does not wish to, to simply put a notecard in the mailbox for the mailmanAny resident can do this with any form of direct mail they get including their Wednesday shoppersWe regret Ms [redacted] does not wish to receive the magazine as we usually only get calls from folks to be addedHowever, we would recommend trying the notecard in the mailboxThank you for understanding this is outside of our scope

I personally received an email from Evan W***, 6/1/2015, explaining events that have impacted the effectiveness of Yellow Scene Magazine publication and distribution. I accept MrW***'s offer for the refund I requested in the amount of $11.99, which he indicated would be mailed out to me 6/1/2015. His offer to continue my subscription at no cost is appreciated. But, I will not take advantage of this offer because the cost of mailing my issue to me has averaged $each mailing. This was paid on the only issues I did receive. Please remove my name from Yellow Scene's subscription mailing list. The issues I did receive I enjoyed as well as my youngest daughter.Thank you.*** *** ***

I am rejecting this response because:
The bottom line is I have always required my permission for my credit card to be processed, and Yellow Scene did not have my authorization to process credit card paymentShavonne attached a copy of that credit card form showing that Yellow Scene must get my authorization before processing paymentI did have a discussion with Shavonne that I was interested in placing an ad as it got closer to the time for my new facility to open with the rendering of my new facilityI would not agree to run an ad with multiple mistakes and told her that I did not agree to run an "old ad" because I didn't send the renderings in time for it to go to pressI told her that if I don't agree to an ad or get the information to Yellow Scene in time before they are going to press, the ad doesn't runA business(Yellow Scene) cannot make an assumption that if they do not hear from the client, that the client is somehow giving permission for the business(Yellow Scene) to do whatever they chooseI noted on several occasions that I did not want an ad run, and even after I sent e-mails not to run an ad, Shavonne said she was going to run the ad anyway

This is absolutely incorrectThis client has a legal contract that was conducted via emailShe has written confirmation of this contractShe has an authorized payment form filled outWe have reached out to this client numerous times to resolve her desire to cancel her contract and her only
response is to ignore usThis is not harrassment it is an attempt to collect on her contractWe can provide all the legal documentation to prove this client has a contract, authorized the contract as well as paymentWe are afraid we are going to have to take this client to small claims court if she refuses to speak with usI have attached the key documents but have about that we can provide

Yellow Scene Magazine negotiated an extensive discount on advertising to help the customer promote a new locationA payment plan was offered to further assist the customer, but the customer opted to pay by credit cardAd space was reserved in Yellow Scene Magazine at the customer's request and per
an electronic agreement between the customer and Yellow Scene MagazineDocuments attached verify this claimThe ad ran in the magazine and a credit card was charged based upon the authority of a credit authorization form that was signed by the customer and returned to Yellow Scene MagazineAttached is a redacted copy of that form-- the customer's credit card number has been removed
The primary issue appears to be that the customer, though well aware of our press date, attempted to change the ad after the magazine had gone to pressStopping the presses is expensive and causes delays that harm both Yellow Scene Magazine and our clientsAs a courtesy, Yellow Scene Magazine has offered to run a second ad in an upcoming issue at no additional charge, though we do not believe that we are obligated to do so
Looking at all documents and emails provided it is obvious that this customer was aware of our deadline and authorized the placement of the ad, and the chargeWe believe this to be an attempt to avoid payment of that obligation by disputing the approval of the ad

The customer's account of events is inaccurateThe attached document, and previously attached documents, demonstrate the actual sequence of eventsWe are happy to provide any additional documentation necessary

This company will not leave my business alone, I've asked, begged, threatened and am now going to have to hire a lawyer to get them to STOP calling, stop dropping by and just leave us alone

I am rejecting this response because: The email attached was never replied to - it says that you are automatically signing me up for 13 ads.  I did not receive that email, nor did I ever actually agree to the 13 ads.
If you think that it is legally binding to send me an email saying I agree to the ads, even though I didn't, then I will let this go.  The email also says that I can run the ads at any time, so I will stop running them for now, and if I am required to, I will run an ad again in the future.  Thank you.

Actually this is incorrect. Ms [redacted] responded with both proof changes as well as a credit card authorization form. Additionally, following these emails she sent an email to Mary confirming sizes for each issue. All have been provided to Ms [redacted] numerous times via email as well as here.
