While you may have discussed another advertising program that included $fixed monthly costs with your sales representative, ultimately the advertising agreement you agreed to was for $monthly fixed costs (which went towards your enhanced profile and featured video) plus up to $monthly variable costs (which went to your Cost Per Click ads)We have attached a copy of your advertising agreement for your records.With regards to your concern with the variable price per click, as noted in your contract, your advertising package included a Cost-Per-Click (CPC) auction-based auto-bidding program, which means that you agreed to allow Yelp to set the bid price per click to keep you competitive in the marketIt's important to keep in mind that the price will fluctuate up or down depending on competition, relevance, and other factorsHowever, it will always be the lowest price possible to win the clickAdditionally, please note that we aim to maximize the number of clicks you get for your budget over the course of the month.You also expressed concern that you saw "no increase in traffic" to your businessWhile it is our hope that advertisers will find success via the Yelp advertising program, we want to reiterate that results are not guaranteed.Additionally, we want to address your comment, "Yelp repeatedly attempted to reject my request to cancel my campaign by calling my business daily to stagnant and prolong the process while continuing to charge me for advertising." Complaint: [redacted] I am rejecting this response because: If it is a requirement to be a "customer" in order to submit and retain a review on your site then you'll need to define customer The actual definition is someone who receives goods or servicesSo if you look at it from this standpoint then Yelp would be obligated to remove any and all reviews where a purchase of some kind did not take place, correct? And I can tell you from personal experience that you do not do this because my business has asked for a few over the years to be removed from non-customers and Yelp refused to do so because it was their review of an experience, not necessarily a purchase; but now you say otherwise Or if you'd like to look at it as me receiving a service since I did experience a very poor customer service situation to which evolved my decision to never contact this company in the future I think that my opinion should be allowed to be voiced which is the entire basis of Yelp to begin with You do not have to be an actual customer to submit a reviewThere are thousands still posted where the person didn't purchase anything So unless you are removing all of them then you cannot discriminate against mineSincerely, [redacted]

Well not on Yelp apparently It is very interesting that only the people who have something bad to say get to have free speech on your site, while those who had the audacity to write something good about my business are blatantly accused of being liars and you are saying your system is unbiased when that is obviously not the caseIt just would not be statistically possible that your “system” is unbiased- since only bad reviews of my business are displayed and zero good ones- statistically very unlikely for a professional that has been in business for yearsReviews are from my patients who have a right to be heard Apart from the fact that your “recommendation software” is blatantly and indisputably biased, the fact that you only show negative reviews about me actually contributes to further bias, because the rare patient that wants to write something negative about me is more likely to write it on Yelp than anywhere else on the internet because that is the only place where there are only negative reviews and no positive ones shown, so they will increase the effect of their negative comments by writing a review on your site rather than anotherIf Yelp wasn't biased in this way those negative reviews would likely be more evenly distributed in other areas of the internetThis contributes to a bias that harms my business further Therefore your explanation of your “review software” makes absolutely no sense and is completely faulty and should not be allowed Please show all my reviews in the recommended section as they should be [redacted] Sincerely, [redacted] ***

As indicated in our prior response, the recommendation software is automated to help avoid the potential for human bias inherent in individual decision-making: we cannot reverse the software's decisions, either to suppress an active review or to restore one that isn't recommendedBut once again, the system is not static reviews may come and go as the recommendation software picks up new informationIt's also important to keep in mind that even if a review isn't currently recommended, users can still find it at the bottom of the Yelp listing or on the user's profile page We do understand the recommendation software can be frustrating at times, and your feedback is appreciatedWhen it comes down to it, all review sites face the same challenge: how to identify fake reviews among the many millions of legitimate reviewsIt's no easy task, and there is always room for improvementWe hope to be able to continually improve on this issue Regards, [redacted] Yelp Inc

Complaint: [redacted] I am rejecting this response because: Lies should not be able to pass as opinionsOne of the reviewers was angry because we sent him a proposal that was more than he wanted to payHe was demanding to be compensated for having had to wait for the proposal and if we would not pay his demand, he would see us in courtWe withdrew the proposal in a very civil and respectful manner - and within hours, he's telling the world that we are trying to keep him from finishing his projectThat is just one exampleAnother reviewer stated that we charged her for our time to procure a paint match, which we did not, and I can show you the email with the invoice that states we did not charge for either our time or the paintBut this lie is allowed to standAt the award ceremony where we received the Revdex.com's Torch Award for Marketplace Trust in ***, the keynote was about business ethicsThe speaker talked about how a guest at a botanic garden, incensed because schoolchildren were allowed in the venue, suggested the CEO's head should be chopped up and used for mulch! Our society encourages people today to feel entitled: to what they want, when they want it, at the price they want it; and empowered: to make your life miserable if they don't get what they wantYelp is contributing to this by allowing opinion to pass as fact, and, in the words of [redacted] , to give the appearance of solidity to pure windIt used to be, if someone wanted to spread slander wider than his own circle, he had to pay to take out an ad in the newspaper -- and laws against slander prevented suchNow any hothead with a data plan can spew venom in an attempt to ruin businessesAnd there is no recourseSincerely, [redacted]
