Hi ***,
Thank you for writingWe are glad to have this opportunity to address your concerns regarding your business page for ***'s Hairstyling
You also expressed concern that "yelp took reviews off, altered business info" We have
systems in place to keep our data accurate and timely but from time to time, errors can occurWe've gone ahead and updated your business name to ***'s Hairstyling and have ensured that the address is the one you've provided to usWe apologize for the inconvenience
Should you have any more issues with your Business Owner Account, feel free to visit our Support Center here: http://www.yelp-support.com/Yelp_for_Business_Owners?l=en_US
Secondly, we want to clarify that a business's decision whether or not to advertise on Yelp does not affect how the reviews on its listing are treatedBusinesses are not punished if they don't advertise, nor are businesses awarded with preferential treatment with regards to their reviews if they do advertiseFurthermore, there is zero relationship between the timing of when a review gets recommended and when a business decides to - or declines to - advertise: reviews can be recommended or not recommended days, weeks, or even months after they were first posted, and your Yelp sales representative doesn't have any influence over when that might happenWe understand there are some misconceptions about this, so we invite you to visit http://www.yelp.com/advertiser_faq and http://officialblog.yelp.com/2013/05/no-yelp-doesnt-extort-small-businesses-see-... to learn more
As you may have read, the goal of Yelp's recommendation software is to showcase more reliable contentThe recommendation software establishes an objective standard against which every review can be measuredEven though it inevitably affects legitimate reviews from time to time and misses some fake ones, too, it helps protect the integrity of the site both for consumers (who will be less likely to be led astray by bogus reviews) and business owners (who will spend less time worrying about whether their competitors are writing negative reviews about them)
It's important to note that the software applies the same analysis to everyone, and that it affects both positive and negative reviewsPlease also understand that the recommendation software is automated: we cannot manually override the software to recommend or not recommend a reviewHowever, the system is not static reviews may become recommended or not recommended over time as the system continues to make decisions based on a variety of factors

Thank for emailing our office on a Friday? Since Yelp maintains it will continue to post defamatory statements about of law office despite being presented facts proving the person was claiming our office provided him services, i.e., trial, which our office never conducted, Yelp has forced our office to seek a removal order seeking a judicial determination that defamatory statements had, in fact, been made by such third party on Yelp’s Web siteNothing section restricts a court from directing an Internet service provider to comply with a judgment which enjoins the originator of defamatory statements posted on the service provider’s Web site

The alleged leads and advertising generated by Yelp did not translate into increased salesIf our sales were skyrocketing due to Yelp, we would not be filing complaintsWe track all our customers to see where they found usOut of all the campaigns we have started, Yelp has been by far the worst performer
In addition to terrible ROI results, Yelp has the audacity to require additional monthly fees, and other charges to cancelI was unable to decrease the monthly capDue to these unsatisfactory results, any Yelp charges going forward will be declinedI would also request a refund on the charges already paid

Thanks for your cooperation in this matter and for certainly understanding all thats involved in my situation
Final Business Response /* (4000, 9, 2015/08/18) */
Hi ***,
Thank you for your response
You have again stated that the review by *** O "is a lie" and should be removedHowever, we don't take sides on factual disputes, so we can only therefore reiterate what we previously communicated to you: if a review appears to reflect the user's personal experience and opinions, we allow the user to stand behind their review
You also wrote, "why is her review up and is a lie and the other real reviews hidden." Please note we don't go into detail as to why a review is or is not recommendedWe intentionally make the recommendation software difficult to reverse engineer otherwise, we would be overrun by reviews written by people hoping to game the systemSo while it may be tough to decipher how the recommendation software works, the rules are actually the same for every business and every review
As indicated in our prior response, the recommendation software is automated to help avoid the potential for human bias inherent in individual decision-making: we cannot reverse the software's decisions, either to suppress an active review or to restore one that isn't recommendedBut once again, the system is not static reviews may come and go as the recommendation software picks up new information
We do understand the recommendation software can be frustrating at times, and your feedback is appreciatedWhen it comes down to it, all review sites face the same challenge: how to identify fake reviews among the many millions of legitimate reviewsIt's no easy task, and there is always room for improvementWe hope to be able to continually improve on this issue

Initial Consumer Rebuttal /* (3000, 7, 2015/08/27) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I explained in my original text to the Revdex.com (that you/Yelp had seen) why I do not want to further engage this woman; she was hostile during the consult with is what prompted me to suggest she find another contractorSuggesting I engage a seemingly unstable individual with a proven history of spreading lies and libelous statements would only entice her to attack me or my business
Yelp is stating that "Rather, if a review appears to reflect the personal experience and opinions of the reviewer, it is our policy to allow the user to stand by his/her review." which is fair, in SOME circumstances however, her review states she was left 'holding the bag' so to speak; and she wasn'tShe did NOT commission *** for workPeriodShe is NOT a customer and her review contains libelous LIESSHE WAS NEVER A CUSTOMER AND HER REVIEW CONTAINS SUGGESTIVE TEXT THAT SHE HAD ACTUALLY COMMISSIONED RD CONSTRUCTION SHE DID NOT, AND I AM REQUESTING YELP REQUEST PROOF OF THIS FROM HER
1) "gave me a bid on concrete work in early June with a promise"
- She was NOT given a promise, nor a bidShe had an initial proposal, to which, she crossed out warranty and payment terms; thereby nullifying the proposal
2) "that the work would be completed by July or sooner."
- Another lieHer initial proposal was in MarchShe didn't follow up to the proposal until summer, at which point she was told there is no guarantee, but because we are at peak season; however, we are doing work nearby we can TRY to get to hers, pending early completion of the other jobsSHE WAS TOLD THIS WAS NOT A GUARANTEE in plain English
3) "The end of August he told me he was busy with bigger jobs and was dropping mine"
- This is an outright lieHer proposal was deemed invalid by her crossing out legalities on the proposal and issuing unrealistic demands; stated "I am not giving you a downpayment because I don't trust you'll come back and do the work." - At which point she was told "Since you don't trust me, you would be better off finding another contractor." And that was the end of the proposal meetingShe was NEVER left with an assumption, date, guarantee or anything any reasonable individual could misinterpret as an agreement
4) The end of her "review" is plain and simple character assassination, absolutely untrue and libelous

Hi ***,
Thank you for writingWe appreciate you bringing your concerns regarding your advertising program for Milestone Window Cleaning to our attentionWe'll be sure to forward your note along to the appropriate parties
We are
sorry to hear you were not satisfied with your advertising campaignWhile it is our hope that advertisers will find success via the Yelp advertising program, we want to be clear that results are not guaranteedWhen advertising with a Cost-Per-Click (CPC) program, you are electing to pay every time a user clicks on your ad impression
You also expressed concern that your advertising program has not yet been terminatedAs noted in the advertising agreement you signed, you must provide written notification to your account manager on or before the 15th of the month in order to to terminate advertising at the end of that monthIf you provide written notice after the 15th of the month, then the advertising program will terminate at the end of the following monthYou notified our account management team on June 25, that you wanted to cancel, so your advertising program is set to terminate as of July 31, As you may recall from the email you received from*** on July 7, you will see a final charge on August 1, because your advertising program is billed in arrearsAs advertising services are being delivered in accordance with your contract, we will not be able to offer you a refund; however, the early termination fee of $has been waived
You also expressed concern with the recommendation software, stating, "The one genuine, positive review from my client was 'filtered' and not even shown." (The consumer indicated he/she DID NOT accept the response from the business.)
I'm aware of what I signed, but verbally, I was promised much, I was misleadI was under the impression that I was paying $a month in order to get new clients as Yelp told me I wouldOne of their employees even told me that I would probably have to hire helpers in order to handle all the new business I would receiveWhy would I pay all that money just for "clicks"?
Final Business Response /* (4000, 9, 2015/08/04) */
Hi ***,
Thanks for writing backYou wrote, "Why would I pay all that money just for 'clicks'?" What the Cost-Per-Click program delivers is targeted ad impressions, and you only pay when a user clicks on your adIt seems reasonable to assume that an individual clicking on an ad for your business is interested in learning more about your businessUltimately, we cannot guarantee that an ad click will result in a new customer, but that the goal of advertising on Yelp is to increase the awareness and exposure of your businessThanks for understanding

Hi ***, Thank you for writingWe are glad to have this opportunity to address your concerns regarding your advertising program for *** ***.We appreciate your feedback, and have forwarded your message to the appropriate partiesIt looks like an account manager, ***, reached out to you to explain
that your advertising program was billed in arrears, so the charge of $you saw on March 1, was for advertising services d***vered from February - 6, Additionally, as you may recall, we are refunding you for the early termination feeWe also want to address your comment, "They initially told my I only pay $a month and additional clickBut I had about click to my page and they charged my $a month." To clarify, you signed up for an advertising program with $monthly fixed costs plus up to $monthly variable costs, for a monthly maximum of $The monthly fixed costs were for the call tracking feature and your enhanced profile, which included features such as competitor ad removal and a photo slideshowYour advertising package also included a cost per click (CPC) program and your monthly cost per click budget cap was set at $475, which means you were only charged when someone clicked on your ad and you agreed to pay up to $a month for those ad clicksIf you did not reach your monthly budget cap, you would only be charged for the ad clicks you receivedHowever, if you did reach your monthly budget cap, we no longer d***vered ads for your business for the remainder of the month so that you wouldn't have to pay more than you agreed to.According to our records, you received ad clicks in November 2015, in December 2015, in January 2016, and in February You can view a breakdown the number of ad clicks you received by logging in to your Yelp for Business Owners Account at *** and clicking on the "Yelp Ads" tab.We hope you will continue to take advantage of the free features available to you on your business account to engage with the Yelp communityFor guidance, please visit ***Regards,***Yelp Inc

Please be sure to indicate that it is in regards to Revdex.com case #***.Additionally, please note that per the terms of the advertising agreement you signed, we require days written notice to your account management contact if you wish to terminate your advertising program, and early termination is typically subject to a feeFor example, if you had submitted a written cancellation request to the account management team on September 7, then your advertising program would have been terminated on October We also want to reiterate that the early termination fee of $was waived, and you were not charged for the advertising services you received in October. You also wrote, "I had informed him yelp stated people had called my business in which I had no record on my end of it occurring."
