[redacted] Inchired Dave M [redacted] (owner) of Yes Electric Inc [redacted] as our contractor for electrical work at [redacted] We hired Dave back in November Dave meet me ( [redacted] ) at the building, and we did a total walk threw,and I showed Dave everything that needed to be doneI asked Dave if he was licensed and bonded in the city of Cleveland because we needed everything up to code in the city of ClevelandDave from Yes Electric told me that everything would be handled properly and the work will be done according to city codesHe also assured me all permits would be filedYes electric started doing work in the building Dave and his employeesThey started doing work the middle of NovemberDave was paid cheeks see attachedDue to Dave's respond to the air conditioner, his employee ripped the old one out, and the new one that was put in did not reach the outlet, so it was way to shortI feel Dave owes us money back for the supplies he ordered and is sitting in the corner of the garageDave did not pull any permits till February 21, 2016, when he found out that one of his workers called us to let us no that Dave never pulled any permitsWe called the city to report himThen all of a sudden Dave came out with a City inspector named [redacted] to check the electrical work on February 22, Dave failed to tell City Inspector [redacted] that he did all the workSee attached violations that [redacted] game to my dispatcherAlso see attached the pictures of the electrical work done by Dave from Yes Electrical Thank you, [redacted] * [redacted] Final Business Response / [redacted] (4000, 12, 2016/03/17) */ Thank you for the opportunity to rebuttal thisTo save you time, we will try to stick strictly to the facts1st for verification, we would like to give you the City of Cleveland's electrical inspector, [redacted] numberIt is [redacted] He is very well familiar with the case and also the behavior of Mr [redacted] The 2nd person is the Fire MarshallLieutenant [redacted] His number is [redacted] He is very familiar with the gas tanks that Mr [redacted] illegally installed and Liet [redacted] was a key figure in having these removed because they are absolutely illegal to have in the city of Cleveland--with no exceptionTo address, again, what happenedWe met Mr [redacted] and agreed to make repairs in the building which consisted of some lights in the parking garage and electrical outlets and lights into their dispatch office, which was illegally built also by Mr [redacted] There were and still are, no blueprints and no permits for thisMr [redacted] first concern when we started was to wire above ground gas tanksMy employee, Steve Nand myself specifically asked him and even suggested we pull a permit for at least this part of the job, as to the wiring is done in explosion proof wiring and has intricate parts of making sure it is shut down for safetyhe insisted no permit be pulled due to all the hazards and violations in the buildingHe agreed we would fix this as we went under time and materials and no permit pulled, but to complete this portion (T&M) under the category "repairs." He paid us checks covering the labor and materials up until the last invoice (see upload) which was presented to him AFTER the gas tanks were installed, wired and functionalWe gave him a final invoice on 1/27/(see upload)Between 1/28/and 2/28/I have text messages (saved and screenshot) where I was very politely and patiently asking him for payment for my services and my employees services (and materials)At one point, around mid February Mr [redacted] called me very upset for ringing his phone twice in one dayHe stated that the air conditioning cord that was unhooked by HIS CARPENTER , to add another cord long enough to reach the plug was not yet complete and he would pay me when the cord was installedMind you, HIS CARPENTER TOOK IT OFF AND did not know how to hook up the new oneSo, I assured him (not that it was my problem) that I would go take care of it (because I felt now I would get paid according to his word)The next episode was on 2/he called me screaming about ringing his phone more than once looking for paymentHe told me "I'm not allowed to talk until he's done because he's the customer." He told me he was reporting me to the city because I did not pull a permit (mind you he said this knowing full well he had no building permit and no permit for those large tanks)Confident my work would pass, I went shortly after and got my permit (see upload 2/16/permit)The inspector met me at the job on 2/22/to perform his inspection on the work covered under my permitEverything was closely inspected due to the problem we're having, even the wires in the pipe for future car wash were sized and calculated for future load and were MORE than adequate per InspectorThe inspector had NO CHOICE but to write up violations due to dangerous safety hazards he witnessed in the building (such as the above ground tanks)A day or two later, Mr [redacted] showed up at the building department, he told them that all these violations were on our contract to be repaired and that he already paid me for them and that I never came back to complete themPoint #How could he have paid me for them when they didn't even exist until the day before(see uploads)Point #I can not get him to pay me for the work he agreed I completed , let alone would he ever pay me $in ADVANCE with that work not being completedThat seems to be a common sense situationAll of us here know Mr [redacted] is trying to get out from paying our electriciansTo sum it up, He pulled NO PERMITS for anything he did: meaning, no building permit for when he built the dispatch room or for him installing the large gas tanks (which are illegal in the city)He has no applications pending for the tanks or the dispatch office until AFTER he got caught (see dates of his permits uploaded) the fire department and had to have them removedAfter being caught, at that point, he went down to file for a variance (see upload application)The next point, he claims he paid me $up front for violations to be repaired that didn't exist until long after the last check he wrote meThe proof of all the dates on these facts should be sufficient proof to prove my case and close this outIf you need any further documents or copies of our talks via texting back and forth with Mr [redacted] we would be glad to provide themIn my opinion, his attempt to threaten me with not pulling a permit backfired on himWe are going to lien his building, but as I stated in one of my text messages to Mr [redacted] , I am not going to sue him because I am a firm believer in not trading evil, for evilHowever, with the lien on the building, maybe one day if he sells it, we will be compensated for both our labor and materials that we invoiced in JanuaryAs I stated in my last text message to Mr [redacted] , I am sorry for him as a person to lower himself to such measuresI did wish him the best in his new venture and more than that , I hope that he can find some peace and happiness in life that he obviously doesn't have at this time
