Thank you for contacting the Arkansas Attorney General Consumer Information Name Bridgette MH [redacted] Company Complained Against Information Company Name Yes Mototrs [redacted] Transaction Information Product or Service Acura MDX Date of Transaction 3/11/ Estimate of dollars involved $ Please explain the circumstances surrounding your complaint On 3/10/16, my wife and I, Bridgette, stopped by to look at a Mercedes Ehe had for saleInstead we opted to look at the Acura MDX that was for saleJerry Gis the owner and Brandon Jis his GMThe battery was dead and it was need of brakes after we test drove itJerry agreed to replace the brakes and replace the old battery with a new oneJerry told us what it took to hold the vehicle and we agreed to return on the 11th with $2,to pull the vehicle from the front and reserve it for us if the deal went throughJerry didn't broker the deal, but he was very excited to receive the $in cash and write a receiptThere was never any mention of a no return policy on the down if we decided not to purchase the vehicle for any reason, nor was there any documentation that we signed to agree to that factHad it been the case, we would've gone through with the deal; he left the deal in the hands of Brandon, and it all went downhill from there...tragically My wife had a bankruptcy filed and was a year in, they were told of this and needed her attorney to file a motion to purchase the vehicleWe had her attorney on the phone discussing the details with BrandonOn 3/24/16, a Thursday,mind you, we did all of the foot work to get the documentation to Brandon and he not once call the attorney, checked his email when we sent information or her attorney had sent information, we had to call him back and drive to the car lot to ensure he received it We returned directly after my wife picked me up from work on 3/24/16, a Friday, to talk with BrandonAs he commenced to fill out the app on his computer, he inquired if my wife had a checking account, she in turn said no, but I replied that I had oneBrandon then replied, well that will set the deal back $1,and you will need to come up with another $Immediately we told him we didn't have anymore money and was going to call off the deal and ask for our money back since we did have a receipt signed by the owner, and it was the owner's vehicle we were attempting to buy; Brandon then replied, "I have another way to make this work." We remembered while we were in the office prior to this that he was on the phone talking to a customer who didn't have a checking account and he told him the same thing as he was receiving his three pay stubs via fax So my wife told him that her check is directly deposited on her check card through PCSSDHe then allowed us to use his PC to pull up her account and print it offSince it didn't show her name or the banking institution making the deposit, he then asked for two check stubs and two documents of proof of residenceShe said that she could produce itBrandon said, "Well the hard part is over now." "Once you bring that in tomorrow, which would be Friday, you'll be ready to do the paperwork and take it home." I asked about him honoring the agreement to replace the dead battery and the brakes per Jerry G., he said that he would honor it without a problem Friday, 3/25/13, we both returned to Yes Motors to give Brandon the documentation and my wife had texted and called me because the vehicle hadn't moved since the day we gave the moneyWe gave Brandon the documentation, and he said everything was good and then asked for $My wife told him that we didn't have the money, then he interrupted her by talking about the checking account and the $set backThen I told him off what he told us of he would, "make it work." He then replied, "I assumed you would bring it." I replied, "If it had been clarified yesterday, we would've demanded our refund then"There's no assumption when it comes to business of this kind." Then I told him of how my wife passed by this lot four times and the Acura had never been moved." Brandon replied, "We have a battery in the back." I replied, "It isn't in the vehicle of purchase." I told him that the brakes weren't even done, you didn't even honor that either." He said that the mechanic was in the back as well to get that done today I then replied,"Today?" "It was supposed to had been done early this morning as you promised us, and it's still parked back there in the same spot and not ready for delivery." It was not mechanically sound to even move

On 3/10/16, my wife and I, Bridgette, stopped by to look at a Mercedes E350 he had for sale. Instead we opted to look at the 2009 Acura MDX that was for sale. Jerry G. is the owner and Brandon J. is his GM. The battery was dead and it was need of brakes after we test drove it. Jerry agreed to replace the brakes and replace the old battery with a new one. Jerry told us what it took to hold the vehicle and we agreed to return on the 11th with $2,500 to pull the vehicle from the front and reserve it for us if the deal went through. Jerry didn't broker the deal, but he was very excited to receive the $2500 in cash and write a receipt. There was never any mention of a no return policy on the down if we decided not to purchase the vehicle for any reason, nor was there any documentation that we signed to agree to that fact. Had it been the case, we would've gone through with the deal; he left the deal in the hands of Brandon, and it all went downhill from there...tragically.
