Yoder's reply to original complaint. Response was delayed by request to bank
for enclosed copy of check issued to Yoder Landscape Inc., May 8, 2013 for
$692.25 for five arborvitae. If original is no longer valid, please open new
complaint as his response for return of my money with a check for $140 is not
acceptable.

Yoder does not recall all facts discussed with us as he deals with many people,
but my wife and I do remember the facts as outlined originally and as follows:
[redacted] stated he
had to order shade thriving shrubs as his stock were a full sun variety; He
charged us cost of shrubs and for planting, cost quoted was $140 each, not his
cost with no guarantee. A transaction like that would also not be good business
practice on his part; Arborvitae were cared for per his instruction;
Shrubs were be
guaranteed for one year;
No mention was
made about soil being bad until he was contacted by neighbor about a dead shrub
last year. That replaced shrub was dead by the end of summer.
As noted, he said
had to order a special shade variety, and unless he misrepresented himself
again, his records should reflect the purchase of the special variety.
Per enclosed copy of photos accompanying original correspondence to The
Revdex.com and enclosed again, three of the eight shrubs were dead
and three were dying. Interestingly, two Arborvitae purchased at [redacted] and
planted by our neighbor are bright green and thriving (as noted on photocopy
enclosed). These are intermingled with those planted by [redacted] and are in the
shade.
Referencing copy
of check written to Yoder Landscaping, [redacted] was paid $692.25 (what he said was
owed after finishing job) for five shrubs. By deducting $140, [redacted] Yoder seems
to feel that a profit of $552.25 should be acceptable. Furthermore, at a cost of
$140 each, he made another $420 from our neighbor for three dead and dying
shrubs. More than $950 over and above his claim to refunded my money with only
$140 for an unacceptable result. It never occurred to me to mention to the
neighbor about contacting the Revdex.com, but I will certainly provide her with copies
of our correspondence.
Per [redacted] Yoder's
statement that he was reimbursing my money, he has again not honored his verbal
and written (per response to Revdex.com) word. Again, solution of less than full
restitution of $692.25 is unacceptable.
