Review: In November, I initially signed up for a yoga teacher training program with YogaOne San Diego that would begin in 1/17/14. They initially wanted the full price of approximately $2550 for 8 weeks instruction, but agreed for me to pay in 3 installments of $883 as I had explained (verbally and also in writing) that my financial situation was fairly tight at the time. I did sign a contract agreeing to pay in three installments. **ter in November, my husband lost his job and I requested a refund of the $883 due to extraordinary circumstances. YogaOne refused to issue a refund despite what I felt was a serious reason to quit and be issued a refund. Instead, they insisted that I can continue their teacher training program. I debated on whether I could afford to do this or not, and finally concluded that financially this would be too costly as we were already behind on house payments. I continued to receive numerous calls and emails from YogaOne, insisting and pressuring that I complete their teacher training program (offer a program at another time in the year) and also demanding the next two installments of the $883.As a consumer, and with potentially dire financial circumstances (I have since acquired a higher pay job beginning in 2/14 but finances are still a very serious issue for us as we also ahve two children), I feel that I deserve a right to a refund or at least the right with withdraw from a costly program without having to pay the amount if I do not continue it. I have decided not to pursue training at this place as it has left me with such a negative experience. I do not feel that such practices benefit the consumer, especially when they are faced with serious financial situations that warrant some flexibility. Likewise, I feel that potential yoga students should be warned about such practices by this school.Desired Settlement: I would like a refund, but if that cannot be issued, I do not want to be pressured by this organization to pay for services that I have decided not to pursue in the future. I also want to know what my rights are as a consumer.

We are very concerned regarding Ms. [redacted]'s complaint regarding our services.

The application she completed clearly states that we do not offer refunds (in one of the instances that information is bold and highlighted in yellow). It also states we do not offer refunds on our website and in various email communications preceding commencement of the course. Based on her correspondence (see below), we realize that Ms. [redacted] is undergoing a time of personal financial hardship and certainly empathize with the challenges surrounding that situation; however, there is no way that she could be unclear regarding our "no refund" policy.

As a result of her financial needs, we accommodated her request to set up a payment plan of three installments. We provided her with a contract detailing the terms of payment, which Ms. [redacted] signed and dated (see below). As a courtesy, we offered to give a credit for any future course once payment is completed per our agreement. However, Ms. [redacted] is refusing to complete the signed payment agreement and has now filed this complaint.

It is our understanding that Ms. [redacted] does not want to honor the terms to which she signed and agreed. We provide clear and simple language in our contracts and policies for clients so that there is no question regarding expectations and obligations to all involved.

At every turn we tried our best to accommodate her requests for special consideration. Our correspondence with Ms [redacted] was always professional, courteous and infused with a sincere intention to be of as much assistance as possible. She missed the first two days of the course due to illness, then sent an email quitting the course and stating “I will not be able to pay the remaining balances” (included below).

In nearly 12 years of service to the community helping to enhance the well-being of thousands of San Diego residents and visitors, we have never had a complaint filed. We are disappointed by these circumstances and hope for an amicable yet honorable resolution.

CONTRACT - SIGNED DEC 2, 2013:

Let this contract confirm that [redacted] (‘Participant’) owes Yoga One a balance of $1766.66 for the 2014 Teacher Training course tuition. After paying a deposit of $888.33 she will make monthly payments of $888.33 in February 15th and March 15th of 2014.

Yoga One acknowledges receipt of Participant’s non-refundable deposit paid on November 4th, 2013 in the amount of $888.33.

The remaining balance totals $1766.66 and will be paid either by check or electronic funds transfer (EFT) on a monthly basis beginning February 15th, 2014 in the amount of $888.33 and continuing for 1 month. The last bill date is scheduled for March15th, 2014.

I had a couple of quick questions based on our conversation on Monday -- you stated that I could begin the 40 class requirement before the course starts, so would it be possible for me to come by in the next week? And, I was also interested in doing the optional restorative class on Fridays from 430-530 during the training. If you can let me know, that would be wonderful!
