When I canceled the account, both accounts should have been linked to my email and both should have been discoverable by me and the business regardless of a different user name The facts are clear;YOGADOWNLOAD is in the wrong, The contract clause they have quoted does NOT apply to these circumstances or factsAgain, by their own admission, their computer system was not allowing me to access the other account despite being linked to the same email addressEvery time I logged into my account, with the same email address, I was told my subscription was cancelledAgain, no link or info was provided to me about the other account that I was only able to set up due to their negligent computer practices with no safeguardsI would like to know if anyone used this second account during this timeIf so, that means someone set up a fraudulent account with my information on their website Their claim that I should have noticed the fraudulent transactions earlier is an untenable and weak defenseRegardless of when the fraudulent charges were discovered, they are still fraudulentThat would result in a rule of law that would allow businesses from banks to retail to conduct fraudulent transactions and then shield themselves from any wrongdoing by invoking YogaDownloads argumenti.eSince the consumer failed to find the fraud in a timely manner, the business is not held responsible for the fraud, leaving the consumer with no recourseWhen the fraud occurred is irrelevant; when the fraud was discovered is the relevant pointAs such YD's argument flies in the face of consumer protection laws; it is neither legal nor conscionable

We always respond to ALL emails that come in to us, and have absolutely no record of any email from this customer prior to the email that came in on 12/2/demanding a refund.We do have a system in place on the login page where a person can recover all user names associated with an email address in our system, so that information could have easily been obtainedThis option is presented very large and clearly on the login page.All accounts the customer had, in this case two, could have easily been accessed at any time by the customerWe were not attempting to "hide" her account from her.The charges are not fraudulent as they were made from the customer's account with the customer's card they they themselves set up, entered info for, and paid forWe are not a fraudulent site and our site is 100% secure using industry best practices for site security.The point here is the customer could have easily cancelled their account with the click of a button at any time from their account page as we allow all of our customers to doIf they were having any issues or questions regarding their account, they could have easily sent us an email and we would've been more than happy to assist and make sure the account was cancelledThey did not do thisWe would like to see proof that other emails were sent prior to 12/2/as we have absolutely zero record of thisWhen the customer did contact us, we were very happy to help her get her account cancelled and refund the last several months worth of charges which is more than fair

Secondly, how I was able to create two accounts with the same email address; the same credit card info., and the same address is problematic for any internet based business. From Facebook to Ebay, safeguards exist so a person cannot use the same email to create two different user accounts. Evidently, by yogodownload's admission, I had created two accounts with the same email and the same information. However, the account never showed up when I would log in even though the second account was linked to the same email as the cancelled account. Not only, was I not able to discover the account, neither was their own computer system! When I canceled the account, both accounts should have been linked to my email and both should have been discoverable by me and the business regardless of a different user name.

Their claim that I should have noticed the fraudulent transactions earlier is an untenable and weak defense. Regardless of when the fraudulent charges were discovered, they are still fraudulent. That would result in a rule of law that would allow businesses from banks to retail to conduct fraudulent transactions and then shield themselves from any wrongdoing by invoking YogaDownloads argument. i.e. Since the consumer failed to find the fraud in a timely manner, the business is not held responsible for the fraud, leaving the consumer with no recourse. When the fraud occurred is irrelevant; when the fraud was discovered is the relevant point. As such YD's argument flies in the face of consumer protection laws; it is neither legal nor conscionable.

[redacted] created two accounts with us and her membership was valid and active during the entire duration she was being billed. She must have been logging into her second account that did not have the membership, but the account that did have the membership was never cancelled by her. It is clearly...

stated in the Terms of Use on our site that she agreed to when making her purchase ([redacted] ) as well as on the membership sign up page ([redacted] ) that subscription memberships renew automatically until cancelled. The cancellation button is easily accessed in the "My Account" section for every user, so she had every opportunity to cancel, and she also could have emailed us regarding the charges well before she did on 12/2/2015 and we would have helped her. We did submit a refund for her as soon as she emailed us for the month of Nov (refund for $18 was submitted on 12/4/2015) and cancelled her account for her at that time. She had full access to her account and membership benefits the entire time she was being billed.
