Walton's Games 11582 Lebanon Road Cincinnati, Ohio 45241 513.281.4444 Waitonsgames. corn E-mail: sales waltonsgames.com January 5, 2016 Revdex.com One East Fourth Suite 600 Cincinnati, Ohio 45202 Dear [redacted], There is (1) one very important point, and a total of (3) three important...

points that make this complaint, not a real business complaint. The (1st) first very important point is that the customer is under a written agreement/contract/signed by customer for us not to buy his game(s), but to sell them for him on a consignment agreement. There are price(s) agreed on before picking up the equipment paperwork /consignment agreement/contract signed by customer. Also, when games are picked up; see consignment agreement as proof, sign by customer. This agreement states very clearly that we are not buying— but selling equipment for customer, and that customer DOES NOT get paid until after equipment is sold, and delivered to the person purchasing equipment. The (2nd) second reason is for free no cost to customer we do all the consignment work. For free we pick equipment up, for free we repair equipment, for free we advertise equipment to sell, for free we sale, deliver, and give a warranty for used consignment equipment to sale it, at no cost to customer. Customer had a pinball, and juke box on consignment. The [redacted] pinball was sold, customer received a check for ($2,500.00) Twenty Five Hundred Dollars, and the pinball was paid in full. The (3rd) third reason, important reason is that the juke box on consignment agreement was NOT SOLD. The reason this is important is because after customer received check for pinball he also wanted a check for the juke box. When customer was told juke box was NOT SOLD, and under his consignment agreement, we did not have to pay him until SOLD. He became angry and we told him that he would have to wait, until sold, and with that he said that he wanted us to return the jukebox. We said no problem. Called customer 11/3/15, 11/4/15, & 11/5/15 no answer, and left a message EACH time. Then came the Revdex.com letter. Call customer 12/15/15, 12/16/15, and 12/19/15 no answer again. On 12/19/15 I did get customer on the phone. He said that we never called him one time. I can prove with my phone records print out.Good news! Called customer to tell him latter in December, 2015 customer wanted to buy his juke box, agreed on a price, and sold juke box. The jukebox gets delivered on January 15, 2016. The price agreed on is ($1,000.00) One Thousand Dollars. See copy of check.Because of these (3) three important reasons: (1) consignment contract, (2) free no cost to the customer, (3) tried to take care of customer but no return phone calls, I believe that this is not a real business complaint, and should not show up on our records.Thank you, very much, and if you have any questions [redacted] — please call me at [redacted].Bruce * W[redacted]Walton Distributing, Inc.

Per phone call from the customer:I finally received the check from the business and it has been cashed.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
To whom it may concern,I reviewed the response from the business (Walton's Distributing/Waltons.com).  First, I have not received a check.  It has been at least 11 days since the business states that he has mailed a check.  Second, I dispute the seller's version of what happened.  However, I realize that disputing his version does nothing to forward my complaint.  If you are interested in the areas that I dispute, I will happily send a follow up account.  However, right now, I would like to point out that the Seller DOES AGREE that he took my money.  And he DOES AGREE that he told me he would refund me.  However, I have not received any check.  One last thing that I do want to point out is that I did submit this complaint on 8/31 after I had spent one week calling multiple times a day with no response from the Seller.  It was not until I submitted the complaint, that I received a phone call with a check number.  But I want to be clear, I HAVE NOT RECEIVED A CHECK IN THE MAIL.  Today is September 11, 2017.

Inc. on May 11, 2017, and Yes, he did purchase this pinball under the condition of all sales final.Walton's then purchased a [redacted] pinball for the customer, only BECAUSE he purchased the pinball from us, and said he wanted it, and he paid for it.On May 30, 2017, a few days before delivery, [redacted] called and cancelled the order. He stated that he could not sleep at night because of this large and expense purchase. On our end, we had:1) Purchased this pinball for the customer 2) Picked-up by our delivery truck 3) Put pinball in the service department 4) Ordered parts for pinball 5) Restored pinball for the customer. We had a full week investment in this pinball, and we did tell him we would give him a refund, but that was based on our company all sales final rules. First, reselling his pinball for him and we did sell [redacted]'s pinball. We did live up to our company rules of all sales final, resale and refund, and we did send him a check. We also told [redacted] only one time/not over and over, but only one time and a specified date, Tuesday, August 29, 2017 that his check would be sent out to him. We also called the customer on Thursday, August 31, 2017 to tell him, and confirm that his refund check was sent out, and we also gave him the check number 5418. After the customer got this information, two days later this e-mail arrived. We do around 3,360 deliveries a year, and our service department does 100's of service calls. We are not perfect, but we did nothing wrong under the law in the State of Ohio. All sales final, actually means, ALL SALES FINAL.We put a lot of work, time, and our money in this deal, and we cannot do deals like this without company rules that protect us.Cordially,Bruce ** W[redacted] Walton Distributing, Inc
