York Risk Services Group is the third party administrator handling claims on behalf of Wesco Insurance Company who insures Jen Forwarding LLC. Please be advised that we received Revdex.com’s letter on October 15. 2014 regarding complaint ID number [redacted] filed by Mr....

This matter was reported to York as an auto accident that occurred August 4, 2014 on Route 95 near Warwick. Rhode Island. [redacted] was driving a Toyota Camry in the left lane and [redacted]., an employee of Jen Forwarding, LLC, was driving a Freightliner in the right lane when a sideswipe type of collision occurred. There were no known independent witnesses reported.
 [redacted] is claiming that Mr. [redacted] caused the collision by making an unsafe lane change and is demanding payment for her damages. The police responded to the scene and the police report states that [redacted] began to travel into the first lane and [redacted] began to travel into the second lane. Thus, it appears that both parties may have been making a lane change at the same time. The report also states that [redacted] sideswiped Mr. [redacted]’s vehicle.
We inspected [redacted]’s vehicle damages and the appraisal estimate for repairs is in the amount of $1,761.05. The vehicle primarily has right side door damage. There is no mention that her vehicle was not drivable, nor does the police report show that it was towed from the scene. There is no way to determine from the location of the damage on the vehicle which party initiated a lane change or may have swerved too close to the adjacent vehicle.
York has made several attempts and continues to pursue direct contact with [redacted] in order to finalize our decision in this matter. We are making every effort to conclude this matter, however; Mr. [redacted]’s direct statement of this loss is critical. [redacted] has been kept apprised of the status of this matter and the lack of evidence confirming liability in this accident.
It is our obligation to only pay claims if it is determined that the insured would likely be proven to be legally liable for [redacted]’s damages. Based on the information received to date, it is not possible to determine which party initiated a lane change or may have swerved too close to the adjacent party’s vehicle. We will continue to keep [redacted] informed regarding this matter until its conclusion which we expect in the near future.

Review: I was involved in a car accident on August 3rd 2014. I was hit by a truck on the highway and my car sustained damage to the front passenger door and right mirror. The driver was covered by WESCO, an insurance company, that eventually gave the claim to York. The claim was assigned on August 13th to an adjustor, [redacted]. [redacted] has not concluded as yet the outcome of this case. She doesn't get back to any phone messages and is extremely hard to get hold of. Her last message stated that she cannot give any time frame when the case will be solved and if I prefer, she can just deny the payment now. She claims that she has to speak to the driver since there were no witness to testify whose fault was and the location of the damage is not sufficient to explain the dynamic of the accident. Even after 2 months since the accident, my car remains unrepaired and not usable, causing tremendous me and my family tremendous difficulty.Desired Settlement: I would like to get the payment from York necessary to fix my car in the amount already evaluated by the insurance estimate.
