Webb Heating and Air Conditioning installed a new heating and air conditioning system on August 7th,
Listed below is a timeline of the events leading up to her complaints
6/27/Found the old system low of refrigerant and recommended system replacement
8/7/Replaced her system per contract with the same size equipment originally installed
6/3/Pre-Paid Summer ServiceThis was a planned maintenance check on her systemEverything was working properly at that time
6/17/Service Call was requested by homeowner that the new unit was running but not able to keep upWe checked and adjusted airflow to increase comfort at no charge
7/9/Saturday call for no coolingWe found a clogged condensate drain lineCleared the drain under warranty
7/26/After-hours service call because the system was not keeping up in the heat of the dayThe system was working properly at that timeThe system thermostat was showing degrees during the heat of the dayThis is not uncommon with an older home that does not have adequate insulation compared to today's new home standards and the excessive heat wave our area has endured this summer
7/28/Customer called in and stated that the system is still not keeping up so the General Manager and Service technician checked the system and made some adjustments and raised the airflow up to high speed where the customer said it worked best and made some refrigerant adjustments for the higher airflow at no charge
We explained that this summer had been one of the hottest on recordWith her home and her new system operating at manufacturers specifications and that it would be best for her to seal and insulate her home to decrease power consumptionShe has a whole house fan located in the hallway in close proximity to the return duct work that is not used anymore and needs to be sealedIt is allowing attic air into the homeWe offered to have someone come and quote her the insulation and repairs
We offered to replace her ductwork under the house since it is not sealed and insulated at no additional cost if she would pay for her attic insulation overhead
She declined to pay for insulationWebb Heating & Air also offered to increase the size of her system by 1/ton at no cost to herThis decision is tough because enlarging an air conditioner can cause other indoor air quality problemsThere is no simple fix for her problemShe again declined the larger system and explained that the increase would cause her power bill to increaseI explained that either a larger system or insulation was needed to have a thermostat set point below the degrees she desired during these excessive heat periodsShe declined both offers that were a no charge to her and said she would have someone else make repairs
She explained that someone else said that the return duct work was not installed properlyThe return air duct work was moved to the hallway to allow for easier filter accessThe new system is taller into the top of the closet which did not allow proper access and clearancesMoving the return air duct work is a common practice done with newer equipment to allow access for filter changes
We have offered to come out at no charge and correct any potential errors with the return air duct workShe has stated that she does not want us at her home anymore
We feel that we have tried to satisfy her needs with our offers but she will not let us perform any more work

Webb Heating & Air Conditioning contracted with Mrs*** on 5/4/for the installation of a new Air ConditionerWe were to replace the outdoor
air conditioner unit and the indoor coilThe original furnace and blower were to be used with the new cooling system
The new equipment was installed 5/7/as per the contract
Webb Heating & Air Conditioning was contacted days later on 5/26/by the homeowner stating that the new equipment was not cooling properlyMrs*** stated she desires her home to reach a temperature of degrees at certain times of operationAccording to the current N.CState Building Code: Energy Conservation Code book dated 2012, Section 302.1, "the interior design temperatures used for heating and cooling load calculations shall be a maximum of degrees F for heating and minimum of degrees for cooling"With this design temperature guideline that our industry is regulated by, Webb Heating & Air Conditioning has already exceeded expectations according to the homeowner by her statement of, "the temperature has yet to go below in one area and in another" when our design temperature according to NC code is a minimum of degreesThe equipment installed is delivering to degrees cooler indoor temperature than required
Webb Heating & Air Conditioning has been to this residence numerous times since the 26th of May, to confirm this system is performing properlyWe have taken data and checked the equipment for proper capacity and operationWe have taken the required information and submitted the data to the manufacturer *** for analysisTrane has responded that the system is operating properly and functioning to proper specifications according to the data providedA data recorder was also installed to analyze the performance of the new equipment during the periods that we were not present, and operation was recorded
As required by state and local codes, Webb Heating & Air Conditioning sized and installed this equipment per the manufacturer's specificationsWebb Heating & Air Conditioning also performed a load calculation verifying the proper size equipment was selected for this homeThe system was designed according to the calculationsThe system has also passed ** inspection by the local code officials
Webb Heating & Air Conditioning feels that the system is operating properly and performing to factory specifications at this timeWe have also responded to each of the homeowners request in a timely manner as we do for all of our customers

Our original systems were installed by *** in when our home was constructedOver the years we always used *** for any necessary repairsOur system functioned well and we were always happy with the heating and cooling capabilities of the units*** was always aware of our expectationsWhen the upstairs unit needed replacing I found out at that time Webb had bought out ***I falsely placed my trust in Webb based on our history with ***When Webb came and gave the estimate for replacing the unit I explained at great length our requirement for the unit t reach degrees at nightThey were well aware that this was an issueWe purchased an upgraded model as well as an additional part that would keep the unit from freezing up in the winter(Which had been the only problem we had previously had)If they were not going to be able to reach our expectations they should have informed us of that before we bought the unit
We paid more money for this unit which is not functioning even closely to that of the old unitThe expense of running this unit is significantly higher than the old unit as well
Bottom line, we made it clear that the unit needed to cool to degrees at nightThey had the opportunity to tell us, before the contract was completed, that they would not be able to meet our expectationsGiven that, I feel we were sold with expectationsFrom my first call that the unit was not working correctly, Webb has been adverse to helpingThey continually denied there were any problems, Always stating the system was functioning correctlyAfter several calls and photographic proof they changed out the malfunctioning thermostat, never admitting that it was not working correctlyThey are trying to use State guidelines to weasel their way out of fulfilling their obligation to usIf they are allowed to do this then they are getting away with deception and outright fraudI want nothing but the results we expected deliveredI have currently suffered much discomfort, annoyance and increased utility costs because of Webb.I want no compensation for the problems, hassles and poor service they have deliveredIf they cannot provide the performance they stated we would receive then I feel a complaint needs to filed against them with the Attorney Generals Office for fraud
I only want what we paid forNo more, no less

This entire debacle was not my fault what so everAll I have ever wanted was the same service and outcome of the unit they were replacingThese expectations were spelled out in my previous lettersWebb gave no indication at the time that, apparently, my expectations for the same service I received from my old unit, was a fools folly
Never before have I had a company not only not provide what they said they would, but then, treat me like the problem is meIn this entire mess they have acted put out by meThey have behaved in a manner that I am the problemI am notThe problem all stems from their dishonestyI strongly feel that this company misrepresented themselves and then when called on it tried to turn the tables and find fault with meIf they are allowed to remove the unit and just return our money then they will have gotten away with dishonest and unscrupulous business practicesI want them to correct their errors and I want an apology for their disrespectful treatment
At this point I do not feel that removing this unit is the proper solutionThis unit is, in itself, evidence of the fraud Webb committed
Below is a copy of the last letter I sent to Webb after they stated they would refund our money and remove the unit
This letter was emailed to Mr.Webb on July 11,
Dear MrWebb,
Would you please forward to me, all the data that was collected on the air containing unit you installedAlso, I would like copies of the contacts that were made by you to *** your reports to them about our unit and their responsesTo date we have come to the realization that, in regards to my desire to cool the upstairs at night to degrees, this appears to be a daunting taskHow our old 1/ton unit did it so well has me totally perplexedWhy those results can not be replicated by a new and larger unit has me even further stymiedThrow in the fact that this new unit is costing us significantly more to run, with poorer results, and I would hope you would be able to grasp my concernsThese issues aside, we have been told by other hvac providers that our unit, thought it appears to be operating properly, should not be taking as many hours as it does to cool each degree
Your resistance to believe any information I passed on to you about our unit, combined with several other factors has results in a justified distrust of your companyI am not, nor have I ever been, out to cause you any financial damageThe problems all started with your initial misrepresentationI was explicit and annoyingly repetitive to every one of your representatives in regards to my expectations of the unitI clearly stated all we wanted was a unit that performed as our old unit did for yearsAt that time your company was the one at great fault, letting me believe that this was possibleYou convinced us to upgrade to a ton unit and also add the other apparatus to prevent freeze upWe compliedThen, when the unit did not perform as expected you tried to hide behind State requirementsWhen I informed your company that the thermostat was not functioning properly, *** *** said to me, "Do you want me to put your old one back on." I had good fortune on my side when your technician came by on that one, as it malfunctioned right in front of his eyes*** asked me to place thermometers in various locations to see that the cooling was as the thermostat statedI did as instructed only to be able to prove that the thermostat was wrongAttached are a few of the picturesWhen I informed you of this I was greeted again with distain and made to feel as I was nothing but a problem
I have always been accountable for my actions and I feel strongly that is a principle upon which honesty and integrity are builtUnder circumstances I would have taken you at your word that the unit was scrutinized as much as you said, unfortunately, your actions have not proved you to be forth right and honorableEven as little as the fact that, after we paid for the entire placement unit, upgrade and additional part, your crew left the job done with the old dirty air filter
After much thought I realized I would never let any one of my children cut and runI have always held them accountable for their actions and I am proud to say that I raised five successful and honest professionalsThis is your opportunity to be accountable
I will be available all day if you wish to contact me either by phone or in personI think that this issue, being that you are supposedly an expert in your field, should be resolved by youYou should be able to do anything any other company could doHaving you remove the unit is a waste of time and moneyIf, in fact, the unit is flawed, then replacement should be done and *** should hold accountability for that
I have never been anything but completely honest with youI did my best to provide the best working conditions for your installersI cleaned up the area around the unit so they would have maximum access, I provided additional lighting and an additional fan in an attempt to ease the extreme heat on the third floor
This whole debacle is something I have never had to deal with beforeI am not a difficult person and I am not going to allow you to make me feel that I am

I would like to follow up with you to recap our conversation along with a brief history and our offer to assist you with your heating and cooling needs
On December 11th,
*** Heating and Cooling installed your system and started up the heatingIn April of 2009, *** started the air conditioning system*** also offered a year labor warranty with the installation
Webb Heating and Air Conditioning purchased *** Heating and Cooling in April
Your service history to date shows a call in July of regarding repairing a drain under warranty and also July repairing a drain under warranty, with no chargesClearing the drain is part of the recommended maintenance program to prevent damage caused by water and to insure safe and efficient operationSince the call in 2011, we do not show a call to this addressWe also do not have any records of maintenance being performed by either company at your address
A call was placed to Webb Heating on 6/10/stating that you had no coolingWe quoted the $diagnostic fee to come out since the system is over years oldYou stated that you were not going to pay for any repairs and that you're not going to spend thousands of dollars on a new systemOur office manager advised you that you had not spent any money with us since the installWe understand that you called the job supervisor to suggest that he never to use our company again and that you will be telling everyone in the neighborhood not to use us and that you will have another company come out to fix and send us the bill and you are calling an attorney to sue us
A complaint was filed with the B.B.Bwhich we received on 6/23/Our office called on 6/24/and left a message for you to call usOnce you and I were able to speak, we reviewed all of the issues with your system and the work that has been performed and I offered to try and assist you with your problemsWe offered to come out at our regular diagnostic rates, to which you declinedThe response was that this is unacceptable and you wanted a complete new air conditioning system and replacement of the damaged sheetrock from previous repairs to which had not been requested until now
We also spoke with ***, the builder's supervisor to make him aware of the situation

Advise customers to look for another company They installed a system in our house with a thermostat for each of two floors First the heat would not work, then only the heat worked, then nothing worked then only the heat worked Counting the installation they made 5-separate trips to the house and each time they blamed the problem on the incompetence of the technicians who came the time before While the individuals are nice, I would not trust them to do any more work as they've demonstrated their inability to meet even the most basic level of professionalism - successfully doing the job they were hired to do
