failure to display changes to parking requirments on building signage [redacted] NC. towing vehicles without proper notificationMother visiting daughter that has been a resident over 3 years. Makes monthly trips to Raleigh to visit as guest overnight. Signage on [redacted] states parking for residents, GUESTS and customers only all others towed at owners expense. (have current photo on building taken Sunday 6-8-2014). Mother has stayed on property without incident until Saturday night June 7. Her car was towed from private parking lot sometime after 11pm by [redacted] towing. I contacted property management-York Properties, [redacted] I was sent email letter from board of directors about parking on property. The sign on building doesn't reflect current parking requirements. The issue with parking decals for all cars and towing from 9pm to 7am is not addressed. The questions that I directed to Ms [redacted] was not addressed. could not talk on phone with her she would not answer. She indicated on her voice mail that it was checked just one time daily. The property needs to install current correct parking requirements for parking. Only then can you enforce policy. York properties cannot have some tow company just steal you car and demand payment in cash only, no checks or credit card. Policy now indicates that just 2 decals per unit are issued. When a family member visits and stays with resident as a GUEST something needs to be done about a temp parking placard. As it stands now no one can park on property unless they are residents. Then change the sign on building to include only residents to remove confusion. Delete GUESTS and CUSTOMERS from parking sign. Does this management company use selective enforcement of parking? Person at [redacted] towing said they got call from management company about my wifes car parked on property. Ms [redacted] denied that call, said office was closed over weekend. Half of the cars on property the morning that my car was stolen/towed did not have a parking sticker displayed.Desired Settlementinstall proper, correct sign stating requirements for parking on property, have some parking sticker visitors or family can use while on property. reimbursement for towing charge Saturday June 7, 2014 around midnight of $100.00Business Response Thank you so much for forwarding this complaint to us. We take complaints such as this very seriously. I have taken the time to review the facts of this complaint with the individuals named in the complaint. There are discrepancies in the complaint and the information I received. York Properties Inc does not set policy for the HOA at [redacted] We are empowered by the board to act on their behalf. Because of routine issues with parking at this location, property owners of [redacted] were notified in February, 2013 of the following....Parking - [redacted] has very limited parking space. Therefore, please be courteous of your neighbors and ask your guests to park on the street and not in the parking lot. Only homeowners, residents and guests of the retail spaces are permitted to use the [redacted] parking. The parking spaces are currently being numbered to better identify that they are reserved for homeowners, residents and guests of the retail spaces only. If this continues to be an issue the Board will move to issuing parking decals.Further, in August 2013, the HOA board set a new parking policy for [redacted] The exact wording of the notification that was sent to property owners is as follows..."This memo is to inform you that the Board of Directors has decided to issue parking passes to [redacted] owners and tenants. Passes will be issued as follows:2 parking passes for each residential unit1 parking pass for each businessIn order to retrieve your parking pass you must stop by York Properties before September 1st to be issued your parking pass(es) free of charge. Anyone (renters, guests, relatives, etc.) may use your parking pass. Owners who rent their units are responsible for transferring the parking pass to new tenants when the old ones move in. If a parking pass is lost or stolen you will be responsible for paying the $100 replacement fee. Effective September 1st towing will be enforced for those parked in the lot not displaying a [redacted] parking pass. Please note that vehicles will only be towed during the hours of 9pm-7am if parked in the lot without a parking decal."As you can see, this is not a new policy and it should be clear to all owners what the HOA board intends as their parking policy. All residents are responsible for abiding by this policy and communicating this to their guests.On the date in question, [redacted] Towing did in fact tow the vehicle for violating the rules of the association. [redacted] did not call York Properties to authorize the towing, but they did tow the vehicle in accordance with the rules of the association. It is clear from the complaint that the complainant has made many trips to this property over the past 10 months since this policy was put in place. It is unlikely that she was not aware of the policy regardless of the details supplied in her complaint.Having had my car towed once before (from another location), I understand the inconvenience this causes and I am sorry that the actions of complainant led to her vehicle being towed. Unfortunately the rules of the association dictated this to happen. I am hopeful that the complainant has a better appreciation for the HOA rules going forward so that this doesn't happen again. Consumer Response do not concur with this explanation of HOA rules. show me the signage describing parking permits, can not park 2 cars there with one parking permit. no way for guests to park overnite at this property. I was not parked in a numbered parking area when towed, against brick wall at upper area. Show me where the two girls that have leased there for 3 years read parking rules, understood them, and are supposed to relay rules to all guests that visit property. Unacceptable practice. She leaves this property in August. I doubt I will ever return to [redacted] because of this HOA policy for parking. The information needs to be available and displayed on property. management company just trying to justify HOA rules after car was towed/stolen. I have made many monthly trips to visit with my daughter over the past three years and this parking issue has never been spoken about.......never an issue beforeFinal Business Response Thank you for your new comments. I am sorry that you do not concur with the information provided. However, it is very clear what the parking policy at this location is to any resident of the property, especially one who has been there for three years, and they are responsible for letting their guests know the policy. As you can see from our prior response, this policy is clearly written and was communicated to the residents at this property in August of 2013. I am very sorry that your vehicle was towed but you were in violation of the policy which had been in place for nearly a year before your vehicle was towed. There is ample parking nearby that will be available to you on future visits.
