Review: Contractor did not complete terms of contract or properly sign off on them. i.e.contractor states behind his work but yet will not complete job or reimburse for job not done. Contractor stated that I hung up on him

which I did because I could not get a word in edgewise when discussing things with him Would bring up what extra he did which by the way his errors that I should not b held responsible for.

1. Bedroom windows not put in as per contract.

2. Threw outside light away had to purchase new lights and asked them to install (not in contract) reference to installation.

3. Bathrooma whole another incident. Wanted normal height vanity with marble top. Told would show samples. I sent him pictures of what we were looking for. He stated we could not have that it was 42" not 36" This is width not height If tile pulled up it would show 36" written on the floor,as this was the width of vanity we talked about not height. The only samples showed were a piece of paper we were allowed to chose from which was only colors. We asked again about a marble vanity top and told it would be too expensive for us to purchase. We also never discussed a side splash or back splash. When it arrived it was the cheapest counter top and guess what it was 36 x 36. It had side splash which was not professionally applied because it did not match up with back splash.

4. Then the plaster job not done professionally as the plaster was all over the place. They had cut down a hall way and made a new entrance and there was plain board with plaster all over it and when the woodwork was taken away in the bedroom which had been there for 40 years it was not replastered to hide set in old plaster lines and the plaster that was already on the walls was not matched up with the plastered walls before. My painter said it was a common plaster design and any plasterer should be able to do this technique which is nothing then an arc motion. When asked foreman to come back and see the job, he never showed up for the rest of the job. For the plaster on the board that had plaster on it I finally had a piece of carpet taken out of a closet to do a patch job. Now, we have carpet 30 years old from traffic with a brand new piece of carpet from 30 years carpeting a closet floor.

5 Electricity was wired in before vanity arrived and had ordered pieces for a medicine chest and a over the toilet cabinet. Vanity lights were put up and we were not asked what size our cabinets were or wherevwe wanted placement of lights. When the other things arrived, they were the correct size we ordered but could not fit between the lights that he electrician decided to put in and also had to send that back and then when the contractor finally took out the vanity and we orderfed the 34 1/2" in height with engineered marble which we ordered our plumbing supplies and got what we wanted.

6. Electrician also did not pass code and had to come back and adjust things, but the worse part is that the contractor sent us another bill for over 2000.00 for his carpenter to come back and finish the job. I paid for the work that I needed changed but would not pay for labor. The inspector for the final inspection told me that I should not have evn paid final bill or the extra bill until the inspections were completed. I was threatened that there would be a ;aw suit if I did not pay the bill way before everything was done.

7. Ramps were never made for us as in the contract, never reimbursed for that either. They put in 2 pine steps and concrete steps outside. We were supposed to have to have handicap ramps as Iam handicapped and handicap accessible and we discussed this all on day 1 when we met the contractor who was a totally different person then we dealt with. We also talked about grab bars which we bought but was not placedin contract but was stated verbally and only took 2 minutes to put in since thet threw our lights away and never reimbursed about.Desired Settlement: Would like for the job to be completed and reimbursement for the things we never received and we paid for. An apology for the grief called and that delay in job wasalso because you only had 1 person doing the job and took him off our job to complete several others

In reference to the above mentioned complaint filed by our customer, a former complaint regarding more or less the same complaints had been previously filed with the Consumer Protection Bureau of the State Attorney General’s Office, which had been closed. Attached is a copy of our response.

A final invoice was sent, which was not paid in full prior to work being completed, it was broken into 3 payments until completion, and copies of checks will show it was not paid in full prior to completion.

As for the windows she said she did not want them installed.

As for throwing away outside lights. Her outside lights were not what she wanted. As per page 3 of the contract at the bottom I told her to purchase what lights she wanted and Yorklyn would install, we did just that.

At no time did customer mention the word handicap, nor is there anything related to handicap mentioned in the contract that she reviewed and signed.

As for the vanity and countertop I gave her what she wanted, I removed the first vanity at our cost and ordered her a new one and at no charge even though the first one was the one she approved.

As for the plaster we told her we would match as best we could. After the job was completed she approved and said she was happy until a painter came in with a different story.

As for the carpet in the hall I ask her if she wanted new carpet in the hallway and she said no. I did suggest taking a piece out of the closet and patch it in and she said that was fine. Again, no charge for this.

Customer had lights she wanted to use above the vanity and she approved placement. There was limited space due to the shower door and the electrician put them where she approved.

As for the electrician’s work not passing code. This was in part from customer insisting all she wanted was a remote switch to operate fan, no switches. All we needed to do is put in approved switches and the electrical work was passed.

As for the ramps, the customer was shown how far the ramps would project into the room and she stated she did not want that. Our carpenter suggested maybe wider steps for her in place of the ramp and made a test area for her approval. She loved it and we proceeded to do both like that. She says she wanted handicap ramps but she was the one to make the final decision. She walks with a walker and she was the one to approve all changes. At no time did she mention handicap because if she would have it would have been included in the contract.

As for the grab gars and lights which were decided upon after contract was written, I told her to purchase which ones she preferred and we would install. We did that.

In summary, the customer was in constant contact with our office from beginning to end with many, many phone calls and conversations with the carpenters, Salesman, and office through out the whole project. Many visits from the Salesman to revisit the contract and what changes she wanted made at the time the work was in progress. The complaints listed were caused by the customer constantly changing her mind and we did indeed try to accommodate her through out the job. She did get a beautiful job.

As far as taking advantage of her upon final completion of the job and another review of the contract it was noted there was a bedroom light in the contract that never got installed and a refund check was sent to the customer. It is not our policy to take advantage of our customers the way this customer is stating.

I am rejecting this response because: This is not true and because he thinks he did a beautiful job, he did not take care of the complaints that I did have with the job and argued with everything that I needed to have corrected or would not complete. The ramps, grab bars, all announce handicap and on our first meeting with him that is all we talked about is that we needed to have a handicap accessible, word being accessible, and that we needed grab bars and ramps as I and my mother are using walkers now and would like the accessibility of the ramlps, etc so in case we would need wheelchairs this would be available to us. In reference to this, this was again discussed on our first visit with the contractor and he agreed and he understood. The bills were correct and the last installment paid but did not have to be paid until all inspections were done (told by inspectors) and we were threatened with a lawsuit if we did not pay in full, thus paid in full so we were bullied to pay bill in full before job was completed because we were waiting for the new vanity to come in and the mirror to be installed and then final inspections as I stated in my oriiginal complaint. Everything in my original complaint is correct and nothing was initialed in reference to the complaint of changes and because of the changes having been made, we had to incur additional costs that should have been included in the contract and the contract was for what we discussed and if any changes made that were less than what the original contract stated should have been reimbursed, i.e. one step to a ramp, replastering to make u mistakes from conractors men. Also, received another bill for the delay in the job because of the wrong doing on the vanity which he did not order, I did, and also because of not being asked where to place the lights or the size of the medicine cabinet which is not even centered over the vanity. Again, received another bill from them even after I had paid th final bill and I paid fo changs I had asked for but would not pay for labor. Again, did not see alot of sales people, only sales people in reference to his mistake in reference to the vanity.

The contract had nothing to do with handicap in the bathroom (a copy of contract was provided with 1st response), in fact there

are no residential codes for handicap baths.

Upon final inspection the customer complained to the inspector and he too explained to her there was no code for residential handicap. Again this job was never written to be handicap accessible.

The customer keeps referring back to the vanity for the bathroom, after the first vanity that she agreed to was unacceptable she

ordered her own vanity and vanity top, Yorklyn absorbed the cost and gave her a credit, this was also explained in the letter to the Office of the Attorney General. They have closed the complaint.

During the duration of the job we had several inspections throughout which needed to pass in order to continue working, all inspections

passed. We did have final inspection for occupancy and it too passed.

Regarding the final invoice, again it was paid with 3 different checks at 3 different times.

All of my workers will tell you they bent over backwards to make this customer happy, they did everything she asked and more.
