I am rejecting this response because:Duration:My Family and I were displaced from our home by a fire that  occurred in May 2015.We hired and Contracted with Yorway Custom Homes in October 2015 to rebuild our home. Brett [redacted] Yorwsys representative at that time assured us it would only take around 90 days to rebuild our home.  He was made aware at the time that we needed to be back on the home by the end of May 2016 which would be over 7 months for the construction process.. As of today the home still is not complete and I have been told by Quility builders that to finish the home and fix all the items that need to be addressed will take them at least another 45 days. Yorway Custom Homes & Brett [redacted] are contracted to proceed with the build "As if Time is of the essence" at best, they have been working as if this was a side job with Yorways Sub contractors showing up sporadicly at best, and the Geretal Contractor Brett [redacted] almost never present on the job site..  We had a issue with a Hardwood Flooring Contrsctor having problems and instead of going over and addressing the problem himself as part of the standard duties and responsibilities He found it appropriate to send me a text message to go over to the job site and talk with their flooring sub contractor instead of addressing this issue himself..During the whole build there has been long durations where No work took place on our home we found out later that Yorway and Brett [redacted] Stopped construction to prepar and attend a home show and apparently start and build a Model Home.. The home also has several obvious issues that building professions have pointed out as needing to be addressed. The Roofing Shingles have developed "Mole Runs" as pointed out by s GAF Roofing Represenitive as being caused by either inadequate Addic ventilation or moisture under the shingles but clearly improper installation issues..The hardwood flooring is and has been a big issue in all by itself. The flooring was not installed to basic hardwood flooring standards. The mill that the flooring was purchased from requires that their flooring be installed per the National Wood Flooring Association guideline requirements.Other then the closets and Stair landings these standards were not met.Compandent flooring contractors found several issues in their review of the finished job air vents floored over improper joint spacing split flooring from flooring stapler pressure set too high, flooring damaged during installation just left large humps 7/16 and greater just floored over. High moisture content of subfloor, large gapping on end cuts, end cuts not square, flooring into office short in door frame etc.Yorway Custom Homes obviously never checked to make sure that the main level Subfloor met the requirements as outlined per the Nationial Hardwood Flooring Association requirements. As pointed out by professional flooring experts they don't meet those requirements today.  The subfloor still has high moisture content and  does it meet the requirements for level and flat.Also we have a problem with the patio door to the deck. Besides the fact it was damaged during the dry walling of the kitchen area by the workmans scaffolding it was apparently framed incorrectly and now sag's approx 3/16" down in the center area obstructing the door correct operation..We also have several contractual issues with Yorway Custom Homes that legal council has brought to my attention need to be addressed..

My response to the Complaint is attached hereto as 8-2-16 letter from my counsel to the Revdex.com.This office serves as legal counsel to YorWay Custom Home Builders, Inc. In this capacity, we have been asked to respond to the Complaint that has been filed by Mr....

[redacted] alleging that YorWay has not completed its construction of the new home in a timely fashion and has supplied deficient materials. My client disputes all allegations in the Complaint. Under the contract, because it is a custom home that exceeds 4,000 square feet finished, there is no set completion date. With regard to the flooring, we have been assured that it passes all Builder's Association guidelines. Regardless of the baseless allegations, my client has not received any cooperation from the [redacted] in processing such change orders and pay requests from their construction lender. As such, my client has filed a Mechanic's Lien against the property and has instructed me to file a Lis Pendens and foreclose the lien for lack of nonpayment and cooperation by the [redacted]. This matter will likely be in pending litigation within the next ten days if a resolution cannot be achieved with the [redacted]. Should you require anything further, please contact me directly.
