Dear Revdex.com and YouCaring Chat Woman, As I explained in the online chat, I had already read the tips and did everything I could do those tips suggested, including emailing " [redacted] @youcaring.com to reach out directly to the team managing the content on this page" before I had ever had the online chat she refers to hereI did this within the first week I went live with my fundraiserIn addition, I sent out information and links to my charity about times within those two weeks , as she informed I had done, and I made updates as I couldHowever, after the first two weeks I couldn't even find my original fundraiser to beg for help I discovered there was a site mess up or a glitch in which my original fundraiser split into two different versionsSomehow all the writing remained in my original fundraiser version and the second one, but the pictures, the updates and the money were all gone (the $I put in to kick things off the first day) from the second versionThe first one could not be found at all I have not been given a reason for why this happened either, and it has severely hampered my fundraiser since people tend to look at the charity link the first time they are sent it and not the more times after that, especially when a glitch prevents them from getting to it When I was told people could not find the link, I went on YouCaring, did not sign in and looked for it myselfI too couldn't find it right awayIt took punching various versions of my fundraiser tagline into the search before I found it and realized it was the different versionsame writing, no pics, no money, no updatesWhen there is a glitch, people get frustrated and few will keep trying to find the fundraiserAfter a while of continuously resending, it becomes bothersome I don't have a million friends on FB, Twitter, my personal blog and nor the five other high-profile sites I belong to and had sent multiple links out to, and I didn't know it was a popularity contest to want to save lives eitherYet to that end, I am not new to the charity rodeo as I'm a petition organoizer for MoveOn.org and Change.org and using my same social sites, I get hundreds of responses within the first few hours for things like animals rights, cliamte change and toxic water I used YouCaring specifically for trying to help kids because YouCaring is marketed specifically as a site for such charities, as opposed to environmental issues from the previous two sites I mentionedIn addition, I find it odd that not a single person off YouCaring donatednot one! That my fundraiser was divided into two was the originally reason I contacted YouCaring's online chatI still have no reason for how this glitch happened and it harmed the fundraiserHow will that be rectified? It's basically a total loss at this point However, because I know I am not the only person who cares about kids dying on public streets in a well-known tourist destination, I will update the fundraiser about the glitch now that you so kindly helped me locate my original fundraiserI will also retest it to see if it is workingAnd, I will AGAIN request the marketing department to take pity on dying children in the streets of Thailand However, I still maintain it is odd that people cannot find my fundraiser and that in order to get help, I must use all other sites but yoursthe one marketed for such charities This matter is not closed in my opinionI would also request that someone other than the chat woman I spoke with respond to this since she clearly did not read what I had sent to her in that chat and she is reiterating what I have already doneI also feel as though she is trying to keep the mistake hidden about my fundraiser breaking down since she did not address this issue at allA supervisor may be more apt to want to help and fix this Finally, there is the matter having to use WePay as opposed PayPal that I and most people already haveI do not feel comfortable giving an unknown, to me, organization my personal banking informationI would like to know if YouCaring has stock in or owns WePay as well Thank you, Regards, [redacted] Final Business Response / [redacted] (4000, 9, 2015/09/02) */ Hi ***, I am truly sorry you are not satisfied with our response to you To confirm, there was not a website glitchIt looks like you had created duplicate fundraisers in error which I did point out to you in our communication and offered to help you remove the one that was not necessaryThis duplication accounts for the confusion in finding the correct fundraiser on our site As a friendly reminder, please follow these steps to remove the duplicated fundraiser you are not using: Log into your dashboard by clicking 'Log in' on the home page (YouCaring.com) Click 'My Account' in the top right corner of the screen to view the list of fundraisers on your account Click 'Manage Fundraiser' next to the fundraiser you would like to edit Go to the "Edit Fundraiser" tab Scroll to the bottom of the page and click the 'Delete Fundraiser' button

*** attempted to chat with our support team on Wednesday January 20th regarding donations to her fundraiserShe was concerned that donations didn't go immediately to her bank accountWhen her chat dropped, our agent followed up with this
email explaining the timeline for bank transfers from our payment processors:
Hi *customer name omitted*,
Thank you for contacting usI apologize for the trouble here and that we weren't able to help you on chat earlier
I see that your funds have been deposited into the bank account ending in ***It then takes 2-business days for those funds to appear in your bank account
You received your donations on 1/15/16, so those funds were deposited into your bank account the morning of 1/16/Since it then takes 2-business days (not including weekends or holidays) for those funds to appear in your bank account, you should see those funds in your bank account between 1/- 1/I'm sorry that wasn't clear
Since we don't have phone support, I'm unable to give you a call right now, but if you would still like to speak on the phone, I can give you a call around 5pm PSTPlease let me know

Hi [redacted],
I am so sorry this happened! This problem was caused by a site update that we have since fixed. I am so sorry for my delayed response. We were waiting for a correction to be applied so I could inform you.
You can now see your...

donation listed on the fundraiser: https://www.youcaring.com/[redacted]-XXXXXX
Again I truly apologize for what happened here.
Initial Consumer Rebuttal /* (2000, 7, 2015/09/03) */
(The consumer indicated he/she ACCEPTED the response from the business.)
The issue is resolved, however the level of customer service I experienced was terrible.

Complaint: [redacted]I am rejecting this response because:

This business is not addressing the HEART of my complaint!
My complaint is that it allows another business to use my trademark / copywriter protected / trade name to solicit funds.
Just because the company using my trademark / copywriter protected / trade name "[redacted]" name did not receive any funds does not mean that this company will not allow it to re-post its request under my or another companies name.
They should run a Google check on the name someone wants to solicit under and verify that the name is not already in use.
Further, they should set a company policy verifying that the soliciting party has done its due diligence to make sure it's not utilizing another companies name.
Sincerely,[redacted]

[redacted] called our press number located on our website on 6/5/17 about the issue. On 6/8/17, we initiated a refund of the $50.00 charge and confirmed with our payment processor, WePay, that there was only one $50.00 charge. We communicated this information with the user on 6/8/17 that the charge had...

been refunded. He indicated that he was happy with the response and thanked us for the assistance.

I'm sorry for the trouble you're having with your WePay account and fundraiser. We received your email this morning at 1:40am PST and have responded at 11:15am PST to help get this issue resolved as soon as possible.

Initial Business Response /* (1000, 10, 2015/05/26) */
We responded to the customer's request to assume the funds for them since they did not want to release their details to our third party donation processor and we directed the funds to the charity they had requested us to.

Complaint: [redacted]
I am rejecting this response because: while led I am happy that they refunded the $50 that I never authorized, they still don't address the 2 issues that I submitted. First, their site requires you to UNCHECK giving them and it is hard to see that they are taking money for their site. Second, they do not address why they were able to process the funding for their own site and not fund the donation I wanted to make to help my friend which was the only charge that I authorized.
Sincerely,

Hi [redacted],
I am truly sorry you were not happy with the tips we suggested to you on live chat this week.
As a friendly reminder, YouCaring does not find donors or donations for you.
The characteristics of our most successful...

fundraisers are that they utilize the power of their social networks to gain exposure and support of their campaign.
I did share this insight with you on live chat and strongly encouraged you to share the campaign on social and also get others to help you promote it.
I also included a link where you can submit a feature request for your fundraiser.
If you are interested in having your fundraiser featured, you can email [redacted]@youcaring.com to reach out directly to the team managing the content on this page.
Please check out the following article tips and suggestions for what you can do to improve the chances of your fundraiser being featured:
https://help.youcaring.com/hc/en-us/articles/XXXXXXXXX-Can-you-feature-my-fundra... /> I cannot guarantee that our marketing team will feature it but at least you can make a submission to be considered.
Initial Consumer Rebuttal /* (3000, 7, 2015/09/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Dear Revdex.com and YouCaring Chat Woman,
As I explained in the online chat, I had already read the tips and did everything I could do those tips suggested, including emailing "[redacted]@youcaring.com to reach out directly to the team managing the content on this page" before I had ever had the online chat she refers to here. I did this within the first week I went live with my fundraiser. In addition, I sent out information and links to my charity about 49 times within those two weeks , as she informed I had done, and I made updates as I could. However, after the first two weeks I couldn't even find my original fundraiser to beg for help.
I discovered there was a site mess up or a glitch in which my original fundraiser split into two different versions. Somehow all the writing remained in my original fundraiser version and the second one, but the pictures, the updates and the money were all gone (the $25 I put in to kick things off the first day) from the second version. The first one could not be found at all.
I have not been given a reason for why this happened either, and it has severely hampered my fundraiser since people tend to look at the charity link the first time they are sent it and not the 10 more times after that, especially when a glitch prevents them from getting to it.
When I was told people could not find the link, I went on YouCaring, did not sign in and looked for it myself. I too couldn't find it right away. It took punching various versions of my fundraiser tagline into the search before I found it and realized it was the different versionsame writing, no pics, no money, no updates. When there is a glitch, people get frustrated and few will keep trying to find the fundraiser. After a while of continuously resending, it becomes bothersome.
I don't have a million friends on FB, Twitter, my personal blog and nor the five other high-profile sites I belong to and had sent multiple links out to, and I didn't know it was a popularity contest to want to save lives either. Yet to that end, I am not new to the charity rodeo as I'm a petition organoizer for MoveOn.org and Change.org and using my same social sites, I get hundreds of responses within the first few hours for things like animals rights, cliamte change and toxic water.
I used YouCaring specifically for trying to help kids because YouCaring is marketed specifically as a site for such charities, as opposed to environmental issues from the previous two sites I mentioned. In addition, I find it odd that not a single person off YouCaring donatednot one!
That my fundraiser was divided into two was the originally reason I contacted YouCaring's online chat. I still have no reason for how this glitch happened and it harmed the fundraiser. How will that be rectified?
It's basically a total loss at this point.
However, because I know I am not the only person who cares about kids dying on public streets in a well-known tourist destination, I will update the fundraiser about the glitch now that you so kindly helped me locate my original fundraiser. I will also retest it to see if it is working. And, I will AGAIN request the marketing department to take pity on dying children in the streets of Thailand.
However, I still maintain it is odd that people cannot find my fundraiser and that in order to get help, I must use all other sites but yoursthe one marketed for such charities.
This matter is not closed in my opinion. I would also request that someone other than the chat woman I spoke with respond to this since she clearly did not read what I had sent to her in that chat and she is reiterating what I have already done. I also feel as though she is trying to keep the mistake hidden about my fundraiser breaking down since she did not address this issue at all. A supervisor may be more apt to want to help and fix this.
Finally, there is the matter having to use WePay as opposed PayPal that I and most people already have. I do not feel comfortable giving an unknown, to me, organization my personal banking information. I would like to know if YouCaring has stock in or owns WePay as well.
Thank you,
Regards,
[redacted]
Final Business Response /* (4000, 9, 2015/09/02) */
Hi [redacted],
I am truly sorry you are not satisfied with our response to you.
To confirm, there was not a website glitch. It looks like you had created 2 duplicate fundraisers in error which I did point out to you in our communication and offered to help you remove the one that was not necessary. This duplication accounts for the confusion in finding the correct fundraiser on our site.
As a friendly reminder, please follow these steps to remove the duplicated fundraiser you are not using:
1. Log into your dashboard by clicking 'Log in' on the home page (YouCaring.com).
2. Click 'My Account' in the top right corner of the screen to view the list of fundraisers on your account.
3. Click 'Manage Fundraiser' next to the fundraiser you would like to edit.
4. Go to the "Edit Fundraiser" tab.
5. Scroll to the bottom of the page and click the 'Delete Fundraiser' button.

Complaint: [redacted]I am rejecting this response because:
I located a person soliciting funds on [redacted] website under my business name: [redacted] (i.e. [redacted]).
I requested that [redacted] either remove or modify this monetary solicitation under my company name ([redacted]) so as not to give the impression that I was the one making this solicitation.
Below is my response to [redacted] reasons for not removing or modifying this solicitation.

[redacted] referenced : Section 102 of the Copyright Law of the United States
MY RESPONSE:
The enactment of a statute/law is not the beginning and end of the law's life. It evolves, generally through case law and advancements in the field for which it was written during the time of its drafting/passage.

[redacted] referenced: An email address, Facebook page or website do not fall into the categories above (a reference to Section 102 of the Copyright Law). Because of this, we are not able to verify that “[redacted]” is copyrighted by the user.
MY RESPONSE:
Under [redacted], it states"...The original authorship appearing on a website may be protected by copyright......"
Although "copyright", is referenced above, this is also a "trademark" violation.

[redacted] referenced: The fundraiser also does not explicitly state that is it raising funds for “[redacted].” The title is written as "[redacted], care packages & Laptops,” which shows that “[redacted]” and “Books” were not part of the same phrase. The two separate phrases in the title are “[redacted]” and “Books, care packages & Laptops.”

MY RESPONSE:
1st, I'm not able to go back into their website to verify what the fundraiser solicitation says because after I asked [redacted] to take down or modify the monetary solicitation, they blocked my IP address from accessing their website.
2nd, although [redacted] states;
........“The fundraiser also does not explicitly state that is it raising funds for “[redacted].” The title is written as "[redacted], care packages & Laptops."
This is nonsensical! Using their logic, I could place a monetary solicitation on their website under their own company name ([redacted]) as long as I added, "care packages & Laptops." Would they also accept a solicitation under "Facebook care packages & Laptops"?
3rd, although they state, ...“[redacted]” and “Books” were not part of the same phrase, either is "You" and "Caring." It is understood that since you cannot create a domain name with a space between words, the domain name will run together, i.e. [redacted] -vs- [redacted]. In addition, if you access my website, the words "[redacted]" and "Books" are clearly separated.

[redacted] referenced: The fundraiser also lists that it is for: "[redacted]."
MY RESPONSE:
This is a non-issue. I'm fine with this. Leave out the word "Books" and I have no issue with this fundraiser's monetary solicitation.
A Google search of my company name, "[redacted]" brings up a [redacted] - [redacted] monetary solicitation. There is nothing that would cause a person to know or even doubt that this solicitation is for my company and that I'm the one making this monetary solicitation.
Lastly, I don't know if or how the individuals soliciting funds are vetted by [redacted], but if they turn out to be a nefarious persons/groups using my company name, it could cause irreparable harm to my Children's Book company reputation.
Take down or modify this monetary solicitation please! Have a [redacted].
Sincerely,[redacted]

Per section 102 of the Copyright Law of the United States ([redacted]), tangible mediums of expression include the following:“102. Subject matter of copyright: In general(a) Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device. Because of this, we are not able to verify that “[redacted]” is copyrighted by the user. The fundraiser also does not explicitly state that is it raising funds for “[redacted].” The title is written as "[redacted], care packages & Laptops,” which shows that “[redacted]” and “Books” were not part of the same phrase. The two separate phrases in the title are “[redacted]” and “Books, care packages & Laptops.”The fundraiser also lists that it is “For: [redacted].

the fundraiser in reference has been removed due to inactivity and no active [redacted] fundraisers are using [redacted] at this time.

Complaint: [redacted]I am rejecting this response because:
Under the US Copyright Act (enacted 1976 ), a copyright exists...

automatically from the moment a work is fixed in a tangible medium of expression. My website domain name registration ([redacted]),My website ([redacted]),My Facebook page registration ([redacted]),And even my email address: [redacted]are all tangible medium of expression and do singularly (and particularly in combination together) "fix" my copyright ownership in [redacted]

Hi [redacted],
I am so very sorry for the difficulty in correct the info on the WePay account.
Travis advised me that he called you to discuss this issue over the phone with you.
We are confirming with WePay when they plan to transfer the...

balance to you/your husband. We will be in touch with you again once they have informed us when the transfer is schedule so you know when you can expect it.
Again, I am so very sorry for how frustrating this experience has been. We are discussing ways to improve the set up concerning fundraiser WePay accounts so that we can avoid situations like this in future.
Please accept our sincerest apologies.
