One of the reasons we send out proof invoices is to make sure that we are talking to the correct person at the company and to make sure they know that they are purchasing an ad due to a phone conversation. Nothing is ever payable until after...

The simple solution to this invoice, since it was just mailed out to the client was to have called and left a message and the ad would have been cancelled and the sales person would have phoned back and answered their questions and concerns.
As well, most clients WANT TO SEE SOMETHING when they ask for information - in order to make up and send an ad we have to input it into our computers which generate an invoice.
There is no problem cancelling this invoice. It has been done. I hope this helps the client understand why an invoice was generated in the first place

Hockey News. The sales manager then came onto the phone to verify she was purchasing an ad. An invoice was then generated with the ad on it showing how it would run at the time of publication (Publication wasn't until February 5th).
There is no mail returned from this client and no contact until April 14th. The client requested us to cancel the ad but found out it was much to late to cancel and her ad was published. Why didn't the client phone us immediately upon receiving the first invoice back in January ? If this had happened there would be no trouble of cancelling the ad.
February 5th we sent the client a copy of the invoice along with the paper her ad was published in. [redacted]
The dates of all correspondence sent to Young Fitness Inc. was in April, four months after the first invoice was generated and sent to [redacted]. The client was never threatened about the invoice being sent to the credit bureau. For the entire time Young Fitness Inc. has been operating we have never sent any one to the credit bureau.
It is clear this issue is not going to be resolved. We have removed the client from our database and removed the invoice and wish the client luck in their future endeavours.

We called the client on June 10th, 2015 9:59am to run an ad in our Amateur Sports News publication. We sent out the ad copy on the bill by mail the next day.
Our process of selling advertisement is done all by phone conversation. The sales...

person gets the sale verified by a superior before submitting it to be invoiced. At no point were we asked for a fax or email ad request, which we do if the client requests it; the verification clearly states that they are PURCHASING an ad; an INVOICE is being sent out; that the BILL does not have to be PAID until the ad has been published at which time they would receive a second INVOICE with a copy of the paper. At no time during that verification did the client indicate that they were not purchasing.
This method of sales and verification has been the way we've sent out invoices for the past 18 years and if the client had indicated that they misunderstood or were not interested at the time of the verification we would not have proceeded with an invoice. As well, they had two months to make sure we had received the message we presume they left on the answering machine (see paragraph below). They did not respond with a second call, nor mail the invoice back to us to make sure we knew they were cancelling the ad.
After checking the message database I located a message left on June 17, 2015 which I presume was this client however, no invoice number was left and the phone number left incomplete. There was no clear name of the company. The message on the machine clearly states to leave an invoice number, a company, and a phone number so we can cancel such ads before publication. In this case publication was August 21st. In good faith after locating the only message with no proper account information, business name or complete phone number. I have decided to write off invoice [redacted].
A second point of contact was made to the client on September 25th, 2015 9:03am again asking the client to run the same ad. Again the sales manager verified with the client he will be receiving another ad copy on a bill by mail. Publication of the second ad in the Minor Hockey News was not set for publication until November 13th 2015. [redacted]
In conclusion, a service has been provided for both invoices. I have decided to write off the first invoice ([redacted]) just under probable cause there MAY have been a message left under his business. However the second invoice ([redacted]) will need to be remitted.
It will be our decision not to contact the client ever again and remove his number from our call out list.

the fact they are purchasing an ad is then verified by the sales manager. The ad copy (Invoice #[redacted]) was generated the next day and sent on the bill by mail. Changes or even cancelling the ad before publication simply takes a phone call, e-mail, or fax which is located on the top right portion of the invoice.
Why did [redacted] consent to running the ad a second time (Invoice # [redacted]) if the ad was incorrect or if he didn't want it ? Why was there no contact made to Young Fitness Inc. after receiving the first invoice back in July (in the consumers original complaint)
Young Fitness Inc. NEVER generates a invoice as a "sales pitch" to show our work and what it would cost. Our billing procedure has been the same for 20 years. A phone call is always placed, this is when the salesperson pitches the company.
Young Fitness Inc. had called [redacted] multiple times before the status of this invoice was subjected to out side hands. October 5/15 the sales person returned [redacted]'s call. Then the in house collections agent called October 6th / 15 trying to reach a solution how ever [redacted] was not in the office.
If they were "unaware this was a real invoice". Why did they not immediately contact us or mail back the invoice? Even when they received the "sample ad".
Ample time was given in each scenario to cancel/change the ad and a service was provided. [redacted] will need to remit both invoice [redacted] and [redacted] to clear the account.

We do not accept this response. Quite simply, if we had wanted to advertise with this company, we would have invested the time to make sure the Ad made sense, which it does not. The logo, the company name and the slogan they put on the ad are incorrect and inaccurate. These are all things that someone looking to place an Ad gives high priority to, and would check thoroughly to ensure accuracy. Even in their response, they continue to incorrectly write our company name which is in fact [redacted], not [redacted].
Young Fitness insists that they have our approval but at the same time they can not provide any such proof - there are no signed documents, no email correspondence or confirmations of approval, and no documented phone calls. All they can do for us is provide our towing managers name, which anyone who calls our shop can find out. Upon speaking to [redacted], he indicates he did not approve the advertisement nor does he recall ever speaking to this company. Young Fitness claims we should have contacted them after the first invoice however we truly had no reason for concern at that point as we believed the odd looking ad was a sample to demonstrate what they could provide if we wanted to employ their services (again because the ad did not match our company name, logo, or slogan). After the third time we received the 'invoice' we did try to contact the company via phone but despite a handful of calls at various times of the day, our calls were never answered. [redacted]
We feel very strongly that even after we received the first two 'invoices' we were not required to pay, as no one with our company had done or approved business with Young Fitness. Had this been a real business transaction that was handled in a professional manner we would have had ample opportunities to clear up this confusion, however we want to emphasize that this was not the case. They acted without our consent and went as far as to run this ad a second time without our consent, even after the first Ad was not paid for. [redacted]

The sales manager verified [redacted] was buying an ad in the publication along with the mailing address. A invoice([redacted]) was generated and mailed the following day (May 26th, 2015) showing how the ad would run at the time of publication(August 21st, 2015). A sales representative called [redacted] again at 1:45 on September 11th, 2015 asking if she would like to run the same ad in the Minor Hockey News. The ad copy was then sent on the bill by mail again on September 14th, 2015 after the week end(Invoice [redacted]). Publication of the 39th edition of the Minor Hockey News was not set until November 13th, 2015.
Why did [redacted] consent to running the ad the second time if she had no authorization ? Why did they pay invoice [redacted] if it was being contested ? Why was there no contact made to Young Fitness Inc. after receiving the first Invoice on the bill by mail back in May ? If there were any problems with anything, a simple phone call would suffice to cancel the ad before publication, which in this case was a couple months after the invoice date.
It wasn't until January, 2016 Jay had informed us of his concerns. I noticed in his Revdex.com complaint he also thinks he is advertising in Alberta. The ad for [redacted] was actually distributed through out eastern Ontario not any where in Alberta. We were also under the impression that [redacted] was paying the most recent invoice. A gentleman by the name of [redacted] had claimed it would be paid.
If the organization was unhappy with how we designed the ad, any phone call before publication letting us know what they want on the ad would suffice. Ample time was given in each scenario and a service was provided. [redacted] will need to remit the final invoice owing([redacted]) to avoid being sent to our out side collection agency.
