Review: We are trying to terminate our relationship with [redacted]. During my initial phone conversation with [redacted], employee [redacted], told me they would require a 30 notice of intent to cancel and completion of Cancellation Form 0-100 by [redacted] (official representative of [redacted], who originally signed the application). [redacted] faxed the form to us (3/4) and [redacted] faxed the form back to [redacted] the following day (3/5/13), signed but without the signature of a new processor. We are a seasonal business and have used [redacted] (online) and don't have a new official processor as we try to determine what is best for our company.

On 3/7/13 the monthly [redacted] fee of $20.20 was withdrawn from my business bank account ([redacted]), and on 3/8/13 [redacted] withdrew $255.60 from my business account. When we discovered the withdrawals we contacted [redacted] and spoke with [redacted] who told us that we were no longer clients of [redacted] and had no recourse. We requested to speak to [redacted], Chief Operations officer for [redacted]. When we did not receive a return call I called again 3/22) and requested to leave a voice mail for [redacted]. When we did not receive a call back again I called (3/25) and asked to speak with [redacted]. I was transferred to [redacted], who identified herself as Office Manager. She explained that because we had not returned the Cancellation Form 0-100 completed within 10 days they had charged us for 3 months of services and a $195 cancellation fee.

Nowhere on our original agreement or on Cancellation Form 0-100 is there reference to a 10 day limit to return the form, and we had a verbal contract requesting 30days notice to cancel.

[redacted] insisted that a 10 day limit was stated clearly on Cancellation Form 0-100 and requested us to fax the from we had received back to [redacted], which we did immediately. I received a call (3/25) from [redacted]. She acknowledged that there was no mention of a 10 day cancellation deadline on the Cancellation Form 0-100. She said that on the fax cover sheet they sent with the cancellation form it says, "please return within 10 days" and there is no other possible interpretation. We offered to fill out any required forms to avoid these hidden excessive fees. [redacted] told me that she would confer with [redacted] (she and [redacted] refused to provide their last names) and insisted that she had to talk with [redacted] directly. [redacted] called [redacted] (3/28). [redacted] told [redacted] that she had not yet reached a decision but required proof of our business history including the change of position of [redacted] from owner to her current position as consultant and authorized representative.

There is no indication in our agreement or cancellation form that we must provide a detailed history of our business to [redacted]. [redacted] was the original authorized representative who signed the agreement and is still the authorized representative trying to resolve this situation. We have repeatedly offered to complete any required forms to avoid these hidden fees and random deadlines. We have spoken to every level of employee in their office at least twice to resolve this predicament.Desired Settlement: We would like to provide [redacted] with a 30 cancellation notice and to provide the required Cancellation form information.

We want repayment of the fees they took out of our business bank account, including 2 months of service fees $20.20/month, and the $195.00 cancellation fee.
