I put this car on hold for six months and let [redacted] pay $400 a month until he reached $2,500 that is something I have never did...

for anybody else. I pulled the vehicle off the lot and inventory and held the vehicle for six months and let him make payments like we agree to. The day [redacted] picked up the vehicle which was August the 3rd, I gave him all of his paperwork and the vehicle did pass state inspection the only thing was Emissions the vehicle needed to be driven for Emissions. I explained to [redacted] that he can take the vehicle and get a temp tag from the DMV because with state inspection paper they will give you a temp tag but in 30 days when you have to get plates you will have to have the Emissions paper. I told [redacted] he can take the vehicle get his temp tags and drive it for a couple days and whenever he gets a chance bring it back to us and we will take it in for Emissions or he can go up to [redacted] Service out here in Saint Charles, which is where the state inspection and emissions was done and since I have already paid for it he can go up there whenever and they would check for Emissions. He was fine with that and I was okay with that too because I would never let a vehicle leave the lot if it was not safe and had not passed state inspection but it did. Two days later I believe it was Wednesday the 5th of August [redacted] called me cussing and and yelling saying the vehicle was not ready and that he should be given some money and saying he was going to sue me and how he has done this to other car lots before and won. I told [redacted] I can not talk to him if he going to cuss and yell and hung up the phone. Later that day my secretary called to tell me that he dropped off the vehicle and took his temp tag out and left. That same day he calls me and continues to yell and cuss saying he going to sue me. The very next day he came back with the police and tried to pick the vehicle back up, which I have the officers card that came in that morning with [redacted]. I told the officer he dropped it off and surrendered the vehicle and was yelling saying he was going to sue me. I am not going back and forth with him and he owes a balance on the vehicle and I explained everything to the officer. Then [redacted] came back again with an officer on Tuesday the 11th saying that he had the title and he wants the car back. I explained everything to the officer which I also have his card and the officer understood. The very next day on the 12th, (when we were not busy) we took the vehicle into [redacted] Service for Emissions and it passed. [redacted] also signed off on our Buyers Guide which states that he is buying the vehicle as is, but I still provide State Inspection and Emissions on all of the vehicles and that is something not all lots do. I am not going to have someone drop off a vehicle cuss and yell at me and my employees and then come back whenever they feel like it and pick up the vehicle. He signed a contract and owes a balance on vehicle and I told [redacted] that the first day he called me yelling. Below I have attached both State Inspection and Emissions. Please give me a call at your earliest convenience. I contacted the Missouri Department of Natural Resources and spoke to Allen in the Vehicle Emissions Inspection Unit Telephone#: (XXX) XXX-XXXX and he said by Missouri law a dealer does not have to provide Emissions but has to sell a vehicle that is capable of passing Emissions. Also the vehicle should pass within 10 days or 1,000 miles or the dealer needs to fix the vehicle so it can pass. I thought that is how it works because I have read this before on the Website for Missouri DMV and other places, but I just wanted to make sure. The vehicle also did pass with 10 days. It passed on the 12th of August and the vehicle was purchased on the 3rd of August but on top of that [redacted] bought it on the 3rd and he surrendered it on Wednesday the 5th of August. I know you are probably busy so again apologize for bothering you but whenever you get a chance feel free to contact me. Even know I know where everything stands because of the type of person I am, I am going to give the $2,500 back to [redacted]. It was something I always wanted to do originally but [redacted] was asking for more money for other things and that was something I knew I was never going to do. So [redacted] should receive a check for $2,500 I have already gave it to my Lawyer and they should be getting in contact with him so he can pick it up.
