I have reviewed the 3 complaints about my business, snow plowing contracts to be more specific. The complaints were filed on 1/5/2018 and the complaint ID numbers are as follows: [redacted]. Please accept this letter and photo copies of text messages as my response to these complaints. Furthermore,...

please know that I also met with the Assistant District Attorney regarding these clients. We have mutually agreed upon a refund in the amount of 50% of the original contract purchase price, as an act of good  faith. It was never the intent of my business to upset my clients in any way, shape or form. Due to a severe illness and a less than adequate, although highly recommended backup plow driver, there was a period of about 2 weeks between December 15, 2017 and January 1, 2018 that I was unable to perform the task at hand in a  satisfactory fashion to the above named clients. It is with the utmost sincerity that I have apologised and have done my absolute best to rectify these unforeseen yet unavoidable situations. Let it be known and acknowledged that there are both truths as well as untruthful accusations in the complaints in which you have received. However as a trustworthy and respected business owner, I have decided to move forward with the best of intentions and my current as well as future clients best interests in mind at all times. In closing, please feel free to contact me In the event that I have not given you enough information, or you have any other questions. Best regards, Brian Zoeller CEO, ZHS Enterprises

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. ZHS Enterprises/Brian Zoeller failed to apologize to us and did NOT do his "absolute best to rectify" the situation, as stated in his response letter dated January 17, 2018. They continually did not show up for the job that we hired AND paid for in full. It has continued to snow through the month of January and ZHS has still not plowed nor offered a reason why he isn't plowing now. He stonewalled repeated pleas to honor the contract and clear our driveway and sidewalks. ZHS unequivocally breached the contract and took took our money with no intent to earn it. ZHS acted in bad faith from the start. They've defrauded dozens of customers in our neighborhood, not just the three mentioned in the response. Based on the above, we rightfully request that 75% of our original payment to ZHS be refunded in the next 10 business day; that is $243.75.

I have reviewed the 4 most recent complaints about my business, snow plowing contracts to be more specific. complaint ID numbers are as follows: [redacted]. Please accept this letter as my response to these complaints. Furthermore, please know that I also met with the Assistant District Attorney regarding the clients residing in [redacted]. We have mutually agreed upon a refund in the amount of 50% of the original contract purchase price, as an act of good faith. Because of this decision, and the agreed upon refunds, the contracts are now considered voided. Which means, I am not and was no longer under contract with these clients after my meeting with the Assistant Attorney General. It is with the utmost sincerity that I am apologising and have done my absolute best to rectify these unforeseen yet unavoidable situations. Refunds will be issued by 2/15/2018 as instructed by the New York State Attorney General Office. Let it be known and acknowledged that there are both truths as well as untruthful accusations in the complaints in which you have received.
