Zia Automotive4907 Menaul Blvd NEAlbuquerque, NM 87110RE: Revdex.com Case
#[redacted] December 9,
2014  Mr.
[redacted] contacted Zia Automotive Pete’s Garage about the warranty repair of
his 2002...

[redacted] Suburban. We repaired his vehicle on July 2, 2014 and it had
189,627 miles on it. Now as of December 16, 2014 there are 200,478 miles on it.
In the last 5 months of 2014, he put 10851 miles on it. He said he called the
1-800 # for repair and was told the transmission part of his warranty was not
covered by them and they referred him to the selling dealer. We reached out to
the owner [redacted] at [redacted] to ask what failed and request pictures
at that time. They sent us pictures on Thursday, December 18, 2014 of Mr.
[redacted]’s transmission. They found it had burned up and wouldn’t move. We worked
things out with them to provide a Remanufactured Exchange Transmission. [redacted] said they had someone passing through Albuquerque who could
pick it up from us, and deliver it to them to go forward with the warranty
repair. It is still here at Zia Automotive Pete’s Garage. On December 22, 2014,
[redacted] called [redacted] at [redacted] in  to follow up on the issue. [redacted] said that Mr.
[redacted] gave him the ok to rebuild his transmission because he didn’t want to
wait for the warranty exchange – which has never been picked up. He decided he
didn’t want to wait for our transmission because [redacted] was
going to be closed the following week until January 5, 2015. On
Friday December 19, 2014 in the afternoon, Mr. [redacted] called me. After speaking
with the [redacted] Manager [redacted] in Albuquerque, he wanted to check on the status of
the transmission issue. I stated again that we’ve had a transmission here since
December 18, 2014 waiting to be picked up. I also explained again that we would
cover the warranty exchange, installation, and also give him $500 as a goodwill
courtesy for his troubles. Mr. [redacted] notified me he worked for [redacted] and said this should have gone quicker. I stated it’s not the same as
reimbursement for Car Insurance. It is a warranty exchange and our normal
process is to send out an Inspector to see what caused the failure and
determine if it was due to manufacturer defect, abuse, hot rodding, commercial
use, or tow abuse. Some of these things can void the warranty. In his case, we
worked with [redacted] to try to determine the problem. I educated him
that we received the pictures from [redacted] and made plans with
them to resolve his issue to replace his warranted exchange. At that point, he
stated he didn’t want to wait so he gave the ok to [redacted] to
have the repair done at their shop, because they would be closed the following
week until January 5, 2015.
I
reminded Mr. [redacted] that we have never stated that we wouldn’t cover the repair
under his warranty. We are a [redacted] Auto Care and AAA certified center, certified
with AARP, and accredited with the Revdex.com. We had everything already arranged to
replace his transmission under his warranty. He agreed with me, and stated that
his only problem was his schedule because they were going to be closed the
following week due to the holidays. I stated the warranty exchange doesn’t
cover his schedule conflict.
There
has not been any misrepresentation on the warranty. We went above and beyond
for this issue to get it resolved in another state, which falls under
nationwide coverage. Unfortunately, Mr. [redacted] told [redacted] at [redacted] to fix his transmission with their rebuilt transmission. They did
not use the transmission that is covered under warranty from [redacted]. Thank you, [redacted]

Complaint: [redacted]
I am rejecting this response because: Can we act like grown ups and stop acting like your the victim here. How can I bully the bullier? Your the one trying to put a deadline on this issue since you have nothing to loss. Im the one getting screwed for $450. Look man I appreciate you trying to work with me but I dont appreciate you making up stuff up. All i'm asking to go away is $1550 which is what I paid to get my truck fixed. Nothing more, nothing less. I still owe [redacted] $700 dollar for the 2300 that I paid your company to fix my truck which you were more than happy to take that money from me. In addition I took out a loan from my 401k to pay the additional 1550 to the mechanic shop. I have enclosed both statements to confirm this. So i'm expected to continue paying [redacted] my end of the contract at $100 a month in addition to my 401k loan at $60.55 twice a month and in addition to that be out of pocket $450.00.  Look man just send me a check for $1550 and get with [redacted] and the Transmission shop to get reinbursed for the diffrence. I'm a paycheck to paycheck father and husband and I know you dont care about that. But now im even more out of pocket and that is taking away from my family. Im not going to fight with you and or call you any names. I just want to get reinbursed for what is fair and what i'm owed.  [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the response. I am rejecting this response because:
Regards,
[redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the response. If the consumer does not provide a reason if he complaint will be closed Administratively Resolved] Its funny how filing a complain can get a total diffrent reaction from a business. When I talked to Mr [redacted] on Friday December 19, 2014, there was never offered or mention that they would provide me with $500 courtesy for my troubles. Mr [redacted] only offered to send me  the transmission replacement and he said that I would have to pay for time and labor myself. He said and I quote "i will not pay [redacted] to install your transmission". Now all of a sudden he offers $500 for my troubles and for courtesy. He is also putting words in my mouth that I never said and I dont appreciate that . He said that I said the following "Mr. [redacted] notified me he worked for [redacted] Insurance and said this should have gone quicker." I never once said this and I just explained to him that I knew how the process worked. I told him that if we fix a car and its not repaired properly then we fix the issue .. We dont make the customer got out of there way to get an estimate and then to accept anything less then fixing the problem at 100%.  Mr [redacted] is offering a partial solution which he belives is acceptable and I believe is the cheapest alternative. They could of offered to tow my vehicle to a Certified [redacted] location and handled everything within house. They decided linger and leave me without a vehicle. I have a family of 6 that I need to provide for and I cannot afford to stay home. I had to take out a loan to cover the expenses.  Now I have that loan for around 1500 and still owe [redacted] 700 for a warranty that never existed. I want my car's tranmission paid in full at 1550 and I want an additional sum for all this trouble that I have had to put my family through. I was sold a lie therefore it is a misrepresantion of what I was sold. Pete's Garage used [redacted] as a way to get my business by offering me a warranty that never existed. When I called [redacted] to report this issue on Tuesday December 16, 2014 he was under the impression that the transmission would be covered. You can confirm this by speaking w/ [redacted] the [redacted] person that works that area.  Nobody offered any solutions for me and I needed to get my car repaired. [redacted] authorized me to move the vehicle to a Shop of my choice to confirm the issue with the vehicle. Once the issue was confirmed they never offered to move vehicle into a [redacted] Certified shop. I did everything that I was told to do by them. Obviously as Mr [redacted] stated that the warranty doesnt cover schedule conflicts but he is not the one without a vehicle and in position to lose their job. So they expected me to wait till the following week and get their transmission but did not offer any alternative transportation. That is easy for a person to do when they have a vehicle to move around with. I have attached documents to confirm all the following. Do yu honestly think that I wanted to go out of my way to get a loan to pay for this? Do you think that I want to screw anyone over ? No I just want to get reinbursed for what I had to pay and all my troubles.   I'm tired of all the he said this and he said that .. Please I just need someone to step up and make this right.
