First and foremost, Zia Suns would like to apologize to the customer for how long this process has taken This system we installed in one of the first in Las Cruces and I believe the first in all of NM Since we were the first company to take on this endeavor, we asked VSP (the generator manufacturer) to aid us in the technical support that would be required to install this system VSP agreed and stated they would be with us every step of the way of the installation process During the installation, not only was VSP not available to us through tech support as promised, but we were forced to subcontract another company to help us through the install process The City Inspector even stated that he did not like the configuration of this system and that it was a difficult learning process for all of us to work on this unit When we got the system installed and up and running, it worked fine for awhile The customer notified us that the generator was not working properly and we immediately took the proper steps to rectify the situation We were in contact with VSP to try and resolve the issues we were having, when the unit completely stopped working I notified VSP when the unit did not respond to the testing VSP asked us to complete and they stated that we could ship the unit back I notified the customer and the customer stated that she felt 'fearful' about having the wires from the solar panels, the grounding wires and the power plug from the transfer switch all disconnected and laying in her garage I tried to explain to her that there were no safety concerns and that it would only be a short time to have them like that I in turn, emailed the VSP representative "John" and explained to him the situationI was attempting to get VSP to send out a new unit without having received the defective, so that I may calm my customer's fears about the wiring I was notified via email on July 8, 2016, by "John" that they had to receive the defective unit prior to a new one being shipped out The defective unit was shipped by Fed Ex freight on Tuesday July 19, We are awaiting an answer from VSP on how to proceed We have every intention of correcting this wrong and again, we sincerely apologize for all the issues this causedAnd once the new unit, arrives, we will gladly install it for Ms [redacted]

This complaint has been handled through communication with Zia Suns Green Construction CoLLC and the reporting parties, [redacted] and [redacted] There was a miscommunication with [redacted] (the company in charge of the trash receptacle) about the service address for removal of the dumpster that has been cleared up and handled The trash receptacle was promptly removed from the [redacted] s property once the error was fixed, along with any other debris The [redacted] s were also reimbursed the fifty ($50) dollars for replacement of their satellite dish Zia Suns Green Construction CoLLC has formally apologized to the [redacted] s for the miscommunication in regards to the trash receptacle and for the mistake of our subcontractor in regards to the satellite dish This complaint has been resolved by both parties

First and foremost we take great offense to you thinking that we are criminals that should be in "jail." Eddie G [redacted] nor I, did anything wrong other than have trust in our so-called partner [redacted] But let's back up here a minute. You, [redacted] , contacted us to... purchase solar for a home in Los Alamos, NM that you were in the process of buying. We had several conversations via email, before meeting in person and not once did you ever express concern over our integrity and work ethics. You accepted our estimate and signed a contract with us for $13,800 for a solar installation in which you paid a 70% down payment. You made the down payment the first week of June, 2016 and your materials were delivered to your house on June 16, 2016. If we were criminals as you imply, I don't believe there would have been such a fast turn-around with the material delivery. Materials that sat in a driveway for months while you worked out your issues with the mold remediation. Materials that also had to be moved to a storage unit because ultimately you were unable to purchase the home. Subsequently, we traveled to Los Alamos numerous times and aided you in the house hunting process, even looked at potential homes to give you assurance that the solar system you purchased would work. Not once were you back-charged for the time and travel costs associated with this. We did all this all the way until November of 2016 when you finally settled on a home - doesn't sound like criminal behavior to me? When you finally settled on your home, we submitted the application to the county, which took a long time to process the permit. May I mention that during this time you also used your law enforcement background and offered to "rattle cages" to get the "incompetent mns at the county" moving on your application process. I've worked in law enforcement myself for several years (someone with a criminal history cannot do this) and I recognize someone who likes to abuse their power. Not once during this entire process were you ignored, not communicated with and not continuously kept in the loop. Not to mention that once the system was installed, we received a GREEN TAG from the State inspector. We both have a copy of that tag. My so-called "partner" [redacted] was ripping us off the entire time. [redacted] , who you praised multiple times and even thanked me for sending, was one of [redacted] 's employees. When you made the down payment for your basement, [redacted] had already been ripping us off considerably, but covered his tracks with a myriad of lies. In reality, [redacted] took your down payment and used it to do illegal work under an illegitimate company that we were not aware of until June, 2017. Eddie and I were noticing that money kept going out for "materials" and "labor," but nothing was ever brought back into the company. [redacted] used [redacted] , knowing he had no licenses, as cheap labor. [redacted] was and has been an accessory to all the illegal activity that [redacted] has committed and was even arrested for stealing one of our trucks. And we now know that [redacted] had been and continues to work and interact with [redacted] and we have every right to believe [redacted] intentionally sabotaged your installation. We appreciate the fact that you have filed an investigation with Construction Industries, PSI, etc. We launched an investigation of our own when we found out about [redacted] ' illegal acts, so your investigation should aid both of us. Again in June, 2017, Eddie was hospitalized nearly dying and had his whole professional career ripped from under him. [redacted] went to the State and told them that we were closing the doors to the business (which he had no authority to do), opened up [redacted] and is still claiming Zia Sun Green Construction as his company. We have been relying on the State of NM, CID, PSI and whomever else will help us get [redacted] ' contractor's license revoked. I receive calls daily about people [redacted] has done work for stating that they had a poor job done, they have not heard from [redacted] since giving down payment, etc. Even after my husband nearly died, I had every penny taken from me and my life was in shambles; I was still trying to get your job finished. I drove to Los Alamos with the last $100 I had, with my 2-year old and my 13-year old because I am not a liar or a thief. If we had intentionally "stolen" your money as you imply, I would not have done that to try and keep you as a customer. We are not criminals that deserve to be jailed. We are hard-working, honest people that had a criminal working WITH us!! We almost lost our daughter at birth, there is no way in hell we would ever steal from someone, especially from a child. I am just as sickened at the lack of urgency on behalf of CID to revoke the license of [redacted] and force him to pay restitution to the customers he embezzled from. I have the documentation to prove it all, but it seems like the State enjoys dragging their feet. So in short, you are owed a refund of $15,000.00 from [redacted] and you have a remaining final balance of $4K that was never paid to Zia Suns at the time of green tag as agreed upon. I believe the amount of the final balance owed to Zia Suns is more than enough to correct any issues intentionally caused by [redacted] to your solar system. I'm hoping that we can both aid one another in getting the real person who deserves to be in jail and that's [redacted] *** [redacted] and all his shady cohorts. Brandy and Eddie Garcia

I am rejecting this response because:The system is not working yet.  If leave it to their own resources, they ignore me.  Yes, I knew it was a new system, but  he assured me he could do the work and would have it done by EOY 2015.  There have been repeated times when nothing would be happening for weeks on end.  I don't believe the unit worked for even a week after the inspections took place.  It took some time for someone to come, and then she tried to fix it.  Once they knew that they until was not going to work, they took a long time to ship it back.  Yes, I am concerned about live wires coming into my garage, but they just needed to let me know how they would re-mediate that.  The unit could have been shipped a month to two months earlier.  Thank you to the Fed Ex driver for being willing to use an extra pallet from his truck, and doing the work to secure the unit to it, so that I didn't have to wait even longer for the unit to be shipped.  He could have just said it needed to be prepared for shipping, and to call him when it was.Now. I wait and hope the new unit works, and is shipped in a timely manner.  I also would like to know what went wrong with this one.  I don't want the new one to only last a week, and we start all over again.
