Zia Townhomes

Hello,In January a Zia Townhomes manager finally responded to my complaint of cigarette smoke by speaking to the neighbor I believed was the source of the smoke entering our unitI had seen a middle-aged man smoking in this woman's garage in SeptemberAs I understand it, the Zia manager has stated that the neighbor denies that anyone is presently smoking in her unitThe manager also reports that he found no evidence of cigarette smoke in her townhome. On approximately January 27, 2016, the cigarette smoke entering our home became so heavy, pervasive, and persistent that I was forced to leave and live elsewhereAs of February 17, my mother who still occupies the townhome reports that smoke still enters our home dailyBecause of the severity of the cigarette smoke inside our unit I am currently living elsewhereNo further action by Zia Towhomes has been taken to resolve the problem.Additionally, Zia Towhomes has verbally declined to renew our lease in August on the grounds that I left "threatening notes" on the alleged smoker's doorIn actual fact the notes I left do not constitute harassment but are a legal form of notice as they do not threaten physical violenceI have left no further notesAttached are typed copies of the handwritten notes I leftPhotos of the notes are also attached as well as a copy of the Zia lease.Zia Townhomes is obligated to resolve the persistent cigarette smoke in our townhome, a green and non-smoking property, and to renew our lease in August if we choose to seek it.Thank you,*** ***

Zia Town Homes has done everything in our power to rectify the complaint. Prior to the complaintant  moving in, we agreed that we would do our best not to put smokers next to their adjoining unit and that if for any reason smoke became an issue, that we would allow them out of their lease...

without penalty. We have upheld our agreement and even evicted a tenant next to them whose son would Smoke when he was visiting. We have supplied the complaintant with an ozone air purifier and put in special filters in their unit to further improve the indoor air quality. Our townhouses are LEED Platinum certified which is the highest Green-Build achievement obtainable. One aspect of this is that our ducts are not connected to neighboring units; therefore, smoke can not enter into adjoining units if someone is smoking inside. Our Townhomes are designated smoke-free inside; however, smoking is permitted outside and smoke may infiltrate units from the outside vents. We issued the complaintant a 3-Day Notice on the basis that she was harassing other tenants trying to get them to sign a document saying they smell smoke inside their units, and asking them if they are smoking and even looking into other tenants windows to see if they were smoking. The complaintant left threatening notes on another tenants door saying she would do everything in her power to get her evicted if she didn't stop smoking. The complaintant indicated that she would stop harassing the other tenants and we again reiterated that she is free to move without a lease-break penalty if she is not happy in our Townhomes.
