Review: I met with [redacted] in early April to bid a project. I explain to them the importance of getting this job done by late May so I could put the house for sale on the market. They agreed and understood the importance of timing to us.I received their quote and hired [redacted] to do the landscape project back in early May, 5/01/13. I deposited with them 35% down ($935) on the amount of the total project as earnest money. [redacted] Landscape committed to completing the job within two to three weeks. My brother [redacted] called them several time the third week of May, 5/20/13 for a status.They committed that the project was slated for the following week. The week of May 27 and again several calls only to be pushed out again on their schedule to the first week of June. My brother [redacted] called several times again the week of June 3rd. Again they continue to stall with commitments to complete the work that week. [redacted] landscape lie to us several times in regards to their commitment to complete the job. Their level of commitment, integrity and honesty is questionable. They should not be making commitments they can not keep.I have cancelled this project with notice to [redacted] as of June 17th, 2013. We are now waiting for our refund. [redacted] has retained our money for two months now. We had to delay the sale of the home due to this dealy in landscaping.Desired Settlement: I liked the the Revdex.com aware of our dissatisfaction with [redacted]. A record should be noted. In addition [redacted] should provide a refund immediately.

We have received your letter and have read the complaint filed by [redacted]. We do agree that we met with [redacted] brother) on site in April and received his down-payment to be put on the schedule on May 6th, 2013.

This is standard practice for Ziegler’s Landscape by Design. Once a sale is made, the down-payment gets the job on the schedule.

As you may know, the spring of 2013 was the wettest spring in years. In the landscaping business, this affects timing of jobs. We were aware that [redacted] had a house that he wanted to put on the market, however, weather is a factor that

is out of our control.

We talked to [redacted] several times from the receipt of the down-payment until we cut the check back to Tony as a refund on 6/17/13. In all of the conversations, we expressed our apologies for the delays. [redacted] job (I have included a copy

of the estimate) consisted of sod and seeding work. This is impossible to complete with the amount of rain that we received. The seed would have washed away due to the constant downpours we received and also our sod supplier was unable to cut

sod during the entire month of April and May due to the wet conditions.

When [redacted] called to cancel the job on 6/17/13, the refund check was cut the same day and sent to his brother [redacted], in Brookfield, WI. From our bank records, the check was cashed on 6/26/13. The amount of the down-payment and refund was

$910.00 not $935.00 (just for clarification).

We see that he filed this complaint on 7/4/2013. The refund check had been cashed 8 days prior according to our bank.

We are disputing that we lied to them. They would call and we would let them know the status of the job at that time. We feel that this complaint is with-out basis. We had received other down-payments for jobs which were delayed due to

weather as this job was and we received no negative feedback from them. We do everything in our power to make the landscaping process as stress free and enjoyable for our customers as possible.

We understand their situation but also hoped for understanding on our end as well. We are very concerned on how this complaint is handled since we do not want a bad mark on our company at the Revdex.com. Please get back to me if you would like to discuss the matter further. Review: First, please note that although the listing is under Markgren Landscape, the contract letter head reflects Zieglars Lanscape by Design, Onalaska, Wi. I contacted this business back in March of 2013 to discuss a job in Tomah, Wi which is our parents property that my brother [redacted] and I had been preparing for sale since they are now deceased.

[redacted] fron Zieglars met my brother and I at the property the first week in April of 2013 to review the scope of work. We explained to [redacted] the situation and to get the job done as soon as possible since we had to get the house ready to place on the market [redacted] reflected 2to 3 weeks once the snow was gone.

We received a quote April 9 and executed the contract May 2. Deposit was made May 5 for 35 percent of the total or $935. We had in writing and verbal with [redacted] at the office with [redacted] (owner) support that we were 2to 3 weeks out in the schedule.

On May 17 I called for an update and was told May 23 was the date to do the job. On May 22 I had to phone to get a status and was told by [redacted] due to rain we were now scheduled for the week of June 3. The week of June 3 came and we didn't hear from Zieglar's. I had to contact [redacted] again on June 11 for a status and was told more delays. Despite being told we were the next job it was never completed within the week.

Their website reflects commitment In addition their verbal and commitment in writing when we emailed the contract reflected 2 to 3 weeks. [redacted] never bothered to call me for an update and I had to call them numerous times for an update. My brother [redacted] and I lost 6 weeks since we finally had to source another company after several attempts to get [redacted] to honor their contract. These delays have had an impact on our ability to list the property on the market. At the same time [redacted] retained our deposit and continued to promise to do the job.Desired Settlement: We request a refund immediately. In addition, the business should not be allowed to contract work they cannot do and take people's money and hold it for over 2 months. We would not recommend this business due to their unethical practices which the State of Wisconsin needs to take action. This also caused significant stress on myself and my brother to get the house on the market meeting deadlines and loss of opportunity to sell. In addition to the refund check we are seeking a settlement for the delays,misrepresentation of services, and holding our money beyond the committed services to be completed.

We have received the complaint from Mr. [redacted] and are again sorry for theinconvenience that the [redacted] brothers have gone through getting their family home on the market in the spring of 2013. We had every intention to complete the work as recorded on the attached contract. As you can see on the contract, there is no promised date of completion. There was a verbal discussion about when the work was to be done. However, we cannot control the weather. Instead of repeating myself in this correspondence, I have attached our I SI two responses to this issue. Please don't take this the wrong way, we are not making light of the situation. We are not happy about this. We have never had a case go to the Revdex.com. I feel a need to address the desired settlement. We refunded the down-payment the same day that we received the cancel letter. The check was issued on 6/17/13 and cashed according to our bank, on 6/26/13. [redacted] filed his complaint on 7/4/ 13. The check had been cashed 8 days prior. Now [redacted] has filed his complaint on 7/14/13. 10 days after [redacted]. The check had been cashed 18 days prior but is still mentioned as being held. I hope that you understand our situation in this case. We are not happy that a customer is dissatisfied but at this point we feel that there is nothing else that can be said to make them understand that in the landscaping business, weather has to cooperate to stick to a schedule and unfortunately, that did not happen here.

We are very sorry for the inconvenience that Mr. [redacted] has gone through. We had every intention on working with them to complete what had been agreed upon.

Nothing that happened was intentional nor were we ignoring [redacted] phone calls. The problem lies in the schedule and rain.

We install sold jobs according to sold date (1st come, 1st serve).

Once the job is sold and the down-payment is received, the job gets put on the schedule. We had sold several jobs before receiving the go ahead for the [redacted] job and some were very large jobs which we were installing during this time frame.

Every day that we received rain slowed down the process. This means that every job scheduled after the current active jobs, were pushed back. We never start a job and leave it to start another one. This is common courtesy for all customers that we work for.

In the service business such as ours, we have a schedule that we follow however, if Mother Nature has other plans, (rain, snow, etc) she always wins.

We are not making excuses. We are simply saying that our hands were tied. We are very happy that the [redacted] job is complete and they can put the property on the market as planned.

I do think it is unfair to have a bad report at the Revdex.com because of this situation. We can only do what we can do about the weather. Once the job was canceled we immediately sent them a refund of their down-payment. It was sent the same day to be exact.

[redacted]'s brother, was the point of contact from the initial meeting. We never received any indication from [redacted] that we would be at this place today with the Revdex.com. He understood what was happening so it was a bit of a surprise. Again, I do understand the time crunch that they were under, but that still doesn't warrant extreme actions.

I would hope that the [redacted] would understand our situation. We never meant to make them feel slighted in any way.

We are a professional landscape company and strive to leave our customers satisfied with the landscaping process. Unfortunately, in this case, that did not happen and we are very sorry about that.
