I would like to start by saying that *** Building Systems, llcdid in fact , build a Deck, located at ***Lakewood XXXXX
Ms*** has claimed that the Gutter System has failed as a result of our installation of the Deck
and has resulted in a basement flooding condition
The first thing that I would like to point out is, we never remodeled or adjusted the existing Gutter System or its downspoutsWhat we did do, as a result of the Deck being built over the location that the downspout terminated, we put on an extension to the downspoutThis extension to the downspout was planned out by, both customer and contractorThe termination of this extension was, in fact, specifically determined by the customer (***)At no point, was there any flow restriction that was caused or created by *** Building Systems, llcThe fact is, that this years abnormally record rainfall and density of this rainfall has contributed more to this flooding issue than any other system failure
Furthermore, *** Building Systems, llchas yet to be fully compensated, as per contract, for work performed on this projectA balance of $ 2,has not been received since completion, as promised

*** *** in fact removed our gutter and replaced and assembled a NEW one that went underneath the deckIt WAS replaced by *** *** and held together with duct tape, so it was indeed the workmanship of *** *** that caused our house to floodWe have a professional flood specialist come out and do readings on all walls and has documented the reason for the flood was the faulty gutter that *** *** replacedAll the other walls in the basement were fine and didn't need to be torn outI also have documentation from a gutter specialist that agrees that the reason for the flood in our house was the gutterI also have video documentation and photographs that show the work that *** *** did was incorrectly done and was the primary reason for the floodI did not see the work or agree to a duct taped gutter system that he put inThe deck was assembled by the time I got home to approve the work
As far as the unpaid work for the deck- I tried on (three) separate occasions to pay *** ***He made an up sale on our deck that increased the initial quote in which he claimed to take credit cards for the rest of the paymentI only agreed to the upscale if I was able to put it on a credit card since I had in my possession the amount that was quoted for the deckOnce the deck was completed, I paid the amount I promised to pay and handed him my credit card for the remainder of the payment and he said that he didn't have the means to take a credit cardI told him that I can pay him when he has the credit payment system in orderOn (two) other separate occasions after the final payment I tried to pay ***He came to my house and wasted over minutes of my time trying to get his credit payment system in orderI was not about to chase him down to pay the remainder since I had already tried times to pay this manIt was up to him to contact me for the rest of his payment, but I never heard backNow, I have no intention on paying himAs far as I am concerned, he has to take responsibility for the destruction and rebuild that has to be taken care of due to his faulty work
If you want to run your own business, you should be able to back up your workThis man claims to do so and talks a big gameIn reality, he runs an uninsured business and should not be a contractor if he can do business right
