I was hired on July 19 2016 to remove a existing walkway and replace it with a stamped landing, steps and walkway along with removing all stones around pool area and pour a concrete pad leading up to existing concrete pad. On July 30 I sent Mrs . [redacted] a picture of a walkway I had just finished...

stamping and asked if this was would she would like and I quote "i do that would be great". After pouring and stamping her front walk way, I received a email on August 7 2016 about her concerns about some cracking on the steps. I told her it was part of the concrete process and that the concrete set up on me very fast and that I would clean it up as I was not finished yet. So to help repair the cracks I used the same colors that were in the stamped pad she liked which was a Increte sand color hardener and charcoal antique release to hand fill each and every crack as a knowledgeable contractor would so as for her comment about 2 yr old paint, I used a proper filler to seal the cracks. Also referring to her comment about the step not being stamped in (he picture you can clearly see a brick stamped finish along the sides and edge of the step, the step also is stamped with a textured finish as it was to narrow for a traditional stamp to fit. To address the concrete around the pool I removed all the stones,dirt and grass. I then used that same space to squared up and form for the concrete around the pool as photoed below.  As a result of the pool being so close concrete dust was subject to get in and on everything in the surrounding area, I do not feel like this is a sign of poor workmanship as I can not control the wind to stop dust from spreading. After tamping and getting my pad ready it was brought to my attention that the concrete near the pool was not properly tamped, so I had to use extra concrete to POUR UNDER EXISTING PAD before I could even pour the new pad, to help stabilize it. *l DID NOT CHARGE EXTRA FOR THIS NEITHER DID I WHEN, I REMOVED AND POURED NEW STEPS LEADING INTO GARAGE DUE TO 10' DANGEROUS STEP THAT WAS NOT UP TO CODE *.  Again concrete set up fast due to weather and did not finish as smooth as I would have liked, Pad was a brush finish and was poured in the exact as spot as stones where after being removed. As shown in picture below. So regarding her comment "He poured up to my fence and contractor is worried fence will come down" That is not relevant as I did not jeopardize that structure of the fence in anyway. All I did was simply pour concrete where I was asked and where the stone went up to. There was a bit of concrete on the very bottom that was on fence due to location of where the pad was poured I used a pressure washer to clean fence. And in regards to her comment about me ruining her hoses but yet I "didn't do any clean up at all". That in its self shows she is being dishonest because if I did not in fact do any clean up I would of certainly not of being using any hoses. I bring my own pressure washer to clean up my jobs however I do need to use the customers water spouts, I could not remove her hose from her spout as it was rusted on, I then hooked her hose up to my presser washer to clean. Dust and concrete mud may have gotten on the hose but there is no way concrete was in her hose as the concrete was poured and dried and we are to use the concrete trucks hose to add water or to clean off tools when they are present. I completed the job August 9 2016 her father was there the whole time to observe me and when finished he then paid me. I left town August 12 2016 and was gone for 9 days. I received not one but 3 calls from Mrs. [redacted] lawyer telling me I needed to respond to her asap to avoid any legal actions. When I returned home Sunday August 21 I had 2 emails from Mrs. [redacted] complaining of several different things then she did in this complete. Monday August 22 I called my attorney to ask them there opiaion of the situation after being harassed by a customers lawyer and was advised to meet with them and not communicate. I then received several emails from Mrs. [redacted] threating me that I was to give her a full refund or she would being suing me. Due to my attorneys schedule I was unable to meet with him personally BUT he was given all the photos and details of this job along with this notice. NOT ONCE did I ever state in any emails I would not find a way to find a solution for this problem and I always disclosed my attorneys information for her to call if she ever felt I was being dishonest. If Mrs. [redacted] would had simply called and stated she had some concerns and would like to discuss them with me personally I would of without a doubt went and helped her. As customer service is very important to me and I thrive on verbal referrals (which is how she heard of me) But due to the harassment by her lawyer and the several threatening emails (as shown below) I was and still am to this day being advised by my attorney to not respond. If Mrs. [redacted] would like to contact my attorney and find a solution I still would be more then willing to work with her. Mrs. [redacted] has I feel lack of any physical proof that I did any un workmans like work at her property and if anything I did more then what was in our agreement without extra cost and if I wanted to, I still could bill her and ask for that to be paid due to when you sign a contract with my it states and I quote * any alterations to the worked listed above will result in extra cost*. To make it more clear how common cracks are in any type of concrete work I simply [redacted] "is there a 100% to to keep concrete from cracking" and printed off the first article about it. I have been pouring concrete since I was 12 yrs old my experience has even led me to pour Government NRCS projects. I feel Mrs. [redacted] is not inclined to a full refund, or any refund for that matter as my work was done in a workmanship matter. Clair Zimmerman Zimmerman Contracting LLC
