Zing Title Agency Response • May 13, 2019

It us the customary practice of Zing Title to provide the seller of real estate with the option to receive the sale proceeds either in the form of a check or via a wire transfer to the seller's bank. In this transaction, the complaintant elected to receive her sale proceeds by check. Prior to delivery of the check, the complaintant was advised that because the check was for a large amount her bank may place a hold on the funds and the funds may not be available for use for up to 15 days. Despite this possibility, the complaintant elected to receive a check for the proceeds of sale.
Zing Title was notified of the problem with the first check by the complaintant on April 2nd. That error was acknowledged by Zing Title and Zing Title again gave the complaintant the option to either have a new check issued or to have the sale proceeds sent to her bank via wire transfer. It was again explained that the funds would be available quicker if sent by wire transfer. The complaintant requested that a replacement check be issued and that an employee of Zing Title travel to a branch of her bank and deposit the check into her account. Zing Title followed the complaintant's request and the check was deposited into Ms. account on April 2nd. The banking records of Zing Title show that the check cleared the account of Zing Title on April 2nd.
The complaint states that the funds were not made available to the complaintant until April 15th. This delay appears to be the result of the internal procedures of the complaintant's bank and not the fault of Zing Title. Zing Title has offered, and remains willing, to reimburse the complaintant for any fees charged by her bank as a result of the error in the first check. To date, the amount of those fees is unclear and has not been substantiated by the complaintant.

As I stated, 1st Check that I Deposited on XX-XX-XXXX did not Clear because of someone on their end put "Refer to Maker". Nothing was done afterwords from the Zing title to provide reimbursement for the fees incurred or the pain suffering and humiliation from bounced rent check along with several other bills. Each of these companies charged me fees as well from $30 - $100 apeice but all Zing title did was write another check only after I complained for several days but the damage was already done!!!

Zing Title Agency Response • Jun 04, 2019

As previously addressed, the delay in availability of complaintant's funds appears to be the result of customary internal procedures of her bank and not as the result of error by Zing Title Agency. The complaintant was advised on multiple occasions that such a delay was likely and could be avoided through use of a wire transfer. The complaintant refused a wire transfer on each occasion and Zing Title Agency followed the direction of the complaintant in delivery of a check.
The documentation provided requests compensation for fees incurred as a result of the unavailability of funds. Even in the absence of error by Zing Title Agency, it appears that the complaintant's bank would not have made the funds available to satisfy the drafts listed in the additional documentation. As the unavailability of funds is attributable to the practices of complainant's bank and not Zing Title Agency, reimbursement of those fees is declined.
Zing Title Agency remains willing to provide compensation for a fee charged by complainant's bank for the return of the first check.
