The following email copy is directly from my email archive that was sent to *** *** I spent considerable time trying to resolve this issue The facts are:
1) The item is not plastic but rather a bi-cast leather product To lower the cost of manufacturing the hide is
split and laminated to another product It is however, manufactured by a well known vendor and has strong clientele These pieces were sold in *** * *** *** *** * *** *** *** and others
2) Industry standard is months pro rated warranty This is mainly due to the vendor not being able to know how the products are treated, cared for, or the conditions that they are kept in
3) I did negotiate for the customer an option to select product from the online showroom with options First option is to take the current sale price of 40% off retail and to subtract a prorated dollar amount to end at the final replacement cost Second option to pick any item or items from the online catalog and I will offer them at wholesale cost less 7%
It is an unreasonable demand to ask a retailer for a cash refund after years of use The product was not sold as a lifetime warranty or lifetime replacement itemNor did we offer an additional warranty
I still honor our offer and/or any option that will allow our company to provide product to the customer in some manner of an exchange for goodsPlease communicate your position on this matter so that we can understand the Revdex.com policy on consumer complaints of this nature
Sincerely,

***,
Thank you for being understanding to allow us time to resolve this issue with the manufacturer.
I have spoken to the Manufacturer multiple times regarding the claim for the Franklin chairs. The manufacturer's warranty full replacement policy is year and partial for years. Our records show these were purchased in or years and therefore, is not covered. However, I have been working with the manufacturer to find a resolve since this is a unique situation.
Based on these discussions, we can offer options: 1) A prorated credit based on the original price less tax and years of service - good towards new club chairs found on our online showroom. 2) Or a more flexible offering - A one time purchase price at Wholesale cost less 7% on any stock or custom order found on our online showroom.
Our online showroom will have all selections of club chairs www.zingerhardware.com http://www.onlinevirtualwarehouse.com/?i=31&wk=r6KRe39L
Our continued efforts to bring good value is shown by our current online offer of 40% off retail. Keep in mind you will receive either a credit towards your purchase or a cost that represents wholesale less 7%. Either offering is substantially better than industry standards for warranty beyond months
I appreciate your patience and look forward to helping you select new products that will create a fresh feeling to your home. Please, start the process by selecting an option from the online showroom and I will start the process to calculate actual residual cost.
Tax of the initial amount will not be applied. Based on the legal requirement, the remaining amount will be taxed. However, I am willing to wave the full taxable amount.
Sincerely,
***

Complaint: [redacted]
I am rejecting this response because:
We were sold "leather" chairs, and it has become obvious the chairs are not covered in leather. [redacted] continues to insist they are covered in "leather bi-cast product" defined in his latest Revdex.com response as "hide split and laminated to another product".
That the manufacturer may have a great clientele, the chairs are sold in several places and other such "facts" have no bearing on the real fact that Zinger Hardware sold us "leather chairs" that in reality are vinyl chairs. That is is the real issue that I intend to pursue as long as it takes through all means available to me. [redacted] continues to insist in writing the chairs are covered in leather bi-cast product. I believe these statements and the original sale transaction to be deceptive. I have complained about the vinyl covering bubbling up and peeling off for months only to be told the chairs are leather and it is common in the market to call leather bi-cast product leather. We did not even get leather bi-cast product; we got vinyl that has bubbled and peeled off.
I offered to accept a refund of one-half the purchase price, but instead have been offered the opportunity to buy more chairs from Zinger. I don't want to buy any more chairs from Zinger because of the experience we've had with the current chairs and [redacted]'s response to the problems.
Alternatively to my offer to settle for one-half of the purchase price, I will agree that if the chairs are covered in leather as [redacted] insists, I will drop my complaint and suffer the full loss, but if it is found that the chairs are covered with a vinyl or plastic material and not leather, [redacted] will refund my full purchase price. I will peel off some of the cover material and send it to [redacted] to inspect.
Regards,
[redacted]
