I received the information from Mr [redacted] .First off, per Mr [redacted] ' direction, the siding was not to be completed until the deck was stainedDue to the cold weather and snow that was sitting on his deck, it couldn't be stained until AprilHis claims that we were supposed to start the siding in January are completely falseI have emails and text messages from him that I can provide showing he did not want us to start the siding until the stain was completed on the deckWe began the siding project the end of JuneThe crew that was on the job wasted more material than they should haveThey also left trash and debris at the home that the should not haveThe crew was also upset that the home owner loaded trash (old fence posts) into half of their dump truckThey pay for waste by the pound, so they were very upset that Mr [redacted] did thatThey wanted to charge us more money and didn't complete the work they were supposed to the day after he loaded their dump truckWe fired them from the job because of their behavior and lack of performanceI ended up paying the extra $our of my own pocket that the crew charged me fore the debris he loaded into their truckBecause they wasted and excessive amount of material, we had to order more more materialWe ordered a standard 10% amount of material for wasteThe claim by Mr [redacted] that we never brought the extra material is completely falseI'm surprised that Mr [redacted] is surprised more material had to be ordered; especially after he requested that some areas be re-done since they weren't done to his likingI paid another crew to come in and repair what he wanted doneMr [redacted] 's claims that calls and texts went unanswered are not trueAll but one of his calls were returnedWe would be more than happy to provide call logsAt this point we would be more than happy to release him from the contract for the barnWe expect to be paid for the siding and guttersMr [redacted] seems to be defending the crew that was out there initially, but his wife told me when I was out there after they started that she didn't want them to come backShe complained about their lack of cleanup and disregardIt's hard for me to deal with a situation when I'm getting conflicting information from both home owners

Yes, we need siding issues corrected, some siding needs to be replace or repaired as follows: 1) siding next to steps on study 2) siding on fireplace / study by gutter 3) trim under deck still has old siding showing 4) trim around east corner and hang over needs fixing 5) several corner pieces are cut too long or too short 6) several window corner pieces are cut too long or too short 7) the south and west wall has some gapping in the siding pieces which are cut too long or too short causing bowing of the walls Sincerely, [redacted]

We contracted with a company called [redacted] in July of They offered referrals for [redacted] and [redacted] customersWe were instructed to complete the repairs for their customers and were promised to be paid within 7-days after completing the jobBeginning in late September our payments were delayed, or not made at all from the [redacted] We had payments in a row that we were expecting to receive that were not madeOn October 8th, after the 3rd missed payment, we notified the [redacted] in writing that we were quitting the program and would no longer be a part of itAt this point, we had completed [redacted] ***'s roof, but still had not been paid for itWe refused to complete anymore work until we received payment for the work we had completed on the roofThe [redacted] refused to pay us until the second week of February of This was nearly months after completing the workAfter the payment was received, we were still short the payment for the deductibleWe were instructed by the [redacted] ***, in writing, not to collect the deductible because they would.It is now the end of May, and we still have not received the deductibleWe have been told it is being mailed to the [redacted] ***, but we still haven't received itWe have notified the [redacted] different times about not being paid the deductible, and we continue to get ignoredWe refuse to call in the final inspection the permit for the roof until we receive this paymentWe very easily could have filed a lien on this home because of the outstanding balance, but didn't because we didn't feel it was fair to the homeownerThe only leverage we have at this point, is to refuse to call in the final inspection until we are paid the deductible that we should have received in October of 2016.Once the payment for the deductible is received, we will call in the final inspectionUntil then, we will pressured into calling in the final inspection so the owner can sell the homeIf the home is sold, we have no recourse.If we do not receive payment for the deductible by June 2nd, 2017, we will file a lien on the home

I am rejecting this response because:On August 8, 2016 I sat down with [redacted], and clearly outlined that I would be deciding between his company, Zio Roofing and a competitor. I gave him the exact bid from the other company and I was told that figure was in line with what he could do. “A difference of “over $8,000” that [redacted] refers to includes depreciation that is not paid out by insurance initially. [redacted] falsely claims that I made the following statement, “The only document I signed was so [redacted] could get more money from the insurance company”.  My statement on Jan. 11, 2017 at 12:08pm was, “The signature I gave was a form [redacted] asked me to sign so he could speak with [redacted] at [redacted] regarding what he described as ‘a calculation error related to square footage where a decimal point was put in the wrong place.’ I understood him to say it was likely not a problem at all but he needed to speak with him regarding it so it could be corrected.”To date, the job Zio Roofing began install on 9/27/16 remains unfinished. My only intention has been to see my roof completed by 9/20/16 with quality workmanship that I was told would be done. On Jan. 11, 2017 at 12:08 pm I emailed, “I have stated several times that when the work is completed I am more than happy to get the final payment to you…I was told by [redacted] that no payments would be collected until all work was finished. All work has not been finished as we discussed on the phone and in subsequent emails.”  Dates I confirmed making payment when work is completed: 9/27/16, 12/6/16, 12/23/16, 12/28/16, and 1/11/17. Each of these dates I have made clear I want the work finished so I can make payment. I have also clarified what work needs to be completed verbally, in writing, and in person. There has been ample opportunity and good weather for the work to be completed. In fact, 7 months of time has gone by since the job was started, yet none of the issues on the “punch list” requested back in October and again specifically in writing on 12/28/16 have been attempted or finished.  I missed no deadlines, rather I responded to the request within hours of the same day on 12/28/16 (note email timestamp).  Instead of the work being completed by 9/20 it continues to be left unfinished. This has been the same issue with two other customers of Zio Roofing. I’m in active communication with these two parties, whom have needed to seek legal representation due to neither one of their roofs being completed: one did not pass inspection and the other is leaking. Both paid [redacted] in full, yet their roofs were left unfinished, again despite Zio Roofing being paid in full. They have left over 12 messages with zero returned calls. When I asked [redacted] about this he acted surprised like this was news to him. He claimed he received none of these calls and knew nothing of the problems. He stated he would give the client, one of the two clients, a call. When I saw [redacted] two days later he stated he left a message. When I checked with the client, the client had received no such call. Not only was [redacted] not present throughout the day of install, but his workers were not competent in knowing how to complete the job.  Rotten boards were left in place that [redacted] stated, prior to the job being started, would be replaced. They are still unrepaired even though I pointed it out in person to both the crew and [redacted] on 9/20/16, as well as additional times since then.  Several other examples include: shingles being put down with no decking underneath, shingles stopping prior to a critical seam, and fiberglass roofing installed upside down rendering the UV protection void.  Additionally, the first day of install was to be 9/19/16 first thing in the morning. The same day they are to begin, I called [redacted] as no one showed up in the morning. He did not answer; I left a voice message. Not only did no one show up, but while I was at a scheduled appointment at [redacted] at 11:45am, I spoke with [redacted] and I was told my install needed to be rescheduled due to not getting supplies. The roof was to be finished prior to my leaving out of town on 9/21/16. [redacted] falsely claims I have been asked regarding compensation for the extra 5 hours I spent cleaning up debris. Not only have I not been asked, but the remaining debris is still not cleaned. In fact, the email dated 12/28/16 where it is listed under item #7 on the “punchlist” was not responded to in [redacted]’s email dated 12/28/16 at 6:33pm. [redacted] lists 1-6, number 7 is unaddressed. I looked again, however I did not see it addressed in any subsequent emails either. [redacted] has had 193 days of opportunity to complete the job to date. It remains unfinished. According to [redacted] law ([redacted]) Zio Roofing is to comply with providing a specific contract prior to beginning work and having standards for workmanlike performance. Sincerely,

We refused to complete anymore work until we received payment for the work we had completed on the roof. The [redacted] refused to pay us until the second week of February of 2017. This was nearly 5 months after completing the work. After the payment was received, we were still short the payment for the deductible. We were instructed by the [redacted], in writing, not to collect the deductible because they would.It is now the end of May, and we still have not received the deductible. We have been told it is being mailed to the [redacted], but we still haven't received it. We have notified the [redacted] 14 different times about not being paid the deductible, and we continue to get ignored. We refuse to call in the final inspection the permit for the roof until we receive this payment. We very easily could have filed a lien on this home because of the outstanding balance, but didn't because we didn't feel it was fair to the homeowner. The only leverage we have at this point, is to refuse to call in the final inspection until we are paid the deductible that we should have received in October of 2016.Once the payment for the deductible is received, we will call in the final inspection. Until then, we will pressured into calling in the final inspection so the owner can sell the home. We completed the job on November 16th. The home owner made no complaints, until we submitted a final invoice to her.  After we submitted an invoice that matched what her insurance company, [redacted], had approved, she demanded that we send her an invoice for over $2,000 less...

than what we had invoiced her insurance company for. In an attempt to get us to collude in committing insurance fraud with her, she tried to get us to invoice her for less than we invoiced her insurance company.  After we refused, she had complaints. Her roof passed two different inspections, including a sheathing inspection. Her claim that the work was not done to code is a lie. The roof passed a mid-roof inspection, sheathing inspection, and final inspection. We will upload documents showing this to the Revdex.com.  We attempted for almost a month to put together a list of items the home owner wanted fixed. We could never get her to agree on a final list. She went back and forth on multiple items and missed two deadlines for a completed punchlist for work to be scheduled.  The home owner is withholding over $8,400.00 since November, 2016 over $250 in "work" she claims still needs to be completed. None of these things concerned her until we refused to let her keep insurance proceeds that were approved for the work we completed.  If she will agree to a final punchlist, we will schedule the work like we've been attempting to do since December of 2016.

She complained about their lack of cleanup and disregard. It's hard for me to deal with a situation when I'm getting conflicting information from both home owners.

I am meeting with the home owner on Friday morning to go over his concerns with the siding.I will update with our action plan after the meeting.
