HelloThe Educational Publisher did publish the complainant's (Pen Name ** ***) initial book under the understanding that she would purchase personal copies, and promote the bookWe charged her nothing for the service, and posted the book in the usual online bookstoresAccording to our records,
she purchased no more than copies @$each, and only a few books were purchased onlineWe devoted time into setting up the first book, also at no costEverything went smoothly with that book, so we accepted her second book, assuming that it too would be easy to set up, and perhaps she would purchase/sell more copiesWe mentioned upon it's acceptance that the book would not be a priority and she said she understandWe set up the second book, ready to publish, and she sent a list of items that she wanted to changeWe considered this to be onerous, but determined that we would be willing to move on, but again, when time was availableWe received the 2nd book in JanWe agree that too much time has gone by for such a project, but we determined that the project was no longer worth the effortShe requested that we return the originals, and after a few promptings, we did soNo mention was made regarding any problems with the returned materials, so we assumed all was well and she had moved onI understand that the damage of the materials is a set back for her, and we would like to offer to send her the scans of the materials to replace the originals, including the book's work files. Hello,To clarify the situation, we determined that the project would not be profitable based on the previous projectWe did accept the project and invested time in setting up the book at no cost to the authorUpon request for further work to be done in July 2016, we later determined that it was not worth the effort to proceedThe materials were returned to the author earlier this yearThere was no contract for the work, and no compensation changed handsThe author had the ability to use a different avenue for publication at any time.As previously suggested, we will offer to send the author the work files for the book, but no further action will be taken.Bob S. I am rejecting this response because: This information is incorrect. I purchased at least personal copies of the first book. Not "no more than 20" as stated. Also, who are they to say I did not promote it & sell it? I did promote, sell and did readings, etc. But this complaint is not about the 1st book. This complaint is about the 2nd book.The response I got from Bob, relative to my list of revisions on the 2nd book dated 4/28/said "Great. I'll make the adjustments and try to find..." Etc. (I had previously submitted a copy of that response to you.) That response clearly indicated to me, they were publishing. That response did not say "oh sorry, this is onerous, we will not publish for you now". Now, almost a year later to decide they are not publishing is merely a result of my persistence and their growing tired of an old project haunting them. That is just poor business management.If they had decided the revisions were too much or the book was not worth their time, then I should have been advised of this in 2014.It is completely unfair to have kept leading me on and prevent me from seeking other opportunities all of this time. Thank You

I am rejecting this response because:  I could not pursue another avenue, because I was under the impression Zip was publishing it.  I could not proceed to submit it to another publisher, If I already had a potential agreement in place.  Additionally, Zip had all of my original watercolor prints.  I needed to hear an official decline to ensure I was not breaching any "understood" agreement that was potentially in place.   And again, when "Bob" got my response with revisions (side note, these were things we had already previously discussed, he just did not do them in the first proof print that was sent to me) he indicated "Great" and was going to proceed to print.  That was April of 2016.    If the decision was to decline to publish- I should have been advised at that moment.  Not almost a year later.
